WAIVER OF-F~LIEN
WHEREAS, TIMOTHY K. BRENDZA, of Shippensburg, Pennsylvania,
entered into a contract with RINE AND RINE BUILDERS of
Shippensburg, Pennsylvania, for the erection of a brick, siding
dwelling with two-car garage upon real estate owned by Brendza
lying and being situate in Southampton Township, Cumberland County,
Pennsylvania, as more fully described in deed from J. Gary Rine, et
al, dated January- 17 , 2003, and intended to be recorded in
Cumberland County, Pennsylvania, Recorder of Deeds Office.
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the said parties as part of the said contract and for the
consideration herein set forth that neither the undersigned
contractor, nor any sub-contractor or materialmen, nor any other
person furnishing labor or materials to said contractor under this
contract shall file a lien, commonly called a mechanics' lien, for
work done or materials furnished to said building or any part
thereof.
THIS STIPULATION IS MADE and intended to be filed with the
Prothonotary of the Court of Common Pleas of the 9th Judicial
District, Pennsylvania, prior to the commencement of any work upon
the ground in accordance with the requirements of Act of Assembly
of Pennsylvania, in such case provided.

EXHIBIT
ALL the following described real estate, together with
improvements thereon erected, lying and being situate in
Southampton Township, Cumberland County, Pennsylvania, more
particularly described as follows:
BEGINNING at an iron pin on the westerly side of Liberty
Drive at corner of Lot F-16 on the hereinafter referred
to plan of lots; thence by said Lot F-16, South 79
degrees 39 minutes 0 seconds West 150 feet to an iron pin
on line of other lands of the Grantor herein; thence by
said other lands of the Grantor herein, North 10 degrees
21 minutes 0 seconds West 90 feet to an iron pin at
corner of Lot F-14 on said plan of lots; thence by said
Lot F-14, North 79 degrees 39 minutes 0 seconds East 150
feet to an iron pin on the westerly edge of Liberty
Drive; thence with the westerly edge of Liberty Drive,
South 10 degrees 21 minutes 0 seconds East 90 feet to an
iron pin at the place of beginning, containing 13,500
square feet.
BEING Lot F-15 on subdivision plan prepared by Carl D.
Bert dated August 15, 2001, entitled "Land Subdivision
for Rine Estates, Phase VI," and recorded in Cumberland
County, Pa., Plan Book 84, Page 64.
THE above-described real estate is part of the same which
Richard E. Railing and Dorothy J. Railing, his wife, by
deed dated August 11, 1998, recorded in Cumberland
County, Pa., Deed Book 183, Page 607, conveyed to J. Gary
Rine and Virginia B. Rine and Darrin G. Rine and Loretta
L. Rine.
