COMPLAINT
I. New Cumberland Federal Credit Union is a federally chartered non-profit credit
union with its principal place of business being 345 Lewisberry Road, New Cumberland,
Pennsylvania 17070.
2. Defendant James H. Shutt presently resides at Apartment E _ 180, 720 I Northwest
16th Street, Plantation, Florida 33313.
3. Defendant Ruby A. Shutt presently resides at 332 SW 80th Avenue, North
Lauderdale, Florida 33068.
4. On or about July 9, 1996 Defendants executed a Promissory Note and Disclosure
Statement as "borrowers" in favor of the Plaintiffin the amount of Twenty Eight Thousand One
Hundred Ninety Three and 15/100 Dollars ($28,193.15) at 12.90% interest. A true and correct
copy of the foregoing document is attached hereto as Exhibit "A".
5. Defendants have made no payments to the Plaintiff since November 13,1997.
6. Defendants' monthly payment under the Promissory Note was $636.84.
7. As of January 22, 1998 the principal balance remaining unpaid was $23,031.48.

Complaint which have now been admitted by operation ofPa. R.C.P. ]029 (b):

4. On or about July 9. 1996 Defendants executed a Promissory Note and
Disclosure Statement as "borrowers" in favor of the Plaintiff in the amount of
Twenty Eight Thousand One Hundred Ninety Three and 15/100 Dollars
($28,193.15) at 12.90% interest. A true and correct copy ofthe foregoing
document Is attached hereto as Exhibit "A".
5. Defendants have made no payments to the Plaintiff since November
13,1997.
7. As of January 22. 1998 the principal balance remaining unpaid was
$23,031.48.

8. As of January 22. 1998 the past due interest was $569.78 accruing at
$8.14 per day.
9. Under the tenns of the Promissory Note Defendants must repay the
Plaintiff its attorneys fees and all costs of collection.

financed); interest rate of 12.90%; and the regular monthly payment of$636.84. Clearly, the
Defendants could explain. if they had any basis to do so - why this paragraph should be denied.
Similarly, the Defendants issued a general denied when confronted with the date of their last
payment (November 13, 1997); per diem interest rate ($8.14); past due interest as of January 22,
1998 ($569.78); and the right of the Credit Union to recover reasonable allomeys' fees which
appears on the face of Exhibit "A" under the "Note and Security Agreement" paragraph.
II. PLAINTIFF IS ENTITLED TO JUDGMENT ON THE PLEADINGS BECAUSE
THERE ARE NO GENUINE ISSUES OF MATERIAL FACT AND THE CREDIT
UNION IS ENTITLED TO JUDGMENT AS A MATTER OF LAW.
In conducting an inquiry into whether a motion for judgment on the pleadings should be
granted, the court should confine itself to the pleadings themselves and any documents or
exhibits properly allached to them. Gallo v. J.e. Penney Casualty Insurance Co., 328 Pa.
Super. 267, 270, 476 A.2d 1322, 1324 (1984). In this case the only exhibit is the Promissory
Note selling forth all the essential terms and damages recoverable in the event of a breach which
is properly allached to the Complaint. The Defendants chose to respond with general denials to
each factual allegation, therefore, each general denial must be treated as an admission in
accordance with Pa. R.C.P. 1029 (b).
It is well settled law in this Commonwealth that general denials are deemed admissions
pursuant to the provisions of Rule 1029 (b). See First Wisconsin Trust Company v. Midlantic
Home Mortgage Corporation, 439 Pa. Super. 192,653 A.2d 688 (1995) and Cercone v.
Cercone, 254 Pa. Super. 381, 386 A.2d I (1978). In this case the Defendants have admilled each
factual allegation set forth in the Complaint and, therefore, Plaintiff is entitled to judgment in its
favor as set forth in the prayer for relief.

CONCLUSION:
Defendants have admitted all of the factual allegations sct forth in the Complaint and
Plaintiff is entitled to judgment on the pleadings in its favor in the amount $23,031.48 plus all
costs ofeollcetion, court costs, reasonable attorneys' fecs and 12.90% interest calculated at $8.14
