COMPLAINT
Now comes the Plaintiff by and through his Attorney, H.
Anthony Adams, Esquire, and sets forth the following:
1.
Plaintiff is Michael C. Gardner of 107 Clay Hill Road,
Newburg, Cumberland County, Pennsylvania.
2.
Defendant is James J. Doran of P.O. Box 988, Bryn Mawr,
Pennsylvania.
3.
On or about January 14, 1963, Mae B. Doran conveyed lands in
Hopewell Township, Cumberland County, Pennsylvania, to herself and
her son as joint tenants and not as tenants in common. A copy of
the Deed is attached hereto and made a part hereof, being marked
"Exhibit A".
4.
On or about January 13, 1969, Mae B. Doran conveyed all her
interest in the said lands to eight of her nine children, namely
June I. Edwards, Mary D. Jackson, Edward J. Doran, III, Angela M.
Burgin, Cabrini Doran, Dorothy A. Doran, David F. Doran and James
J. Doran. A copy of the deed is attached hereto and made a part
hereof, being marked "Exhibit B".

In the deed listed as Exhibit B, it was the express intent of
Mae B. Doran to sever the co tenancy.

6.
William F. Doran had resided upon the land listed in Exhibit
"A" from 1991 and has exercised exclusive hostile and open sole
possession of the land since 1969.
7.
since 1969 no action in ejectment or petition for partition
has been filed by any of the Defendants, their heirs, executors or
assigns.
8.
william F. Doran died on November 12, 1996.
9.
At the time of his death, William F. Doran had acquired full
and complete title to the said lands by adverse possession.
10.
Beginning in 1963 and continuing until his time of death,
william F. Doran paid all real estate taxes, made all necessary
repairs and maintenance and made major improvements to the real
estate.
11.
None of the Defendants, their heirs, executors or assigns made
any contribution in any manner to the real estate.
12.
Defendants are estopped from making any claim against the said
real estate.
Wherefore, the Plaintiff prays your Honorable Court enter an
order awarding full and complete title to the real estate to the
Estate of William F. Doran.
