Dear Judge Guido:
I represent Mr. and Mrs. Troy Beam and Actual Holdings, a Common Law Trust. I
was rather dismayed to hear that my clients were sued in Court through a newspaper article,
especially when Forest Myers, Esquire understands that I represent the above.
I am most troubled in handling of this matter by the Township. Last week, I
contacted Mr. Myers who was less than open concerning the nature of the action, other than
it involves "roadway and stormwater issues." I requested that he provide me with a copy of
the filing so that I could address the Township concerns. The Complaint was received by me
on Tuesday. March 3, 1998.
Prior to sending this letter to your Honor, I contacted Mr. Myers and infonned him
of this letter and had a constructive conversation on efforts from both parties which should
be taken to resolve the issues before the Court. As below discussed, this matter involves
issues which are not properly before your Honor in an injunction matter.
1. The issue of the "number" of units in a particular structure has been an issue
between the parties for almost one year. Certainly, an issue whether a structure
incorporates four or five units is not the proper subject for an injunction. There is no safety
or hazard issues alleged. The issue is simply whether the owner is paying the proper amDunt
of inspection fee.
2. The Township also complains about the registering of these units for housing
purposes. It is my understanding that the Township has adopted some edition of the BOCA
Property Maintenance Code which requires the Township to provide certain administrative
notices of violation and appeal rights which were not afforded here.

4. Dcfcndant, Latrobc Lcasing, is anunincorporatcd cntity with officcs locatcd at 401
Shippcnsburg Road, Shippcnsburg, Pcnnsylvania.
5. On or about January 19, 1996, Dcfcndants, Troy A. Bcam and Dcbbic K, Bcam
submittcd for approvul to thc Board of Supcrvisors, a Subdivision and Land
Dcvclopmcnt Plan rcqucsting approval for subdivision of 8 lots and to bc constructed
thcreon 65 Units, as wcll as a public watcr, public scwcr, strects and storm watcr
facilitics.
6. Said plWl was approved ut a duly held meeting of the Board of Supervisors on June
13, 1996, and recorded in Plan Book _' Page in the Office of the
Recorder of Deeds of Cumberland County, Pennsylvania. A copy of suid plan is
uttached hereto us Exhibit "2".

7, Defendunts, Beam applied for and received a building permit for a building to be
constructed on Lot ND. 2 at 25 Sunbcam Court to contain four (4) units. A copy of
the application is attachcd hcreto as Exhibit "3".
8. Defendants, Bcwn commcnced construction of said structure on or about June I,
1996. In addition, Defendants, Beam at the same time commenccd the installation
of streets and water, and scwer lines and storm water facilities.
9. Defendants, Beam completed said building on or about September 30,1996,
containing five units in violation of the land development plan and contrary to the
building permit application.
10, On or about October 7, 1996, Defendants, Bcam conveycd the land to Defendant,
Actual Holdings, a Trust of South Carolina.
I I. Defendants, Bcam and/or Actual Holdings, installcd or caused to be installed the
storm water facilities required under said plan in a mwmcr not in accordance with the
plans as submitted and approved.
12. The storm water facilities have created and caused storm water runoff to adjoining
downstrcam property owncrs creating hazards to the personal propcrty of said
property owners.
13. The failure of Defendants Beam nnd/or Aetunl Holdings, to properly install the
streets and storm water facilities in contrary to the plan represents a continuing
violation of the Subdivision/Land Development Ordinance of the Township.
WHEREFORE, Plaintiff prays your Honorable Court:
(a) that an injunction may issue, preliminary until final hearing and pcrmanent thereafter,
requiring Defendants Bcwn and Actual Holdings, to corrcct the defects in the storm
watcr run-off facilities in accordance with the plans submittcd and approved by
Plaintiff, and to pavc snid street to Township specifications and to restrain the
Defendants from erecting and maintaining W1Y buildings upon the premises contrary
to the approved plan.

