5. In addition, Defendant has violated the mles of the mobile home park, a copy of
which is all ached hereto as Exhibit "B." Defendant has breached Rule IQ, 2B through 2M, 40,
4E, and 5E of the regulations.
6. Plaintiff properly posted and scntnotification to the Defcndant setting forth the
violations of the lease and the mles,
7. TIle case was heard by District Justice Susan K. Day, and judgment was entered in
favor of the Plaintiff on January 26, 1998.
8. On Febmary 4, 1998, the Defendants appealed to this Court. A true and correct
copy of that appeal is attached hereto as Exhibit "C."
WHEREFORE, Plaintiffhas made demand upon Defendant for payment of the sum of
$894.00 for rent, $352.00 for late fees, $186,90 for legal fees and costs of$85,73, for a total of
$1,518.63. In addition, the Plaintiff requests that it receive tile sum of$250.00 pcr month from
the time offiling this Complaint for future rents for tile months of March and thereafter. TIle
Plaintiff also requests possession of the premises.

LESSEE.
Whereas, Lessor owns and operates a mobile home park in which Lessee desires
to occupy a mobile home site.
NOW THIS AGREEMENT WITNESSETH, that the parties hereto, for and in consideration
of the mutual covenants contained herein, and intending to be legally bound
hereby agree as follows;
1. The rent shall be $ ;;;> 30, -per month, payable on the first
day of each month.

4. Tenants shall, upon execution of this Lease, deposit with
Landlord as security for the performance of all the terms, covenants, and
conditions of this Lease, a sum in the amount of one month's rent, to be retained
by the Landlord until the end of the original term and any extended terms of
this Lease. Upon termination of this Lease, by d~fault or otherwise, the
security'deposit shall be returned to tenant, less any charge for damage to the
leased premises, rent arrearages, or charges treated as rent arrearages.
Tenant agrees to leave a forwarding address with the ,Landlord upon vacation
of the leased premises to facilitate the return of the security deposit as
above set forth.

5. The Lessee agrees to and shall sve, hold and keep harmless
and indemnify the Lessor from and for any and all payments, expenses, costs,
attorneys fees and from and for any and all claims and liabilities for losses
or damage to property or injuries to persons occasioned wholly or in part by
or resulting from any act or ommissions by the Lessee or the Lessee's guests,
licensees, invitees, or for any cause or reason whatsoever arising out of or by
reason of occupancy by the Lessee.
6. If the demised premises shall be taken under eminont domain or
condemnation proceedings, or if the Lessor conveys the said premises to any
governmental authorities seeking to take the said premises, or if there is a
change in the use of the park land, or parts thereof, or termination of tho
park, then this Lease, at the option of the Lessor, shall terminatu and the
term hereof shall end as such date as the Lessor shall fix by nol:ice. LOBS~O
shall have no claim or interest in the compensation received by LeBsor for
such taking.
7. If the Lessee shall fail to comply with any conditions and
covenants hereof, the Lessor may perEorm such conditions and covenants, at
the cost and expense of the Lessee, and the said costs and expenses shall be
added to the next installment of rent and shall be payable as Buch.
8. The Lessee agrees that the Lessor and ~he Lessor's agents,
employees or other representatives, shall have the right to enter into and
upon the said premises'consisting of the lot which is the subject of this Lease
or any part thereof, at all reasonable hours, for the purpose of examining
the same or making such repair or alterations therein as may be necessary
for the safety and preservation thereof. This clause shall not be deemed to be
covenant by the Lessor nor be construed to create an obligation on the part
of the Lessor to make such inspection or repairs.
9. All goods and personal property of any kind in or upon the
leased premises shall be the sole responsibility of the Lessee, and in no . '
event shall Lessor be liable for any loss or damage to said goods or property
for any reason whatsoever.
10. The Lessee shall take good care of the premises and shall
maintain the premises in good condition, and upon vacating the premises, either
at the expiration of the term or for any reasons, shall deliver the rented
premises in good order and condition, wear and tear from a reasonable use
thereof, and damage by the elements not resulting from neglect or fault of
the Lessee excepted. The Lessee shall neither encumber nor obstruct the
sidewalks, driveways or yards, but shall keep and maintain the same in a
clean condition, free from debris, trash, refuse, snow or ice. Lessee
further agrees to maintain the premises so that grass or other ground cover,
excluding shrUbs, trees and flowers, shall not be permitted to exceed three
inches in height.
11. The Lessee may not sublet the premises or any portion or
part thereof. The Lessee may sell the mobile home belonging to the Lessee,
but, following the sale, if the mobile is to remain in the park with a new
owner, written approval of the new Lessee is required, and this approval must
be obtained prior to sale.
12. Lessor shall not be liable for failure to give possession of
the leased premises to the Lessee upon the effective date of this Lease.
In such event, rental payment and other fees, charges or assessments shall not
commence until possession is given to, or is made available to the Lessee, and
the term of the Lease shall be extended accordingly.
13. Any equipment, fixtures, goods or other property of the
Lessee not removed by the Lessee upon quitting, vacating or abondment of the
premises by the Lessee, or upon the Lessee's eviction, shall be considered as
abandoned and the Lessor shall have the right, without notice to the Lessee,
to sell or otherwise dispose of the same at the expense of the Lessee and
shall not be accountable to the Lessee for any part of the proceeds of the
sale, if any.
14. The Lessor shall not be liable for any damage or injury
which may be sustained by the Lessee or any other persons, as a consequence of
the failure, breakage, leakage or obstruction of the water, sewer, waste, or
soil pipes, or the electrical, gas or oil system; or by reason of the elements;
or resulting from the carelessness, negligence or improper conduct on the part
of any other Lessee or the Lessor or the Lessor's or this or any other Lessee's
agents, guests, licensees, invitees, sublessess, assignees or successors; or
attributable to any interference with, interruption of or failure, beyond the
control of the Lessor, of any services to be furnished or supplied by the Lessor.
15. The various rights and remedies of the Lessor expressed herein
are cumulative, and the failure of the Lessor to enforce any such right or remedy
at any time against the Lessee shall not constitute a waiver thereof.
16. Lessee shall pay all county, municipal and school district
real estate taxes assessed and levied against his home and personal property,
and shall furnish Lessor, when requested, with proof of payment of same.
Failure to pay such taxes, when due shall be a violation of the Lease, rules,
or regulations, if any, and constitute default thereunder.
17. The Lessee hereby confesses judgement in favor of the said
Lessor for the whole amount of the rent at any time remaining unpaid, and any
other charges incurred hereunder, whether the same shall have been due or not,
waiving a stay of execution, inquisition and all exemption laws now in force or
which may hereafter be passed, and authorizes the adding of Fifteen (15%) per
cent attorney's commission for the collection; and further does hereby, upon
breach of any of the conditions of this Lease, including non-payment of rent or
violation of rules and regulations, if any, authorize any attorney of any
court of record to appear for him and enter an amicable action of ejectment and
confess a judgement of ejectment therein for the premises herein described and

