ANSWER WITH NEW MATTER AND COUNTERCLAIM
AND NOW, comes the Defendants, Michael S. Smetana, Vd/b/a Smetana
Contracting, and Michael S. Smetana and Douglas Kann, Vd/b/a Smetana & Kann
Electric, by their attorneys, Frey & Tiley, and files the following Answer to the Plaintiffs'
Complaint in the above referenced matter, of which the fOllowing is a statement:
1, Admitted.
2. Adrnitted.
3, Admitted in part, denied in part. The first sentence of the averments of
paragraph three of Plaintiffs' Complaint makes no sense, It is admitted, nevertheless,
that toward the end of June, or beginning of July of 1996, the Plaintiffs and Defendants
did discuss the construction of a kennel on Plaintiffs' property and Defendants did
estirnate the cost of Defendants' portion of the work on the kennel, as described to
Plaintiffs, to be between $19,800 to $22,000. It is denied that Plaintiffs contracted with
Defendants to construct a kennel at any particular price, but rather the agreement was
based on time and materials. Indeed, at this time there were no specifications or even
a clear idea of what the Plaintiffs desired, upon which to rnake a cost estimate or
range. The Plaintiffs and Defendants did discuss a budget for a basic building,
without consideration of any details and specific items which would be required for a
kennel, all of which details and specifications were to come later.
4. Denied. The averments of paragraph four of Plaintiffs' Complaint make no
sense. By way of further answer, Defendants did begin work on the construction of a
kennel building on Plaintiffs' property in mid July of 1996,

5. Denied. Plaintiffs' Complaint refers to the "cost of the project" however that Is
not the same as the original kennel building and project as contemplated by the
Plaintiffs and Defendants In their first discussions due to changes In the project
ordered by Plaintiffs. Defendants did Inform Plaintiffs all through the construction
process of the additional Items of cost and on one occasion Defendant, Michael
Smetana, did specifically sit down with Plaintiff, Sandra Tartarnella, and tell her that
the total project, as it had expanded with rnanyaddlllonal lIems forthe building and a
number of lIems unrelated to the building, would cost approximately $10,000 more
than the budget for the basic building first discussed and asked her where the
Plalnllffs Intended to obtain the money for the project as they had expressed financial
concerns all along,
6. Denied. The averments of paragraph six make no sense.
7, Admitted In part, denied In part, It is admitted that SUbparagraphs (a), (b), (c)
and (f) were discussed as work to be performed by Defendants on a time and
materials basis however In the beginning of November of 1996 Defendants advised
Plaintiffs that they would not perform additional work until their prior bills were
satisfied. Regarding subparagraph (d) there are air vents in the gable ends of the
attic. Plaintiffs did discuss their desire to contract with Defendants to install an
additional roof vent. Defendants advised that the additional roof vent was not, in their
opinion, necessary, but they would have been willing to install it on a time and
materials basis if Plaintiffs' payments were current. There was never any discussion
of Defendants being hired to install ventilation in the basement (SUbparagraph e),
allhough Defendants did recommend that Plaintiffs put down plastic and gravel and/or
a sump pump. There was certainly never any contract to cornplete any of the items
described in paragraph seven of Plaintiffs' Complaint.
B. Denied, The averrnents of the SUbparagraphs of paragraph eight of Plaintiffs'
Complaint are insufficiently specific for Defendants to answer other than to state that
all of the work which was performed was in a workmanlike manner, In addition, the
averments of the SUbparagraphs (d) and (e) lack clarity in that It is unknown what
"finish work" is purported to be defective. Specifically, Defendants answer that all
floors were properly installed and insulated, as contracted for by Plaintiffs; all concrete
was properly cured; all paint which Defendants applied was properly applied; and
there was no finish work Which was defective in any manner, however, paint was
applied to the concrete floor sooner than the paint manufacturer's recommendations,
against both Defendants specific advice to Plaintiffs.
9. Denied. The averments of this paragraph, and the basis upon which Exhibit
"A" is attached to Plaintiffs' Complaint, constitute conclusions of law to which no
responsive pleading is required. Strict proof at trial of any legal duty to complete any
work, or of any defective construction, is hereby demanded, To the extent that Exhibit
"A" is incorporated into Plaintiffs' Complaint also sets forth unverified heresay no

AND NOW, this 9th day of February 1998, comes the plaintiffs, JOHN J.
TARTAMELLA, ill and SANDRA L. TARTAMELLA, his wife, by their attorneys, Irwin,

I.
The plaintiffs are John J. Tartamella, III and Sandra L. Tartamella, his wife, who are adult
individuals who reside at 637 Grahams Woods Road, Newville, Pennsylvania 17241.