AN ORDINANCE TO REOUIRE A RENTAL LICENSE
IT IS HEREBY ENACTED AND ORDAINED, by 'lhe Board of Supervisors of
Shippensburg Township, Cumberland County, Pennsylvania, that Ordinance 95-7, is enacted as
follows:
SECTION 1. RENTAL LICENSE: No pcrson shall rcnt a residcnlial property or properties,
located in Shippensburg Township, unless the person holds a valid current
operating license issued by Shippensburg Township for the specific named or
numbered, regulated residential property. A license shall be obtained by the
Owner(s) having a legal or equitable interest in the dwellings, single family
dwelling and/or rooming units, donnitories, group homes, health care facilities,
residential care facilities, supervisory care facilities and any or all combinations
thereof, or parts thereof.
SECTION 2. . EEES.: Annual fces per unit for a rental license shall be as follows:
A. Each Dwelling Unit, which includes single family residences, one-half
, of a duplex, mobile homes, townhouses, efficiency apartments,
apartments, floors or other separatc living arcas.........$35.00 per
, dwelling.
B. Each Rooming Unit, which includes each and every bedroom within n
structure such as a boarding house, a fraternity, a sorority, a motel, a
hotel, a hospital, a nursing home, a donnitory, a tourist house, or other
similar building.........$1 0.00 per room.
The annual fees established may be reviewed and changed from time to time by
resolution of the Board of Supervisors of Shippensburg Township.
SECTION 3. DESIGNATION OF LOCAl. AGENT: The owner(s) having a legal or equitable
interest of any residenlial building or property thaI is used for rcntal purposes, not including
single frunily owner occupied buildings, shall register for each such residential unit or property, a
person or finn who shall serve as the local agent. Said local agent shall be legally responsible for
operating said rental property in compliance with the provisions of the codes andJordinanees of
the Township of Shipp ens burg and Commonwealth of Pennsylvania and shall be responsible for
providing legal access to the premises for the purposes of eonducling inspections nccessary to
assure compliance with said codes, ordinances and laws. In addition, said individual or finn
shall be designated and authorized by the owner(s) to accept legal process on behalf of said
owner(s), as it relates to said premises or property.

this code shall, upon conviction thereof, bc subject to a tinc of not more than
$300.00 or lmprisoruncnt for ateml not to exceed thirty (30) days, or both, at the
discretion ofthc court. Each day that a violation continues shall be deemed a
separatc offensc.

conlaining five units in violalion of lhe land development plan and conlrary 10 lhe
building permil application.
10. On or about October 7, 1996, Defendanls, Beam conveyed lhe land 10 Defendanl,
Aclual Holdings, a Trusl of Soulh Carolina.

slorm water facililies required under said plan in a manner nol in accordance with Ule
plans as submilled and approved.
12. The slorm water facililies have crealed and eaused slorm water runoff to adjoining
downslream propcrly owncrs crcating hazards to lhe personal properly of said
property owners.
13. The failure of Defendants Beam and/or ^elual Holdings, 10 properly install the
slreels and slorm waleI' facililies in contrary to lhe plan represenls a continuing
violation of the Subdivision/Land Developmenl Ordinance of the Township.

