BLUMENSTEIN, an adult individual, who currently resides at 3B East Keller Street, Mechanicsburg, Cumberland County, Pennsylvania 17055. 2. The Defendant in this action is SHANE E. BLUMENSTEIN, an adult individual, who currently resides at an undisclosed location in the tri-county area; the location of which is known to Cumberland County Domestic Relations. 3. Both the Plaintiff and the Defendant have been bona fide residents of the Commonwealth of Pennsylvania for at least six (6) months immediately previous to the filing of this complaint. 4. The Plaintiff and Defendant were lawfully joined in marriage on June 1B, 1996, in Las Vegas, Nevada. 5. There have been no prior actions of divorce or for annulment between the parties hereto in this or any other jurisdiction. 6. The Plaintiff avers as the grounds upon which this action is based is that the marriage between the parties hereto is irretrievably broken. -1- 7. The Plaintiff has been advised that counseling is available and that the Plaintiff may have the right to request that the court require the parties to particip~te in counseling. 8. His address is currently known and available to the Cumberland County Domestic Relation pursuant to a wage garnishment as a result of a child support order. 12. Plaintiff/petitioner seeks primary physical custody of MARISA D. BLUMENSTEIN, who resides at 38 East Keller Street, Mechanicsburg, Cumberland County, Pennsylvania, is two (2) years, eleven (11) months of age having been born on February 24, 1995. The child was born out of wedlock. The child is presently in ~he custody of the plaintiff/ petitioner, Desiree E. BLUMENSTEIN, being duly sworn according to law, deposes and says that: 1. She is the plaintiff in the foregoing complaint; 2. She has personal knowledge concerning the facts and circum- stances set forth in the complaint filed in this action for divorce and custody; 3. The last contact that the plaintiff has had with the defen- dant was through Legal Services, who was able to provide the plaintiff with a one-year Protection from Abuse on March 4, 1997, based upon circumstances presented before the Honorable Kevin A. Hess. This PFA expired on March 4, 1998. The plaintiff has not seen nor heard from her husband, the defendant, since this hearing. 4. Plaintiff was receiving child support via garnishment of defendant's wages. It was believed that Domestic Relations possessed -1- a current address of the defendant. The plaintiff's counsel contacted the Cumberland County Domestic Relations Office. The Cumberland County Domestic Relations provided an address of 949 Highland street, Harrisburg, PA 17113-1537. Service was attempted by certified mail and returned for illegible reasons as either attempted or refused. A blackened strip revealed an address in Thomasville. 5. Plaintiff's counsel contacted the Cumberland County Office of the District Attorney's Criminal Investigation Division. Counsel spoke with County Detective Letitia Woodford, who is familiar with the defendant and stated that she would keep her eye out for him. Detective Woodford has not had the occasion to run into the defendant recently, nor has she seen him in the area for awhile. 6. Plaintiff's counsel then hired a process server who first went to the Highland Street address, spoke with two elderly woman who stated that they believed the defendant lived in the York area. The process server then submitted an application to the Postmaster for a correct address. The Postmaster answered the application with the same address, RD 2, Box 862, Thomasville, PA 17364. 7. Plaintiff's counsel then referred the plaintiff to a private investigator, API, out of Marysville, who attempted to find the defendant through the Workmans' Compensation index. 8. None of these attempts have been successful in tracking the defendant in order to properly serve him. -2- I.. , ~, 9. Plaintiff has made a diligent search in the community surrounding the premises which is the subject of this action, but that no information concerning these matters was elicited by said investi- gation. 11.
