1. The plaintiff is Beatrice L. Gill, residing at 35 Betty
Pennsylvania 17013.
Nelson Trailer Park, Lot 129, Carlisle, Cumberland County,
2. The defendants are Patricia A. Clapp, residing at 133 B
North Pitt Street, Carlisle, Cumberland County, Pennsylvania
17013 and Walter Clapp, currently incarcerated in the Cumberland
County Prison at 1101 Claremont Road, Carlisle, Cumberland
County, Pennsylvania 17013.
3. The plaintiff seeks custody of the following children:

The children are presently in the custody of Beatrice Gill,
Pennsylvania.
who resides at 35 Betty Nelson Trailer Park, Lot 129, Carlisle,
a long time friend with whom the children have resided.
The plaintiff currently is residing at 35 Betty Nelson
Trailer Park, Lot 129, Carlisle, Pennsylvania.
5. The relationship of defendants to the children is that
of the mother and father.
6. The plaintiff has not participated as a party or
witness, or in another capacity, in other litigation concerning
the custody of the children in this or another court.
7. The plaintiff has no information of a custody proceeding
concerning the children pending in a court of this Commonwealth.
Currently however, there is a dependency proceeding, No. 004-
1998, regarding the minor child, James Edward Clapp, which
includes the plaintiff as the primary custodian to whose custody,
at the conclusion of the dependency proceeding, the child shall
be returned to the plaintiff when the child is released from the
custody of Cumberland County Children and Youth Services.
8. The plaintiff does not know of a person not a party to
the custody proceedings who has physical custody of the children
or claims to have custody or visitation rights with respect to
the children.
9. The best interest and permanent welfare of the children
will be served by granting the relief requested because:
a. The plaintiff, the children's current caretaker, is
a responsible adult who can best provide for the minor
children and who can continue to provide for the
emotional and physical needs of the children.

NOW THEREFORE, it is agreed by the parties that:
1. Mother shall have primary physical custody and legal
custody of the children, William, Ashley and Allen.
2. Father and Custodian shall have visita tion with the
children at the times and places agreed upon between the parties.
3. Each party shall have equal access to the children I s
personal, school and medical records and each party is to inform
the other of significant events that occur in the children's life.
4. The parties shall immediately notify each other of
medical emergencies which arise while the children are in their
care.
5. Each party shall enjoy reasonable telephone access to the
children.
6. No party shall do anything which may estrange the
children from the other parties or injure the opinion of the other
children as to the other parent or which may hamper the free and
natural development of the children's love or respect of the
others.
7. This Agreement shall supersede all other Agreements or
Stipulations concerning the custody of the children.
8. It is the intent of the parties that this Agreement be
made an Order of Court.