ORDINANCE NO, 95-7
AN ORDINANCE TO REOUIRE A RENTAL LICENSE
IT IS HEREBY ENACTED AND ORDAINED, by'the Board of Supervisors of
Shippensburg Township, Cumberland County, Pennsylvania, tlIDt Ordinance 95-7, is enactcd as
follows:
SECTION 1. RENTAL LICENSE: No person shnll rent a rcsidentinl property or propertics,
loeatcd in Shippensburg Township, unless the person holds n valid current
operating license issued by Shippensburg Township for the specilic named or
numbered, regulated residential property. A license shall be obtained by the
Owner(s) having a legal or equitable interest in the dwellings, single family
dwelling and/or rooming units, donnitories, group homes, health care facilities,
residential care facilities, supervisory care facilities and any or all combinations
thereof, or parts thereof.
SECTION 2. . EEES.: Annual fees per unit for a rental license shall be as follows:
A. Each Dwelling Unit, which includes single family residenccs, one-half
, of a duplex, mobile homes, townhouses, efficiency apartments,
apartments, floors or other separate living areas.........$35.00 per
, dwelling.
B, Each Rooming Unit, which includes each and every bedroom within a
structure such as a boarding house, a fratcrnity, a sorority, a motel, a
hotel, a hospital, a nursing home, a dormitory, a tourist house, or othcr
similar building.........$l 0.00 per room,
The annual fees establishcd may bc rcvicwcd and changcd from time to time by
resolution of the Board of Supervisors of Shippcnsburg Township.
SECTION 3. DESIGNATION OF LOCAL AGENT: The owncr(s) hnving n legnl or cquit~ble
interest of any residential building or property that is used for rentnl purposes, not including
single family owner occupied buildings, shall register for each such residential unll or property, a
person or linn who shall serve as the local agent. Said locnl agent shall be legally responsible for
operating said rental property in compliance with the provisions of the codes andJordinances of
the Township of Shippensburg and Commonwealth of Pennsylvania and shall be responsible for
providing legal access to the premises for the purposes of conducting inspections necessary to
assure compliance with said codes, ordinances and laws. In addition, said individual or linn
shall be designated and authorized by the owner(s) to accept legal process on behalf of said
owner(s), as it relates to said premises or property.

SECTION 4. REQ,tSTRATION OF RENTAL UNITS: Rcgistration'ofrental units shall be
ml1de In sueh fonn Md mlllU1er In l1eeordanee with sueh instnletions liS may be furnished by the
Township and shall inelude at least the following infonnalion:
(a) Thc names, addrcsses and telephone numbers of the owner or owners of the
premisesj and,
(b) The name, address and telephone numbers, business Md home, ofthc local
agentj and,
(e) The address' oflhe dwelling; and,
(d) The type ofdwelllngj and,
(e) The number of dwelling unit or units in each building.
SECTION 5. LICENSING: Upon receipt of the fully completed registration fonn Md the
payment of the appropriate license fcc, the Township, after investigation, shall
within twenty (20) business days issue a license to the owner(s) or responsible
local agcnt. In the cventthe Town'ship finds the property to be in violation of
this ordinance, the Property Maintenance Code of Shippensburg Township, or any
. other ordinance, or law, then the Township shall issuc the necessary notice and
order to abate the illegal use or unsafe eonditions to insure compliMce with this
ordinance; the Township after reinspection to insure compliance with this
ordinMce shall then issue a license to the owner(s) or responsible local agent,
Said license, shl1l1, I1tl1l1times, be maintained on the property Md be availablc for
inspection by Township officials.
SECTION 6. TIME FOR REGISTRATION. REMOVAL. TRANSFER OF OWNERSHIP:
(a) TIle registration and licensing of all rental residential properties Md the
designation of a rcsponsible loeal agent shall oecur on or before March I of
each ycar.
.(b) In the event of a lrMsfer of ownership, legal or cquitable, of a property
covered by this ordinMee, the registralion and license shall become invalid. It
shall be the responsibility oCthc ncw owner(s) to notify the Township of said
transfer not mo~e than five (5) days from lhe dale of said transfer of
ownership. The new owner shall register and license the premises or, property
\\ilhin ten (10) days oCthe dl1le oflransCer ofOWlleuhlp either legal or
equitable.

