COMPLAIN,I
AND NOW, comes Plaintiff, Moore's Lumber and Building Supplies, by its attorneys,
KUNDRAT & ASSOCIATES, and states the following cause of action:
I. Plaintiff, Moore's Lumber and Building Supplies, is authorized to do business in the
Commonwealth of Pennsylvania with offices and/or a place of business situate at 3442 Simpson Ferry
Road, Camp Hill, Cumberland County, Pennsylvania.
2, Defendant R-Gee Contracting, Inc, is a Pennsylvania corporation with offices and/or
a place of business situate at 3 Richland Lane, Suite IOIA. Camp Hill, Cumberland County.
Pennsylvania,
3. Defendant Robert G. Derrickson, is an adult individual with a last known address of
3 Richland Lane, Suite lOlA, Camp Hill, Cumberland County, Pennsylvania.
4. Defendant Nancy Derrickson is an adult individual with a last known address of3
Richland Lane, Suite lOlA, Camp Hill, Cumberland County, Pennsylvania,
5. Plaintilfis, and at all relevant times was, a wholesale distributor of building supplies.
6. Defendant R-Gee Contracting, Inc. is. and at all relevant times was. a general
contractor.
7, On or about May 4, 1995, Defendant R-Gee Contracting. Inc. applied to Plaintiff for
credit. A true and correct copy of the credit application is attached hereto and made a part hereof
and marked as Exhibit "A",
8. Between June 26, ] 997 and October 7, 1997, various products, goods, supplies, and
materials (hereinafter collectively referred to as "products") were ordered by Defendant R-Gee
Contracting, Inc. from Plaintiff. Plaintiff sold and provided the products ordered by Defendant R-Gee
Contracting, Inc" the same being represented by and as set forth on invoices supplied to Defendant.
The invoices themselves are too numerous to be attached hereto, however, invoices shall. upon
request, be supplied to Defendant.
9. The prices charged for the products sold to Defendant R-Gee Contracting, Inc, as set
forth on the invoices were the fair, reasonable, and market prices of the products, and the prices that
Defendant R-Gee Contracting, Inc, agreed to pay,
10, Plaintiff has maintained a statement of account keeping an accurate and running
amount of debits and credits for the sale of products sold to Defendant R-Gee Contracting, Inc. by
Plaintiff,
11, Plaintiff has submitted to Defendant R-Gee Contracting, Inc. a statement of account
accurately showing all debits and credits for transactions with Defendant R-Gee Contracting, Inc.,
said statement of account shows an amount owing to Plaintiff of$23,263.31 through December 25,
1997. A copy of the statement of account is attached hereto and made a part hereof and referred to
as Exhibit "B".
12. Pursuant to the tenns and conditions of sale contained on the credit application which
were agreed to by Plaintiff and Defendant R-Gec Contracting, Inc" and as further stated on the
invoices, Plaintiff is entitled to receive a finance charge of I .5% per month on past due amounts.
13. Despite demand, Defendant R-Gce Contracting, Inc. has refused to pay the past due
balance on it's open account of all sums due and owing to PlaintilT.
14. Pursuant to the tenns and conditions of sale and extension of credit, Defendant R-Gee
Contracting, Inc, agreed to pay reasonable attorney's fees and all court and collection costs.
15. Plaintift'has retained the services of the law firm of KUNDRAT & ASSOCIATES at
the rate of$135.00 per hour in the collection of the anlOunts due from Defendant R-Gee Contracting,
Inc.
16, Plaintiff has incurred reasonable attorney's fees from the law offices of KUNDRAT
& ASSOCIATES in the collection of the amounts due from Defendant R-Gee Contracting, Inc.
incident to the commencement of the within action; Plaintiff shall continue to incur such attorney's
fees throughout the conclusion of the proceedings,
17. Any and all conditions precedent to the bringing of this action has been performed by
Plaintiff.
18, The amount in controversy is within the jurisdictional amount requiring
compulsory arbitration.

