AND NOW, come the Defendants, Joseph D. Henry and Joanne L.
Henry, by their Attorneys, Snelbaker, Brenneman & Spare, P. C.,
and file the within Motion pursuant to Pa. R.C.P. No. 3121
averring as follows in support thereof:
1. On or about February 17, 1998 a judgment in the amount
of $850.00 plus costs of $95.50 from a District Justice
proceeding was entered of record in the above captioned
matter.

2. On or about February 17, 1998 a Praecipe for Writ of
Execution was filed and a Writ of Execution was

issued.
3. On or about May 6, 1998 a Sheriff's Sale was held in
this case at which time Plaintiff purchased a 1989
Dodge Shadow automobile belonging to Defendants for
the sum of $81.82.