The defendants are Michael S. Smetana t/a/d/b/a Smetana Contracting and Michael S.
Smetana and Douglas Kann t/a/d/b/a Smetana & Kann Electrie, P. 0 Box 212, Plainfield,
Pennsylvania 17081 with their residence and principal place of business located at 20 Pasture
Lane, Newville, Pennsylvania 17241.

On or about April IS, 1996, the plaintiffs contacted the defendants negotiate a verbal
contract by which the defendants would construct a kennel on the property of the plaintiffs. The
eost of the project was projected by the defendants to be from $19,800.00 to $22,000.00.

On or about August I, 1996, the plaintiffs contacted the defendants began to work on the
kennel construction.
5.
On or about December I, 1996, the defendants informed the plaintiffs that the cost of the
project would exceed the highest estimate by Ten Thousand and no/l00 ($10,000) Dollars.
6.
On or about the end of November of 1996, the defendants to work on the project.
7.
The defendants ceased work without completing the following items:
a. The landscaping;
b. The ceiling fan; .\

The defendants provided defective workmanship in the construction of the kennel.
a. They failed to properly install and insulate the floor.
b. They failed to properly permit the concrete to cure.
c. The application of the paint was defective.
d. The finish work by the contractor was defective.
e. The finish work whieh was installed was defective.
9.
The plaintiffs have obtained an estimate from David L. Divan Construction to complete
the work and correct the defective construetion. The total cost will be $9,500.00 and a copy of
the estimate is attached hereto and marked as Exhibit "A" and is made a part of the Complaint
WHEREFORE, Plaintiffs demands damages against the Defendants in the amount
of Nine Thousand Five Hundred and no/IOO ($9,500.00) Dollars, and such other and further relief
as this Court shall deem proper.

The following is a discription of repairs to be made on the
building not adjoining the home.
These repairs are necessary to the integrity of the structure,
mechanical, and looks of the kennel.

Also I would like to state that the shipshod manner of the
construction on this site is by all means the worst that I
have seen in reasent memory.

defy all logic in the construction of this building.
1 Tear off and throwaway linolium in office, and wash room
area 9'6" x 29'11"
The paint that has pulled up from concrete has stained
the floor cover.
since their was no vapor barrier below its suspected
that the luane and sub floor are moving and is reading
through the sheet goods.
2 Throughout project ventilation is needed
a Crawl space.
b Soffit and ridge vents are code but owner may suffice
with one power vent at gable.
3 Entire, kennel floor area must have the paint removed and
repainted to the specifications.
This will require sand blasting and repainting.
The reason being hydrostatic pressure. The floor was
painted to early. [a 28 day period is required.]
4 Remove all kennel doors prime and paint, some of the rusted
area~ will need prepping.
Its suggested that all should be primed and painted.
5 Individual upper kennel walls must be fastened.

These diamond mesh barrier walls just need more fastners.
6 CaUlking areas throughout kennel at the floor area must
be removed, prepped and redone.
7 Several sheets of the water resilant boards must be re-
moved and perhaps new ones be reinstalled.
8 Roofing needs to be gone over and some may need replacing.
since the ventilation was not adequate some nail popping
is occuring. Also if a ridge vent is installed more
shingles will be needed.
9 Entire wash area will need to be redone.
There is a cOUple of things here.
a. Not enough backsplash.
b. Poor plumbing.
c. Loose and unsquared materials.
d. Water is able to get to the plywoods.
10 Trim throughout needs sealed and painted.
No. 2 pine was used and knots are reading through the
paint.
11 Steel' drain grating needs revised, its not properly
draining the floor.
12 Rehang all doors inclUding jambs straightened.
This probably will require new casing.
13 Siding will need reworked.
Loose every where at the top [it's suggested that a
freeze board be applied and a termination strip tight
to the soffit.]
14 All seams to be sealed.
In the plywood cieling latice is needed at the seem.
15 Where electrical supply enters building through block
'needs sealed. Water is penetrating the frame.
16 Crawl space needs vapor barrier and 4" of I" stone layed.
. Insulation is distroyed by the moisture. Floor movement.
.Very damp conditions.
17.Interior attic space should be insulated from the outside
attic area.

18 Exterior exposed wood around kennel area needs prepped for
paint. Primed and painted.

building or the landscaping. The plaintiffs have paid for cquiprnent and materials which have