ORDINANCE NO. 95.7
AN ORDINANCE TO REOUIRE A RENTAL LICENSE
IT IS HEREBY ENACTED AND ORDAINED, by the Board of Supervisors of
Shippensburg Township, Cumberland County, PeMsylvania, that Ordinance 95-7, is enacted as
follows:
SECTION 1. RF.NTAL LICENSE: No person shall rent a residential property or properties,
located in Shlppensburg Townshlp, unless the person holds a valid current
operating license issued by Shippensburg Township for the specific named or
numbered, regulated residential property. A license shall be obtained by the
Owner(s) having a legal or equitable interest in the dwellings, single family
dwelling and/or rooming units, dormitories, group homes, health care facilities,
residential care facilities, supervisory care facilities and any or all combinations
thereof, or parts thereof.
SECTION 2. . EEES.: Annual fees per unit for a rental license shall be as follows:
A. Each Dwelling Unit, which includes single family residences, one-half
of a duplex, mobile homes, townhouses, efficiency apartments,
apartments, floors or other separate living areas.........$35.00 per
, dwelling.
B. Each Rooming Unit, which includes each and every bedroom within a
Structure such as a boarding house, a fratemlty, a sorority, a motel, a
hotel, a hospital, a nursing home, a dormitory, a tourist house, or other
similar building.........$ I 0.00 per room.
The annual fees established may be reviewed and changed from time to time by
resolution of the Board of Supervisors of Shippensburg Township.
SECTION 3. DESIGNATION OF LOCAL AGF.NT: The owner(s) having a legal or equitable
interest of any residential bUilding or property that is used for rental purposes, not inclUding
single family Owner occupied buildings, shall register for each such residential unit or property, a
person or firm who shall serve as the local agent. Said locol agent shall be legally responsible for
operaling said rental property in compliance with the provisions of the codes andJordinances of
the Township of Shippensburg and Commonwealth of PeMsylvania and shall be responsible for
providing legal access to the premises for the purposes of conducting Inspections necessary to
assure compliance with said codes, ordinances and laws. In addition, said Individual or firm
shall be designated and authorized by the owner(s) to accept legal process on behalf of said
owner(s), as it relates to said premises or property.

SECTION 7. OCCUPATION OF PREMISES WITHOUT REGISTRATION AND LICENSE
PROHJnITED: It shall be unlawful for thc owner(s) of nny premises containing
onc (I) or morc dwclling and/or rooming units, or any agcntacting fDr said
owncr(s), to permit occupancy of any dwclling unit Dr rooming unit on thc
prcmiscs by anothcr, or to rcprcscntto thc public such prcmiscs, a part thcrcof, as
for rcnt, Icasc or occupancy, unlcss said rcntal and/or rooming units arc currcntly
registered and licensed and said registration and Iiccnse hIlS not been revoked or
invalidated.

SECTION 8. GOVERNMENTAL ENTITIES: Notwithstanding any other provision to the
contrary, a renCallicense shall not be requircd for any dwelling unit or rooming
unit rcnted by a governmental entity, including all agcncics, departmcnts, boards,
commissions, and instrumentalities of the Fcdcral Governmcnt ofthc United
States of America and the Commonwealth of Pennsylvania, including member
institutions of the Pennsylvania State System of Higher Education.
SECTION 9. PENAL TV: Any person, firm or corporation who shall violate any provision of
this code shall, upon convictIon thereof, be subject to a fine of not mDre than
5300.00 or Imprisonment for a term not to exceed thirty (30) days, or both, at the
discretion oflhe court. Each day that a violation continues shall be deemed a
separate offense.
SECTION I a'-EFFECTIVE DATE: This ordinance shall be effective January I, 1996.

NOW COMES the Plaintiff, Shippensburg Township, by its attorney, Forest N. Myers, and
sets forth the following:
I. Plaintiff is Shippensburg Township, a Pennsylvania Municipal Corporation with
offices at 81 Walnut Bottom Road, Shippensburg, Cumberland County,
Pennsylvania.
2, Defendants, Troy A. Beam and Debbie K. Beam, arc sui juris adults, having an
address of 401 Shippensburg Road, Shippensburg, Cumberland County,
Pennsylvania, and the former owners and current developers of a tract ofland situate
in Shippensburg Township, Cumberland County, along Britton Road, now owned by
Defendant, Actual Holdings. '
3. Defendant, Actual Holdings, a trust ereated,under the laws of South Carolina, with
offices located at 1531 Broad River Road, Suite 128, Columbia, South Carolina,
29210 is the record owner of property situate on Britton Road, Shippensburg
Township, Cumberland County, Pennsylvania. A copy of the deed to said premises
is attached hereto and identified as Exhibit" 1".
4. Defendant, Latrobe Leasing, is an unincorporated entity with offices located at 401
Shippensburg Road, Shippensburg, Pennsylvania.
5, On or abDut January 19, 1996, Defendants, Troy A. Beam and Debbie K. Beam
submitted for approval to the Board of Supervisors, a Subdivision and Land

