COMPLAINT
Plaintiff files this Complaint pursuant to Pennsylvania Rules of Civil Procedure, PA
R.C.P. 2951 (b) for judgment by confession and avers the following:
I. Plaintiff is the Commonwealth of Pennsylvania for the use of the County of
Cumberland.
2. Defendant, James K. Lawlor an adult individual, with his principal office at 525
Penn Street, Reading, P A 1960 I.
3. Defendant, Frontier Insurance Company is an insurance company with its
principal office at 195 Lake Louise Marie Road, Rock Hill, New York 12775-8000.
4. Attached hereto and marked Exhibit A is a true and correct copy of the original
instrument duly executed by Defendant.
5. The attached instrument has not been assigned.
6. Judgment has not been entered on the attached instrument in any jurisdiction.
7. Contrary to the terms and provisions of the written instrument, on May 7, 1996,
Alex Davis failed to appear as ordered before the Court of Common Pleas of Cumberland
County, PA to answer and defend the charges of Unlawful Possession Schedule II Controlled
Substance and Unlawful Delivery or Manufacture or Possession With Intent to Deliver a
Schedule II Controlled Substance in the case docketed No. 0931 Criminal 1995, and Defendant,
his surety, failed to produce the body of Alex Davis at that proceeding, all of which constitutes a
default under the written instrument, whereby Plaintiff exercises its option to declare the entire
balance of the within instrument immediately due and payable.

Bail was forfeited on May 7, 1996, by Order of Court attached hereto and marked

6. On or about May 7, 1996, the Court issued a bench warrant and ordered
that the bail be forfeited to the County of Cumberland in Commonwealth 1'. Alex Davis,
95-0931 Criminal Term.
7. On or about July 26, 1996, Smith Bonding Group received a letter
addressed to James K. Lauter from John Ward, Chief Clerk for the Commissioners of
Cumberland County, advising him that the bond had been forfeited on May 7, 1996.
8. More than two and one-half months passed from the date of the forfeiture
until the Agent for the Frontier Insurance was sent a letter.
9. Rule 4016(b) of the Pennsylvania Rules of Criminal Procedure, the
applicable rule governing notice at the time of the forfeiture, provided as follows: "Upon
such declaration written notice of such forfeiture shall be given to the surety either
personally or by certified mail at his last known address." Pa.R.Crim. P. 4016(b)(emphasis
added)(Rule effective through June 30, (996).
10. In the matter of Comnumwealth I'. Alex Davis, 95-0931 Criminal Term,
Cumberland County failed to provide timely written notice in accordance with Rule
40 16(b) of the Pennsylvania Rules of Criminal Procedure either by personal service or
certified mail.
II. Rule 4016(e)(I) and (2) of the Pennsylvania Rules of Criminal Procedure

Petition to Open Judgment Entered By Confession, and respectfully represents as follows:
I. Mr. Lawlor was a duly authorized agent and Attorney-in-Fact of Frontier

Insurance Company (Frontier), a company lawfully authorized to write bail bonds under
and subject to the laws of the Commonwealth of Pennsylvania. Mr. Lawlor's business
address is 525 Penn Street, Reading, Pennsylvania.
2. Mr. Lawlor and Frontier provided a surety bond for the criminal defendant
Alex Davis in the amount of Twenty-Five Thousand Dollars ($25,000.00) on May 31,
1995, for the appearance of Mr. Davis at various stages of the criminal proceedings in
Commomvealtll v. Alex Dal';s, 95-093 I Criminal Term in the Court of Common Pleas of
Cumberland County.
3. On January 28, 1998, the County of Cumberland confessed judgment

4. Immediately upon notice of the entry of Judgment, petitioners have
petitioned this Court to open the Judgment.

5. Pctitioners have meritorious defcnses to the pending action as follows:
FIRST DEFENSE
6. On or about May 7, 1996, the Court issucd a bench warrant and ordered
that the bail be forfeited to the County of Cumberland in Commonwealtll I'. Alex Dal'is,
95-0931 Criminal Term.
7. On or about July 26, 1996, Smith Bonding Group received a letter
addressed to James K. Lauter from John Ward, Chief Clerk for the Commissioners of
Cumbcrland County, advising him that the bond had been forfeited on May 7, 1996.
8. More than two and one-half months passed from the date of the forfeiture
until the Agent for the Frontier Insurance was sent a letter.
9. Rule 4016(b) of the Pennsylvania Rules of Criminal Procedure, the
applicable rule governing notice at the timc of the forfeiture, provided as follows: "Uoon
such declaration written notice of such forfeiture shall be given to the surety either
personally or by certified mail at his last known address." Pa.R.Crim. P. 4016(b)(emphasis
added)(Rule effective through June 30, 1996).
10. In the matter of Commonwealtl, I'. Alex DaI'i.v, 95-0931 Criminal Term,
Cumberland County failed to provide timely written notice in accordance with Rule
40 16(b) of the Pennsylvania Rules of Criminal Procedure either by personal service or