does authorize the immediate issuing of a writ of possession and execution for
cost without asking leave of the court. A photocopy of the Lease may be used
for confession of judgement for unpaid rent, of for confession of judgement in
ejectment. Such remedies shall be cumulative, and not alternative, and may be
re-oxercised as necessary.
18. The Lessee shall conform to all rules and regulations made by
the Lessor for the use and government and management of this mobile home park
to protect tho entire premises of the Lessor and to further the general
comfort and welfare of all of. the occupants, which rules and regulations, and
any changes thereto hereafter adopted, are attached hereto and incorporated
herein or reference, and made a part hereof, and are covenants and conditions
of this Lease, the same as if fully set forth herein. Lessor shall furnish
with notice of all changes in said rules and regulations. Lessee acknowledges
receipt of a copy of such regulations concurrent with execution of this Lease.
19. If proceedings shall be commences by Landlord to recover
possession under Acts of Assembly, either at the end of the term or sooner
terminations of this Lease, or for nonpayment of rent, or for any other reason
Tenant specifically waives the right to fifteen or thirty days" notice
required by Act of Assembly of April' 28, 1983. P.L. 202, and agrees that five
days' notice shall be sufficient in either or any such case.
20. The Lease, and the aforesaid rules and regulations, constitute
the entire agreement between the parties and same is not subject to any oral
modification. Further, this agreement shall be legally binding upon the parties
hereto, and their respective heirs, successors and assigns. If any information
provided by the Lessee, whether by way of background, financial or otherwise
which has induced the Lessor to enter into this Lease, is found by the Lessor
to be false, the Lease shall, at the option of the Lessor and upon notice
to the Lessee, be null and void and the Lessee shall be considered a tresspasser.
21. Lessor may from time to time modify, change or revoke rules for
the mobile home park and upon notice to the tenant, these rules shall be incor-
porated herein with the same force and effect as though they were in force at
the time this Lease was executed.
22. Lessee agrees that he has read this Lease Agreement, under-
stands its terms and the rules and regulations of the mobile home' park ,and
agrees to be bound thereby.
THE TENANT MUST GIVE AT LEAST 30 DAYS NOTICE IN WRITING PRIOR
TO MOVING. IT IS THE RESPONSIBILITY OF THE TENANT TO PROVIDE MANAGEMENT WITH
ALL NECESSARY COMPLETED STATE OR LOCAL GOVERNMENT FORMS.

