Neither the Plwntiff nor the Defendunt is u member of the military or naval service of the United Stutes or its allies within the provisions of the Soldiers and Sailors Relief Act of the Congress of 1940 and its nmendments. 9. The parties have been separated since September 1997. WHEREFORE, Plaintiff requests the Court to enter a decree of divorce based upon the separation of the parties and the irretrievable breakdown of the marriage. COUNT II . FAULT GROUNDS 10. The averments set forth above are incorporated herein. 11. During the course of the marriage, the Defendant caused the Plaintiff to become personally liable on various debts incurred by Defendant, relating to Defendant's individual and corporate business activities. 12, Without notice, the Defendant left the marital residence in September 1997, leaving Plaintiff liable for various debts, and leaving her to defend against various legal proceedings for debts which are not of her making. IS. Since the separation of the parties, the Defendant has failed to contact the Plaintiff or to make his whereabouts known. To date, Plaintiff is unaware of his place of residence. 14. During the marriage, the Defendant induced Plaintiff to provide for Defendant in various financial ways, by misrepresenting his own background and financial status, and by misrepresenting his intentions regarding the marriage itself. ~ 15. The Defendant has olTered such indignities to his innocent and injured spouse as to render that spouse's condition intolerable and life burdensome. 16. The Defendant has committed wlllful and mulicious desertion and absence from the habitation of the innocent and injured spouse, without a reasonable cause, justifying a dissolution of the marriage. 17. The Defendant induced Plaintiff into this marriage by misrepresenting to her his history of prior marriages, and by failing to reveul to the Plaintiff how many times he had been married prior to this marriage. WHEREFORE, Plaintiff requests the Court to enter a decree of divorce based upon the fault grounds set forth above. COUNT III . EQUITABLE DlSTRIDUTION 18. The averments set forth above are incorporated herein. 19. The parties are subject to various debts, which are subject to equitable dilltribution between them as marital debts. WHEREFORE, the Plaintiff requests the Court to equitably divide such marital debt between them. COUNT IV . COUNSEL FEES, COSTS AND EXPENSES 20. The averments set forth above are incorporated herein. 21. Plaintiff is not in a financial position to meet the costs and expenses of prosecuting this action and to pay reasonable counsel fees to her attorney. Milkes, Jacobsen & Milkes, and respectfully requests of this Honorable Court that it allow her to make service upon the Defendant by publication, pursuant to Rule 430 of the Pennsylvania Rules of Civil Procedure. In support of this Petition, Plaintiff avers as follows: 1. On February 6, 1998, Plaintiff filed the above styled Divorce Complaint. 2. The last known address of the Defendant is the Plaintiff's residence, where she continues to reside, at 106 North Locust Lane, Mechanicsburg, Pennsylvania 17055. 3. The Defendant does not live at or accept mail at this address. 4. The Plaint.iff attempted service upon the Defendant by mAiling the Complaint to 126 Mayfair Road, Hattiesburg, Mississippi 39402, a location where one of the Defendant's creditors said he may be accepting mail. 5. Mail to this address was returned as "Attempted Not Known." A copy of this envelope is attached as Exhibit A. 6. The Plaintiff and her counsel have inquired of postal authorities as to a forwarding address of the Defendant but there is none. l:, , , 7. The Plaintiff and her counsel have inquired of neighbors, friends, ., creditors and employers Il6 to the Defendant's whereabouts but none are able to identify his location. /:, ., , 8. The Plaintiff is unaware of any living relatives of the Defendant. 9. Examination of local telephone directories, voter registration records, local tax records, and motor vehicle records all reveal expired addresses or the Plaintiff's current address. 10. One of the averments of the Plaintiff's Divorce Complaint entitling her .- , to a divorce is that the Defendant deserted her. 11. The Plaintiff has not spoken to, corresponded with, or in any way communicated with the Defendant, his family or agents since October 1997, when the Defendant deserted Plaintiff. 12. Before the marriage of the parties on May 22, 1997, Plaintiff was in solid financial condition. Due to various fraudulent business activities of the Defendant . I before and since the marriage date, Defendant caused Plaintiff to be significantly in debt, to the extent that Plaintiff was forced into bankruptcy solely for the purpose ! , of extinguishing the business related debts incurred as a result of Defendant's business practices. 13. Since Defendant's desertion of Plaintiff, he has taken with him, or in some way disposed of new vehic1es,lell6ed in Plaintiff's name or the name of business enterprises created by the Defendant. 14. The Defendant would have to be aware that if he is located, he will be held responsible for large amounts of debt which he incurred. 15. Plaintiff believes the Defendant is concealing his whereabouts in order to avoid debt and to avoid the Plaintiff. 16. Collection on one of Defendant's creditors, Keystone Financia1lPennsylvania National Bank, was referred to a collection agency called Roquemore & Roquemore, Inc. In connection with this agency's efforts to collect this debt, the agency communicated regularly with the Plaintiff, and followed leads she WIl6 able to offer, as well as other developed leads. This agency also spoke with individuals where the Defendant was believed to have lived at one point but was unable to locate him. 17. The attached letter from this collection agency, Exhibit B, is a true and correct copy of its communication to Plaintiffs counsel. The letter confirms that: We were able to locate Ms. vernon and had numerous discussions with her. She was very cooperative and gave us information to aid in our search for John Dean Raffensberger. We pulled TRW traces and researched every address available and spoke with nearbys to no avail. [W]e traced Mr. Raffensberger from Pennsylvania to Tennessee to Florida. Had an [sic] two different agents run addresses in Pennsylvania and Florida. Our search was not successful. 18. At this time, Plaintiff is unaware of any further efforts which could be made to locate the Defendant. A divorce complaint was filed on February 6, 1998, raising grounds for divorce of irretrievable breakdown of the marriage, indignities, and willful and malicious desertion, The complaint also raised the economic claims of equitable distribution and counsel fees and expenses, I am directing counsel for Cathleen P. Vernon and Mr. Raffensberger, who is apparently unrepresented, to each file a pre-trial statement in accordance with P.R,C.P, 1920,33(b) on or before Monday, February 1, 1999, Upon receipt of the pre-trial statements, I will immediately schedule a pre-hearing conference with counsel and with Mr. Raffensberger to discuss the issues and, if necessary, schedule a hearing. I am sending this letter to the last known address which we have for Mr, Raffensberger. It does not appear, however, that he will receive the notice of the filing of pre-trial statements because apparently the address that he has been using is no longer an address where he is getting mail. If Mr, Milkes determines that we need to proceed with the scheduling of a hearing on the alternative grounds for divorce of willful and malicious desertion or indignitiesr he should so advise and then .