MOORE'S LUMBER AND BlJILDING PRODUCTS v. R-GEE CONTRACTING. INC.
OPEN ACCOUNT
19. Plaintiff incorporates by reference Paragraphs one (I) through eighteen (IS) oeits
Complaint as though the same were set forth at length herein,
20. The invoices supplied to Defendant R-Gee Contracting, Inc. represent products sold
by Plaintiff and purchased by Defendant R-Gee Contracting, Inc. pursuant to it's account with
Plaintiff,
21, Defendant R-Gee Contracting, Inc. has not objected to any of these invoices and has
accepted the products provided thereby, but has failed to pay Plaintiff despite demand pursuant to
its open account, all to the damage of Plaintiff.
WHEREFORE, Plaintiff, Moore's Lumber and Building Supplies, respectfully requests this
Honorable Court to enter judgment in favor of Plaint iff and against Defendant R-Gee Contracting,
Inc, in the amount of$23,263,31, plus interest at the rate of 1.5% per month from December 25,
1997, reasonable attorney's fees, the costs of this action, and such other relief as the court deems just
and proper.
COUNT II
MOORE'S LUMBER AND BUILDING SUPPLIES v. ROBERT G. DERRICKSON
and NANCY DERRICKSON. Individually. .Jointly and Severally
(Guaranty)
22, Plaintiff incorporates by reference Paragraphs one (I) through twenty-one (21) of its
Complaint as though the same were set forth at length herein.

23. In consideration of the extension of credit by Plaintiff to Defendant R-Gee
Contracting, Inc., Defcndants Robert G, Dcrrickson and Nancy Derrickson, jointly and individually,
unconditionnlly guaranteed the payment of all amounts owed by Defendant R-Gee: Contracting, Inc.
to Plaintiff in addition to reasonable aUorneys fees and costs incurred in the collection of any amount
due from Defendant R-Gee Contracting, Inc.
24, Pursuant to the terms and conditions of the Guaranty Agreement aU ached as part of
Exhibit "A," Defendants Robert G. Derrickson and Nancy Derrickson unconditionally guaranteed the
payment of all amounts owed by Defendant R-Gee Contracting, Inc. to Plaintiff in addition to
reasonable attorneys fees and costs incurred in the collection of any amount due from Defendant
R-Gee Contracting, Inc.
25. Pursuant to the terms and conditions of the Guaranty Agreement attached as part of
Exhibit "A," Defendants Robert G, Derrickson and Nancy Derrickson specifically agreed that:
,..the undersigned Guarantor (even if more than one) hereby warrants and
unconditionally guarantees to Moore's the full and prompt payment when due
(including any accelerated or extended maturity) of all indebtedness, obligations and
liabilities of Customer to Moore's including finance charges applicable hereto, now
existing or hereafter created or arising, even if such indebtedness is in excess of the
applied for, or established credit line, Guarantor further agrees to pay all expenses,
including expense of court costs and attorney's fees paid or incurred by Moore's in
endeavoring to collect such indebtedness or any part thereof or in enforcing the
Guaranty.

26, Despite demand, Defendants Robert G. Derrickson and Nancy Derrickson have

for credit from Plaintiffindividually.
30. The document that is labeled as Credit Information and Personal Guaranty which is
attached to Plaintiffs Complaint as Exhibit A docs not indicate anywhere that Defendants Robert
G. Derrickson, Sr., or Nancy Derrickson, arc providing a personal guaranty for the account of
Defendant R-Gee Contracting, Inc.
3 I. There is nothing in the document that is identified as Credit Information and Personal
Guaranty that obligates Defendants Robert G. Derrickson, Sr., or Nancy Derrickson as personal
guarantors of any account with Plaintiff, much less the account of Defendant R-Gee Contracting,
Inc., in that there is no reference in any documentation attached to Plaintiffs Complaint that
Defendants Robert G. Derrickson, Sr" and Nancy Derrickson were in fact guaranteeing any
specific account with Plaintiff.