ORDINANCE NO. 95-7
AN ORDINANCE TO REOUIRE A RENTAL LICENSE
IT IS HEREBY ENACTED AND ORDAINED, by the Board of Supervisors of
Shippensburg Township, Cumberland County, Pennsylvania,that Ordinance 95-7, is enactcd as
follows:
SECTION 1. RENTAL LICENSE: No person shall rent a rcsidcntial property or propcrtics,
locatcd in Shippensburg Township, unlcss the person holds a valid current
operating license issued by Shippensburg Township for the specific named or
numbered, regulated residcntial property. A license shall be obtained by the
Owner(s) having n legal or equitable interest in the dwellings, single family
dwelling and/or rooming units, dormitories, group homes, hcalth care facilities,
residcntial care facilities, supervisory care facilitics and any or all combinations
thercof, or parts thereof.
SECTION 2. . EEliS.: Annual fces per unit for a rentalliecnse shall be as follows:
A. Each Dwelling Unit, which includes single family residenccs, one-half
ofa duplex, mobile homes, townhouses, efficiency apartments,
apartments, floors or other separate living areas.........$35.00 per
, dwelling.
B. Each Rooming Unit, which includes each and every bedroom within a
structure such as a boarding house, a fratcmity, a sorority, a motel, a
hotcl, a hospital, a nursing home, a dormitory, a tourist house, or other
similar building.........$1 0.00 per room.
Thc annual fees cstabIishcd may bc rcviewed and changed from timc to time by
resolution of the Board of Supcrvisors of Shippcnsburg Township.
SECTION 3. DESIGNATION OF LOCAL AGENT: The owncr(s) having a legal or cquilablc
intcrcst of any rcsidcntial building or propcrty that is uscd for rcntal purposcs, not including
single fnmity owncr occupied buildings, shall rcgislcr for caeh such residential unit or propcrty, a
pcrson or firm who shall servc as the local agcnt. Said local agcnt shall be lcgally responsible for
operating said fenlal property in compliance with the provisions of the codes andJordinances of
the Township of Shippcnsburg and Commonwealth of Pennsylvania and shall be rcsponsible for
providing legal access to the premises for the purposes of conducting inspcctions necessary to
assure compliance with said codcs, ordinances and laws. In addition, said individual or firm
shall be dcsignatcd and authorized by the owner(s) to accept legal process on behalf of said
owner(s), as it relates to said premises or property.

Development Plan requesting approval for subdivision of8 lots and to be constructed

facilities.

1996. [n uddition. Delcndunls, Beum at the same time commenced the installation
of streets and wnter, nnd sewer lines nnd storm water fncilities.
9. Delcndunts, Beum completed suid building on or nbout September 30,1996,
contuining five units in violution of the Innd development plun and contrury to the
building permitupplicution.
10. On or about October 7, 1996, Delcndnnts. Beam conveyed the lund to Defcndnnt,
Actual Holdings, n Trust of South Carolinn.
I I. Defendants, Beam and/or Actunl Holdings. instnlled or cuused to be installed the
stoml water facilities required undcr said plan in umnnner not in accordance with the
pluns as submitted nnd npproved.
12. The storm wnter facilities have crentcd and cnuscd storm wuter runoff to adjoining
downstream property owners creating haznrds to the personal property of said
property owners.
13. The failure of Defendunts Beam and/or Actunl Holdings, to properly install the
streets nnd storm wuter facilities in contrury to the plan represents a continuing
violation of the Subdivision/Land Development Ordinnnce of the Township.

