AND NOW, comes the Plaintiff. Michellc Kibe. by and through her counsel. Gary L
Kelley. and respectfully Petitions this Honorable Court as follows:

TIlis Petition is filed pursuant to the Protection From Abusc Act,
Plaintiff is Michelle Kibe who resides at 401 Erford Road. Harrisburg. PA 170 II,
Defendant is William Kibe. II who resides at 59 W. Vine Street. Shiremanstown,

TIle parties are parents of a minor child. Mark David Kibe. DOB 2/23/94,

Defendant has engaged in abusive conduct toward Plaintiff as defined in the Act
Examples of such conduct include, but are not limited to, the following:
II. On Friday. January 9, 1998, the Defendant picked the minor child up for a visit
and threatened not to return the child stating "Get a good look at your mommy because you'll
never see her again," TIle Defendant sped off

b. On TIlUrsday, January 22, 1997, the Plaintiff met the Defendant at a local

stating "You'll leave when I tell you, you can lellve." TIle Defendant further threUlened "I'm in

c. During the fall of 1997, thc Defendllntagllin threlltened to kill the Plaintiff
d. During the past six (6) months, the Defendllnt has been physically abusive to the
Plaintiff on numerous occasions in the presence of the minor child, 111C Defendant has knocked
the Plaintiff down to the floor, has prevented her from gelling up after he knocked her down, has
struck her. and has pulled her hair.
e. Defendant has engaged in other acts of violence against Plaintiff during their
relationship.
6. As a result of Defendant's actions, Plaintiff fears for her safety,
WH EREFORE, Plaintiff respectfully requests that this Honorable Court issue a Protection
Order granting the following relief:
I. Prior to a hearing on this mailer:
n. immediately entering a temporary Order in accordance with Section 5(b) of the
Act;
b. directing Defendmll from approaching, abusing, harassing, or threatening Plaintiff
or the minor child wherever they may be;
c. directing Defendant from having any contact with Plaintiff or the minor child.
including. but not limited to, restraining Plaintiff from entering her place of employment or
business or school and from harassing Plaintiff, or Plaintifrs relatives, or removing the minor
child from the custody and control of a caregiver;

e. excluding the Defendant from mlY residence which Plaintiff or thc minor child may
occupy whilc this Order remains in effect;

firearms he may own or possess, and any current glm permits he may hnve. to the Dauphin
County Sheriff immediately upon being served herewith mId prohibiting Defendmll from acquiring
or possessing such weapons during the pendency of this Order,
h. such other relief as this Honorable Court may determine is appropriate,
II. Arter hearing, and pursuant to Section 1 of the Act, enter a final protection Order
continuing the relief previously set forth above for a period of one (I) ycar, and further requiring
that Defendant:
n. pursuant to section 5(d) of the Act, pay all taxable costs of this action;
b. pay attomeys fees for the use of the COlmty of Cumberland in the amount of
$250,00;
c. reimburse Plaintiff for out-of-pocket losses as a result of filing this action;
d. relinquish mlY handglU1s, shotglU1s, rilles or other firearms he may own or possess.
and any current glm permits he may have. to the Sheriff of Cumberland County if he has not
already done so and prohibiting Defendant from possessing any such weapons during the
pendency of this Order; and