COME NOW the defendants, Alan Golden and Lori Golden, by
counsel, Philip C. Briganti, Esquire, Legal Services, Inc., and
as their Answer to Plaintiff's Complaint respectfully represent
as follows:

4. Admitted in part and denied in part. Whether defendants
breached the lease agreement by failing to pay the rent as
alleged in plaintiff's Complaint is a conclusion of law and/or

have failed to pay monthly rent in the amount of $144.00 for the
month of November 1997, and $250.00 for the months of December

there are late charges in the amount of $352.00 and attorney's
fees in the amount of fifteen percent (15%) of the amount owed.
5. The averments set forth in Paragraph 5 of Plaintiff's
Complaint constitute conclusions of law and/or fact to which no
response is required. If it is jUdicially determined that a
response is required, Defendants aver that they have either not
violated or breached the rules and regulations of the mobile home
park set forth in Plaintiff's Complaint, or have cured any
alleged violations of which they have been notified as
contemplated by the Mobile Home Park Rights Act.
6. Denied. Defendants deny that Plaintiff properly posted
and sent notification to the defendants setting forth the alleged
violations of the lease and rules.

NEW MATTER
I. Late Charqes are Unenforceable as a Penaltv
9. Rule 1E of Plaintiff's RUles and Regulations provides
that "[a]ny rents not received by the fifth day of each month
will receive a late charqe of Ten ($10.00) Dollars and will be
increased at the rate of One ($1.00) Dollar per day until rent is
paid in ful1." (emphasis in original). See Plaintiff's Exhibit
"B", which is incorporated herein by reference.
10. The late charges imposed by Plaintiff are excessive,
bear no rational relationship to losses suffered or reasonably
anticipated to be suffered by Plaintiff as the result of the late
payment of rent and are unenforceable as a penalty.
II. Late Charaes are Unconscionable
11. Defendants repeat and incorporate by reference their
averments set forth above in Paragraphs 9 and 10.
12. Defendants had no meaningful bargaining power in
negotiating the terms of their lease with Plaintiff or the Rules
and Regulations incorporated therein, rendering said lease a
contract of adhesion.
13. Plaintiff's late charges are oppressive, outrageous,
unconscionable and therefore unenforceable.
III. Late Charaes are Unfair and Unreasonable
14. Defendants repeat and incorporate by reference their
averments set forth above in Paragraphs 9 through 13.
15. Rule 1E of Plaintiff's Rules and Regulations, with
respect to late charges, is not a fair or reasonable rule or
regulation reasonably related to the health or safety of
residents in the park or to the upkeep of the park, in violation
of section 4 of the Mobile Home Park Rights Act (68 P.S. section
398.4) .
IV. Excessive Late Charaes Violate Unfair Trade Practices
and Consumer Protection Law
16. Defendants repeat and incorporate by reference their
averments set forth above in Paragraphs 9 through 15.
17. Plaintiff is engaged in the conduct of "trade" or
"commerce" within the meaning of the Unfair Trade Practices and
Consumer Protection Law, 73 P.S. section 201-1 et ~
18. The imposition of late charges as set forth in
Plaintiff's Lease, and Rules and Regulations, constitutes an
unfair or deceptive act or practice within the meaning of section
3 of the Unfair Trade Practices and Consumer Protection Law (73
P.S. section 201-3).
V. Uneaual Enforcement of Park Rules and Reaulations
19. Pursuant to section 3 of the Mobile Home Park Rights
Act, "[a] mobile home resident shall not be evicted when there is
proof that the rules he is accused of violating are not enforced
with respect to the other mobile home residents or nonresidents
on the park premises." 68 P.S. Section 398.3(c).
20. Rules 1Q, 2B though 2M, 40, 4E and 5E of Plaintiff's
Rules and Regulations are not enforced with respect to the other
mobile home residents or nonresidents on the park premises, and
therefore cannot constitute grounds for evicting Defendants.
VI. Attornev's Fees provisions Unenforceable
21. The parties' lease, including but not limited to
Paragraph 17 concerning attorney's fees, does not meet the
requirements of the "test of readability" set forth under the
Plain Language Consumer Contract Act, 73 P.S. section 2201 et
sea. See Plaintiff's Exhibit "A".
22. Defendants had no meaningful bargaining power in
negotiating the terms of their lease with Plaintiff, rendering
said lease a contract of adhesion.
23. The attorney's fees provisions in the parties' lease
are unenforceable.
VII. Failure to File Eviction Action in a Timelv Manner
24. Plaintiff failed to file an eviction action against
Defendants within sixty (60) days of any last alleged violation
of RUles 1Q, 2C, 2D, 2E, 2F, 2G, 2H, 2I, 2J, 2K, 2L, 2M, 40 and
4E, as required by section 3 of the Mobile Home Park Rights Act
[68 P.S. Section 398.3(b) (2) (ii)).
VIII. Defendants Have Not Violated Anv Rules Two
or More Times Within six Month Period
25. Defendants have not violated any of Plaintiff's Rules
and Regulations two or more times during a six-month period,
which is a prerequisite to commencing an eviction action against
them, pursuant to Section 3 of the Mobile Home Park Rights Act
[68 P.S. Section 398.3(b)(2)(ii)).
WHEREFORE, Defendants pray that Plaintiff's action be
dismissed and that judgment be entered in their favor.
COUNTERCLAIM
I. Collection of Excessive Late Charqes
26. Defendants repeat and incorporate by reference their
averments set forth above in Paragraphs 9 through 18.
27. Since March 1995, when Defendants commenced leasing
their mobile home lot from Plaintiff, Plaintiff has demanded, and
Defendants have paid, late charges purportedly required by the
parties' lease agreement and rules and regulations.
28. Said charges were unlawful and excessive.
WHEREFORE, Defendants pray that judgment be entered in their
favor and against Plaintiff in the amount of all late charges
they have paid to Plaintiff, and that they be granted such other
and further relief as this Court may deem reasonable and just.
II. Violation of the Plain Lanauaae Consumer Contract Act
29. Defendants repeat and incorporate by reference the
averments set forth above in Paragraphs 9 through 18 and 21 through
23.
WHEREFORE, pursuant to section 7 of the Plain Language
Consumer Contract Act, 73 P.S. section 2207, Defendants request
that the Court grant them the following relief:
a. statutory damages of $100.00;
b. declare that the attorney's fees and late charge
provisions in the parties' lease and park rules are unenforceable;
c. award to Cumberland County, one of Legal services, Inc.'s
funding sources, the costs of pursuing this claim in lieu of
attorney's fees;
d. such other and further relief as this Court may deem
reasonable and just.
III. violations of the Unfair Trade Practices
and Consumer Protection Law
30. Defendants repeat and incorporate by reference their
averments set forth above in Paragraphs 9 through 29.
31. Plaintiff's acts as described herein constitute unfair or
deceptive acts or practices within the meaning of the Unfair Trade
Practices and Consumer Protection Law, 73 P.S. section 201-1 et
sea.
WHEREFORE, pursuant to section 9.2 of the Unfair Trade
Practices and Consumer Protection Law, 73 P.S. Section 201-9.2,
Defendants request that the Court grant them the following relief:
a. actual damages or $100.00, whichever is greater;
b. three times Defendant's actual damages;
c. award to Cumberland County, one of Legal Services, Inc.'s
funding sources, the costs of pursuing this claim in lieu of
attorney's fees;
d. such other and further relief as this Court may deem

