Survivorship" on thc back of the signaturc card was not signed by Carol S. Mason and C.
.Gary Mason, attached and marked as Exhibit "A",
6. The checking account was opened, and subscqllently held by Carol S. Mason
and C. Gary Mason as tenants by thc cntircty.
7. The chccking agrcement, rules and regulations signed by the Masons, attached
and marked as Exhibit "8", included one set.off clause relevant to a tenaney in thc entirety,
specifically, "SET OFF: We may without notice to you withdraw any or all of the money
from the account and apply the money to reduce any indchledlll'ss that you OliO us,"
8. On March 16, 1989 C. Gary Mason established a $:1.500 Cash I{CSl'lI 0
Agrecment (linc of eredit) with Commerce Bank, account number 000032003758,
9. Carol S. Mason was not a party to the Cash Reserve Agreement with
Commerce Bank signcd by C. Gary Mason on Mareh \6, 1989, attached and marked as
Exhibit "C",
I O. The Cash Rcservc Agrc(~mcnt signed by C. Gmy Mason on Mm'ch 16, 1989
included a default provision in the cvellt ofthc death of the borrower, as set forth in Exhibit
HC",
11. C. Gary Mason died on May II, 19cJ7.
12. On Muy 11, 1997, the rights in thc checking aowunl at Comnwree 13ank held
in tenancy by the entirety by Carol S. Mason and C. Gury Mason vested eompletcly in Carol

S. Mason, as a result ofC, Gary Mason's death.
13. On May II, 1997, C. Gary Mason's Cash Rcscrve Agreement dcbt ()f$2,9(,~
matured, as a result of his death, coupled with the death dcHlult provision,
14. On May IS, 1997, a direct deposit in the umount of $1,719.50 was mudc into
Carol S. Mason chccking account at Commerce Bank.
15. On May 20, 1997, Carol S, Mason dcpositcd $2,144 of hcr own funds in hcr
checking account at Commercc Bank.
16. On May 21. 1997, Carol S. Mason dcpositcd $2,952,38 of her own funds in
her checking account at Commerce Bank.
17. On May 22, 1997, a direct dcposit in the "mount of $653.43 was made into
Carol S. Mason checking account at Commerce Bank,
18. Bctwcen MflY II, 1997 and May 2.1, I <)l)7 I'lIrious checks and other
obligations werc drawn on Carol S. Mason's checking account which reduced and exhausted
the funds that were in the checking account on II May 1l)l)7.
19. On May 23, 1997 the Commerce Bank placed a hold on Carol S, Mason's
checking account in the amount of $3,796.84.
20. On May 29, 19lJ7 and Junc 4, 1997 two checks druwn on thc checking account
wcre returned for insufficient funds and ClIrol S. Mason was notified.
21. Upon un inquiry, Carol S. Muson dctcrmincd a hold was place on hcr account
in thc umount of $3,796.84.

22. On June 29, 1997 Carol S, Mason's attorney rcqucsted that the hold bc
removed from the !lccount, since at the time of C. Gary Mason's death the account vcsted
completcly in Carol S. Mason.
23, On July 10, 1997 Commerce Bank rcfuscd to remove the hold on Carol S.
Mason's checking account and asserted their right to set-off Carol S. Mason's checking
account.
24. Subsequent to the death of C'. Gary Masoll, Commcrce Bank through its
officers and agents offered to rcmovc thc hold on Carol S. Mason's checking accoullt only
if she signed an agrcemcnt to pay the debt owed by C. (Jary Mason on his Cash Reserve
Agreement.
25. Subsequent to the date ofC'. Gary Mason's death and after being notified that
Carol S. Mason was rcpresented by counsel. Commercc Bank continued to contact Carol
S. Mason directly in an attcmpt to gct her to pay the debt ofC. Gary Mason.

27. Defendant, Commerce Bank, had a duty to deliver the funds of the Plaintjft~
Carol S. Mason. on demand.
28. Ncvelihcless, Defendant, Commerce Bank, refusod to deliver the thnds in thc

Plaintiffs account upon dcmund und continues to rcfuse.
29, As u direct und proximate rcsult of Defendant's eonvcrsion, the Plainti ff has
and continues to suffer damages in thc amount of $3,7911.84, plus intcrcst from May 23,
1997.
WHEREFORE, Plaintiff demands judgment again,t Dcfcndant in thc amount of
$3,796.84 plus interest and punitive damages for Dd'endant's intentional acts, plus costs.
COUNT II

31. Defendunt, Commercc Bank, had a duty to conduct its debt collection
pl'llctices in accordance with the Pennsylvania Unfair Trade Practices Act.
32. Ncverthclcss. Ddendant I'l~prcsentcd. through the hold placed on Carol S,
Mason's checking account, that nonpayment ol'C, Gary Mason's dcbt rcsulting from his
Cash Rcserve Agreement with the Defcndant, Vlould result in the set-otT of the Plaintiffs
ehceking account, while thcy knew or should have known that such attachment was not
lawful.
33. The Defendant, through its actions, also falscly represented the debt of C.
Gary Mason's as that of Carol Masou. The Detendant also uscd this ttllse reprcscntation as
a means to attcmpt to collect thc debt of C. Gary Mason from Carol S. Mason,

34, The Dcfcndant's actions, in placing a hold on the checking account of Carol
S. Mason for the debt of C. Gary Mason and subsequ\mtly trying to get Carol S, Mason to
sign a note plcdging to repay the debt ofe. Gary Mason, were both abusive and harusslng,
35, Thc Defendant's actions wcre a violation of the Pennsylvania Unfair Trade
Practice Act.
36, As a direct and proximate result of Defcndanl's violation of the Pennsylvania
Unfair Trade Practice Act, the Plaintiff has and continues to suffcr damagcs in the amount
of$3,796.84, plus interest from the date the hold was placcd on the account (May 23, 19lJ7),
as well as cOUli costs and attol'l1cy's fccs,
WHEREFORE, Plaintiff demands judgmcnt against DeHmdant and rclicf as
indicated bclow:
a, Direct the Defendant to rclease the hold on Carol S. Mason's bunk
account in the amount of$3,796.84 and pay interest beginning on May
23,1997,
b, Direct the Dcfendant to pay three timcs actual damages, in the amount
of $11,390,52, for a violation of lhe Pennsylvania Unfair Trade
Practice Act.
c, Dircct the Defendant, Commcrcc Bank to pay eourt fccs and
rcasollable attorncys' fees for a violation of the Pennsylvania Unfair
Tradc Practice Act.
d, A ward Plaintiff such other relief as the Court shall deem appropriate.
