CUSTODY PETITION FOR EMERGENCY RELIEF AND NOW, comes the Plaintiff, Mary Ellen Charbonnier, by and through her attorney, Gary L, Kelley, and files this Petition for Emergency Relief and in support thereof respectfully avers as follows: 1. Plaintiff is Mary Ellen Charbonnier who resides at 440 Market Street, New Cumberland, Cumberland County, Pennsylvania 17070 with her minor child. Tommy Gilliland, DOB 8/25/86, 2. Defendant is James R, Gramley who resides at 748 Erford Road, Camp Hill, Cumberland County, Pennsylvania 17011. 3. The parties are not married, 4, The parties are the parents of a minor child, Krystal Gramley, DOB 1/14/95, 5. The parties previously resided together, 6. The parties separated in June 1997 after having resided together for approximately l'our (4) years, 7, During this period, Plaintiff was forced to leave the residence on at least two (2) occasions because of domestic violence, 8, As a result, Plaintiff obtained a Protection From Abuse Order against Defendant wherein Defendant was granted supervised visitation of the minor child, 9, Plaintiff and Defendant ultimately attempted to reconcile and began residing together again, 10. The parties were unable to work out their differences and Plaintiff left the residence in June 1997 as previously stated, 1 I. Since the parties' separation, they have shared custody of the minor child on a week by week basis, 12, On or about January 17, 1998, Defendant called Plaintiff and informed her that he would no longer share custody with Plaintiff and has refused to allow her to see the child since this date, 13. Defendant alleged that the minor child had been abused by Plaintifrs son, Tommy, the minor child's half-brother, 14. The minor child has always been closely supervised by Plaintiff and Tommy has never had any inappropriate contact with the minor child, 15, Defendant previously threatened Plaintiff that she "would never see the child again" if she left him, 16, Plaintiff believes that Defendant has undertaken this course or conduct for the sole VERU'ICATION I hereby verify that the statements contained herein arc true and correct.