AN ORDINANCE TO REOUIRE A RENTAL LICENSE
IT IS HEREBY ENACTED AND ORDAINED, by 'the Board of Supervisors of
Shippensburg Township, Cumberland County, Pennsylvania, that Ofdinance 95-7, is enacted as
follows:

SECTION I. RENTAL LICENSE: No person shall rent a residential property or properties,
located in Shippen~burg TownShip, unless the person holds a valid current
operating license issu.'d by Shippensburg Township for the specific named or
numbered, regulated res;,Jentlal property. A license shall be obtained by the
Owner(s) having a legal or equitable intercst in the dwellings, single family
dwelling and/or rooming udts, dormitories, group homes, health care facilities,
residential care facilities, '.upervisory carc facilities and any or all combinations
thefeof, or parts thereof.
SECTION 2. . EEES: Annual fees per unit for a rental license shall be as follows:
A. Each Dwelling Unit, which includes single family residences, one-half
ofa duplex, mobile homes, townhouses, efficiency apartments,
apartments, floors or other separate living areas.........$35.00 per
dwelling.
B. Each Rooming Unit, which lnelude~ each and every bedroom within a
structure such as a boarding house, a fraternity, a sorority, a motel, a
hotel, a hospital, a nursing home, a dormitory, a tourist house, or other
similar bullding.........$1 0.00 per room.
The annual fecs established may be rcviewed and changed from time to time by
resolution of the Board of Supervisors of Shippensburg Township.
SECTION 3. DESIGNATION OF LOCAL AGENT: The owner(s) having a legal or equitable
interest of any rcsidential bUilding or property that is used for rental purposes, not including
single family Owner occupied buildings, shall register for each such residential unit or property, a
person or firm who shall serve as the local agent. Said local agent shall be legally responsible for
operating said rental property in compliance with the provisions of the codes andJordinances of
the Township of Shippensburg and Commonwealth of Pennsylvania and shall be responsible for
providing legal access to the premises for the purpo~es of conducting inspections necessary to
aSSUfe compliance with said codes, ordinances and laws. In addition, said individual or firm
shall be designated and authorized by the owner(s) to accept legal process on behalf of said
owner(s), as it relates to said premises or property.

commissions, and instrumentalities of the Fcdcral Go\'ernmcnt of the United
States of America and the Commonwealth of Pennsylvania, including member
institutions of the Pennsylvania Slate System of Higher Education.

SECTION 9. PENAL TV: Any person, firm or corporation who shall violate any provision of
this code sholl, upon conviction thefeof, be subject to a fine of not mOfe than
$300.00 or imprisonment for a term not to exceed thirty (30) days, or both, at the
discfetion of the court. Each day that a violation continues shall be deemed a
separate offense.

PlaintifT, Shippensburg Township, through its undersigncd counsel, Petitions this Court on
its behalf for the issuance of a Preliminary Injunction pursuant to Pa. R.C. P. No. 1531 and in
support thereof allege as follows:
I. PlaintilT filed a verified Complaint in equity with the Prothonotary of this Court on

2. The parties to this action arc the Township and certain property owncrs, developers
and lessees of real estate situated in the Township.
3. Plaintiff has filed its Complaint and secks this Preliminary Injunction, against the
Respondents Dcfendants Troy A. Beam, Debbie K. Beam, Latrobe Leasing, and
Actual Holdings, a Trust to enjoin thcir continued breaches and violations of the
ordinance and regulations of the Township.

