1. Plaintiff, FLEET MORTGAGE CORP. f/k/a FLEET REAL ESTATE
FUNDING CORP., is a Rhode Island corporation, with an office at
P.b, BOX 1169, Milwaukee, Wisconsin, 53201-0800.
2, Defendant, LARRY R. KIEFFER, is an adult individual
whose last known address is 293 I,OCUST POINT ROAD, NEW KINGSTON,
PENNSYLVANIA 17072,
3, On or about May 28, 1993, the said Defendant executed
and delivered a Mortgage Note in the sum of $74,358.00 payable to
FLEET REAL ESTATE FUNDING CORP., which Note is attached hereto
and marked Exhibit "A".
4. Contemporaneously with and at the time of the execution
of the aforesaid Mortgage Note, in order to secure payment of the
same, Defendants made, executed and delivered to original
Mortgagee, a certain real estate Mortgage which is recorded in
the Recorder of Deeds Office of the within County and
Commonwealth conveying to original Mortgagee the subject
premises. Said Mortgage is attached hereto and made a part

6) Petitioner had accumulated $4,000,00 in order to pay on the arrearages
that have accumulated on the mortgage and was working with Respondent directly in
order to become current on the mortgage.
7) Despite these contacts, Respondent has proceeded to enter a judgment
against Petitioner and has made claim for attorney's fees in the amount of $3,522,67,
3) Petitioner has filed the Chapter 13 Bankruptcy Plan in order to reinstate
the regular monthly payments, as well as to repay the arrearages which have
accumulated on the mortgage, Because of the attorney's fees and costs associated
with the Chapter 13 Bankruptcy filing, as well as the attorney's fees and costs
associated with this Petition to Open or Strike the Judgment, the money that had been
accumulated by Petitioner is not available to have the arrearages reduced by the
$4,000,00 payment and accordingly, they will have to be paid throLlgh a Chapter 13
Plan.
9) Petitioner acknowledges that Respondent does have the right to collect
reasonable and actually incurred attorney's fees pursuant to 41 P,S. Section 406.
10) Petitioner in the past has been behind in his payments and has made up
the arrears, In so doing he has been assessed attorneys fees amounting to hundreds
or thousands of dollars in an amount far in excess of reasonable and actually incurred
attorney's fees,
11) The actions of the Respondent are a direct violation of 41 p, S. Section
406.
WHEREFORE Petitioner respectfully requests that the Cour\:
A) issue a Rule upon the Respondent to show cause why the
Judgment should notl:>e opened or stricken in reference to the above-captioned action;
B) determine thfi reasonable and actually incurred attorney's fees;
C) determine if the attorney fees collected from the Petitioner to date
are fair and reasonable and if found to be excessive be returned to Petitioner;
D) determine if the amount claimed by ttle Respondent Is in fact
correct; and
D) and grant such other relief as is fair and equitable,

12) The Petitioner incorporates paragraphs 1 through 11 herein,
13) The Petitioner has paid the Respondent $7,700 in 1998 in the belief that
the arrears were being reduced. Copies of payments are attached hereto and
incorporated herein as Exhibit 8,
14) The Respondent has not accounted for the application of those funds In
its Judgment amount.
15) Whfin Petitioner attempted to forward the regular monthly payments to the
Respondent In late 1997 the Respondent refused to accept the payment and returned
the check, A copy of the check is attached hereto and incorporated herein as Exhibit
C, This action by the Respondent served to further exacerbate the situation as it