Mobile Home Park, by and through its counse~ Kollas and Kennedy, and respectfully petitions
this court to discontinue and settle this case and in support, states the following:
1. Kollas and Costopoulos is a Pennsylvania partnership comprised of William C.
Kollas and William C. Costopoulos whose principal place of business is 1104 Femwood Avenue,
Camp Hill, Pennsylvania 17011, and is the Plaintiff herein.
2. Alan and Lori Golden, et al, are adult individuals residing at 37 Regency Woods
North, Carlisle, Pennsylvania 17013, and they are the Defendants herein.
3. This is a landlord/tenant case and the Cumberland County Prothonotary's Office is
holding rent payments made to the Prothonotary's Office by Defendants in the amount of
$1,250.00 .
4. This matter is resolved by the parties 8S evidenced by the Agreement attached
hereto and marked as Exhibit "A"

WHEREAS, the Lessees desire to remain in the Regency Woods North Mobile Home
Park; and

NOW, THBREFORE, the panies hereto, esch intending to be legally bound hereby, and
in consideration of the terms and conditions herein set forth, agree as follows:
1. The Lessees will adhere to the rules of the mobile home park, specifically Rule lQ,
2B through 2M, 4D, 4E, and 5E, I copy of those rules is attached hereto and Lessees
Icknowledge receipt of same.
2. In the event Lessor receives complaints, or on inspection. determines that there are
breaches of the rules by Lessees, Lessor will notifY both the Lessees and the Legal
Services, Inc., 8 Irvine Row, Carlisle, Pennsylvania, specifically Philip C. Briganti or his
successor, of the alleged breach of rules.
3. Lessees shall have fifteen (15) days within which to either correct the breach or
respond to Lessor as to why there is no breach or why said breach cannot be remedied.
4. With fifteen (15) days thereafter, Lessor and Legal Semces, Inc., specifically
Philip C. Briganti, will determine what course of action will follow. .
S. In the event Philip Briganti and LeSsor agree that I breach has occurred. contruy
to either the lease or the rules of the park, and said breach has not been remedied. Lessees
agree to vacate the park within ninety (90) days thereafter.
6. Lessees further agree to pay all rents on time and to bring the rents current IS of
the dat~ of the execution of this agreement or on April 1, 1998, whichever shall first
occur.