Defendant's have continued to violate the ordinances and regulations of the
Township by (I) failing and refusing to adhere to the approved subdivisiOn/land
dcvelopment plan approved by the Township, (2) by failing and refusing to complete
the public improvements required by the approval and ordinance, and (3) by leasing
and occupying buildings and structures in violation of the Ordinance to Require a
Rental License Ordinance of the Township.

granted. Dcfcndant's continuing conduct results in Plaintill' being unable to
effcctively enforce its ordinance and results in harm to adjoining landowners from

Defendants of Township Ordinanccs arc elear. Defendants arc breaching township
ordinances by failing and refusing to develop in conformity with them, and to rent
buildings withoatthe required license.

(a) Issue a Rule to Show Cause why a prdiminary injunction should not be granted

constructed on Lot No.2 at 25 Sunbeam Court to contain four (4) units. A copy of
the application is allached hereto as Exhibit "3",
8. Defendants, Beam commcnced construction of said structure on or about Junc I,
1996. In addition, Defendants, Beam at the same time commenced the installation
of streets and water, and sewer lines and storm water facilities.
9. Defendants, Beam completed said building on or about September 30,1996,
containing five units in violation of the land development plan and contrary to the
building permit application.
10. On or about October 7, 1996, Defendants, Beam conveyed the land to Defendant,
Actual Holdings, a Trust of South Carolina.
11. Defendants, Beam and/or Actual Holdings, installed or caused to be installed the
storm water faeilities required under said plan in a manner not in accordance with the
plans as submitted and approved.
12. The storm water facilitics have ereated and caused storm watcr runoff to adjoining
downstream property owners creating ha.....ards to the personal property of said
property owners,
13. The failure of Defendants Beam andlor Actual Holdings, to properly install the
streets and storm water facilities in contrary to the plan represents a continuing
violation of the Subdivision/Land Development Ordinance of the Township.
WHEREFORE, Plaintiff prays your Honorable Court:
(a) that an injunction may issue, preliminary until final hearing and pemlanentthereafter,
requiring Defcndants Beam and Actual Holdings, to correct the defects in the storm
water run-off faeilities in accordance with the plans submitted and approved by
Plaintiff, and to pave said street to Township specifications and to restrain the
Defendants from erecting and maintaining any buildings upon the premises contrary
to the approved plan.
(b) to grant such other general relief us may be just and proper.

CUMDERLAND COUNTY, PENNSYLVANIA
ORDINANCE NO. 95-7
AN ORDINANCE TO REOUIRE A RENTAL LICENSE
IT IS HEREBY ENACTED AND ORDAINED, by'the Board of Supervisors of
Shlppensburg Township, Cumberland County, Pennsylvania, that Ordinance 95-7, is enacted as
follows:
SECTION 1. RENTAL LICENSE: No person shall rent a residential property or properties,
locuted in Shippcnsburg Township, unless the person holds a vnlid cunent
opcrating license issued by Shippensburg Township for the specific named or
numbered, regulated residential property. A liccnse shall be obtained by the
Ownef(s) having a legal or equitable interest in the dwellings, single fnmily
dwelling and/or rooming units, dormitories, gfOUp homes, health care facilities,
residential care facilities, supervisory care facilities and any or aU combinations
thereof, or parts thereof.
SECTION 2. . EEES.: Annual fees per unit for 11 rentalliccnse shaU be as foUows:
A. Each DweUing Unit, which includes single family residences, one-half
ofa duplex, mobile homes, townhouses, efficiency apartments,
apartments, floors or other separate living areas.........S35.00 per
, dwelling.
B. Each Rooming Unit, which includes each and every bedroom within a
Structure such as a boarding house, a fraternity, a SOfOnty, a motel, a
hotel, n hospital, a nursing home, n dormitory, a tounst house, or other
similar building.........SI 0.00 per room.
The annual fees establishcd may bc reviewcd and changcd from time to time by
rcsolution of the Board ofSupcrvisors ofShippcnsburg Township.
SECTION 3. DESIGNATION OF LOCAL AGENT: The owncr(s) having a legal or equitable
Inlercst of nny rcsidentinl building or property that is used for rcnlal purposes, not including
single fnmily owner occupied buildings, shall registcr f.'r cnch such residential unit or property, a
pcrson or firm who shall serve as the local agent. Said local agent shall be Icgally responsible for
operating said rcntal property in compliance with the pro'/isions of the codcs and}ordinances of
the Township of Shippensburg and Commonwealth 0 r Pennsylvania and shall be responsible for
providing legal access to the premises for the purposes of conducting Inspections neccssary 10
assure compliance with said codes, ofdinance~ and laws. In addition, said Individual or firm
shall bc designated and authonzed by thc owncr(s) to ace cpt legal process on behalf of said
owner(s), as it relates to said pfemises or property.
EXHIBIT "4"
(a) The registration and liccnsing of all rcntal rcsidcntial properties and the
designation of a responsible local agent shall occur on or before March 1 of
each year.
SECTION 4. REGISTRATION OF RENTAL UNITS: Regislralion'offental units shall be
made in such form and manner in accordance with such instructions as may be furnished by the
Township and shall include at least the following information:
(a) The names, addresses and telephone numbcrs of the owncr or ownefs of the
premises; and,
(b) The name, address and telephone numbers, business and home, of the local
agent; and,
(e) The address'oCthe dwelling; and,
(d) The type oC dwelling; and,
(e) The number oC dwelling unit or units in each building.
SECTION 5. LICENSING: Upon receipt of the fully completed fegistration form and the
payment of the appropriate license fcc, the Township, after investigation, shall
within twenty (20) business days issue a license to the owner(s) or responsible
local agent. In the event the Township finds the property to be in violation of
this ordinance, the Pfoperty Maintenance Code of Shippensburg Township, or any
. other ordinance, or law, then lhe Township shall issue the necessary notice and
order to abate the illegal use or unsafe conditions to insure compliance with this
ordinance; the Township after reinspection to insure compliance with this
ofdinance shall then issue a license to the owner(s) or responsible local agent.
Said license, shall, at all times, be maintained on the property and be available for
inspection by Township officials.
SECTION 6. TIME FOR REGISTRATION. REMOV At. TRANSFER OF OWNERSHIP:
,(b) In the event of a transfer of owncrship, Icgal or cquitable, of a propcrly
covered by this ordinance, the rcgistration and license shall bccome invalid. It
shall be the rcsponsibility ofthc new owncr(s) to notify the Township of~nid
transfer not more Ihan live (5) days from the date of said Iransfer of
ownership. The new owner shall register and license the prcmises or propcrty
\\ithln ten (10) days of the dale of transfer of ownership either legal or
equitable.

SECTION 7. OCCUPATION or PREMISES WITHOUT REGISTRATION AND LICENSE
I'ROHIDITEQ: II sholl be unlawful for thc owner(s) of any premises containing
one (I) or more dwelling and/or fooming units, or any agent acting for said
owner(s), to permit occupancy of any dwelling unit or rooming unit on the
premises by another, or 10 rcprescnt to the public such premises, 0 port thercof, os
for renl, lease or occupancy, unlcss said rental and/or rooming units ore currcnlly
feglstered and licensed and said registration and license has not been fevoked or
Invalidated.
SECTION 8. GOVERNMENTAL ENTITIF.S: Notwithstanding any other provision to the
contrary, 0 renCallicense shall not be requircd for any dwelling unit or rooming
unit rented by 0 govcrnmenlal cntity, including all agcncics, departments, boards,
commissions, and instrumentalitics of the Fcdcral Go\'ernment of the Unilcd
States of America and the Commonwealth of Pennsylvania, including member
institutions of the Pennsylvania State System of Higher Education.
SECTION 9. PENALTY: Any person, firm or corporation who shall violate any provision of
this code sholl, upon conviction thereof, be subject to a fine of not more than
$300.00 or Imprisorunent for II term not to exceed thIrty (30) days, or both, at the
discretion of the court. Elich day that II violation continues shall be deemed a
separate offense.
SECTION IC.'EFFECTIVE DATE: This ordinance shall be cffectivc January I, 1996.
