AND NOW, come Plaintiffs, Mark and Nanette Holmes, by and
through their attorneys, Law Offices of Craig A, Diehl, and file
this Complaint, respectfully stating in support thereof the
following:
1, Plaintiffs are Mark and Nanette Holmes, husband and wife,
(hereinafter referred to as "Plaintiffs"), adult individuals who
reside at 4726 Charles Road, Mechanicsburg, Cumberland County,
Pennsylvania 17055.
2.
Defendants are Kenneth and Lydia Waggoner, husband and
wife, (hereinafter referred to as "Defendants"), adult individuals
who reside at 5105 Inverness Drive, Mechanicsburg, Cumberland
County, Pennsylvania 17055.
3, On or about the middle of October, 1996, the Defendants
listed for sale their residence situated at 4726 Charles Road,
Mechanicsburg, Cumberland County, Mechanicsburg, Pennsylvania
17055, with Jack Gaughen Realty, Said property shall hereinafter
be referred to as the "Subject Property".
4. On or about October 13, 1996, Defendants fully completed
and signed the "Seller's Property Disclosure Statement" attached as
Exhibit "A" and incorporated herein by reference,

5, Question 9 (h) of the "Seller's Property Disclosure
Statement" specifically required Defendanto to answer, in writing,
the following:
" 9, WATER AND SEWAGE: . . . ,
.' (h) Are you aware of any leaks, backups,
occasional surface water or other problems relating
to any of the plumbing, water and sewage related
items? Yes _ No . . ."
Defendants answered in the negative,
6. In early November, 1996, the water pipe leading into the
Subject Property began leaking,
7. On or about November 14, 1996, at the bequest of
Defendants, employees of Zimmerman Plumbing inspected the leakage
in the water pipe,
8, On or about the same date, Barry Wagner, an employee of
Zimmerman Plumbing, recommended to Lydia Waggoner, Defendant, that
the damage to the water pipe be cured through replacement of the
entire length of water pipe on the Defendants' property, that the
surrounding bed of rock and soil around the pipe be replaced with
a finer grade of stone and dust so that further breaks and/or
leakage would not occur, and that any repair besides the
replacement of the pipe would be a temporary solution.
9. Despite this information, Defendant, Lydia Waggoner, made
the decision to only repair that section of pipe where the break
and leakage occurred.
10. Thereafter, Defendants failed to amend the "Seller's
Property Disclosure Statement" to reflect the repairs made to said
water pipe and that a professional had recommended that the entire
water pipe be replaced.
11, During April, 1997, the Plaintiffs performed a "walk-
through" of the Subject Property. The repairs made to the water
pipe were not readily apparent to the Plaintiffs,
12, On or about April 4, 1997, the Plaintiffs signed an
Agreement of Sale to purchase the Subject Property,
Defendants
failed to inform the Plaintiffs that repairs had been made to the
water pipe or that the water pipe should be replaced,
13, On or about April 20, 1997, the Plaintiffs signed the
"Receipt and Acknowledgement of Buyer [s] " on the original "Seller's
Property Disclosure Statement".
14, On or about May 13, 1997, the Plaintiffs employed
Biechler & Tillery, Inc., a home inspection company, to examine the
Subject Property, The Defendants informed neither the Plaintiffs
nor the home inspector that repairs had been made to the water pipe
and that a recommendation had been made by a professional to
replace the water pipe,
15. On or about May 29, 1997, the Plaintiffs and Defendants
settled on the Subject Property, Defendants failed to mention at
settlement that any repairs were made to the water pipe or that it
should be replaced,
16. On or after July 30, 1997, the Plaintiffs received a
water bill from the Pennsylvania - American Water Company in the
amount of Two Hundred Seventy-Nine and 20/100 ($279.20) Dollars.

Said bill was the Plaintiffs' first water bill for a complete
billing cycle spanning 30 days from June 17, 1997 to July 17, 1997.

17, On or about August 12, 1997, Nanette Holmes, Plaintiff,
contacted Lydia Waggoner, Defendant, to inquire as to the standing

water found on the Subject Property. The Defendant responded that
they had experienced certain problems with the water pipe and that
remedial repairs had cured both the leakage and the standing water,
18, Plaintiffs subsequently contacted Zimmerman Plumbing to
investigate the water pipe problem. Upon arrival en the Subject
Property, Barry Wagner, of Zimmerman Plumbing, informed Plaintiffs
that they had previously been to the same property to inspect and
repair similar problems with the water pipe and that Zimmerman
Plumbing had recommended to Lydia Waggoner that the water pipe be
replaced instead of repaired,
19. Employees of Zimmerman Plumbing inspected said water pipe
on or about September 8, 1997. Said employees recommended
installing a new water pipe from the curb to the house and
installing a new main shut off so that further leaks could be
mitigated.
20. Installation of the water pipe and installation of the
new main shut off cost the Plaintiffs One Thousand Two Hundred
Sixty-Eight and 52/100 ($1,268,52) Dollars.
21. Said repairs and installation also caused damage to the
yard and landscaping on the Subject Property,
22, Plaintiffs hired McCurdy's Tree & Landscape Services,
Inc" to provide a quote for restoring the property to its original
condition. This proposal was in the amount of Eight Hundred Sixty-
Four and 27/100 ($864.27) Dollars.
23. Until the date of repair, September 8, 1997, Plaintiffs
incurred two additional water bills from Pennsylvania - American
Water Company which far exceeded what Plaintiffs have now come to
know as the average water bill of approximately $40,00.
Said
excessive water bills were in the amounts of Four Hundred One and
54/100 ($401,54) Dollars and 'hree Hundred Thirty-Nine and 57/100
($339,57) Dollars, respectively,
24, Said actions and/or omissions by Defendants are a breach
of their continuing duty to disclose accurate information on the
Seller's Property Disclosure Statement regarding a material defect.
25. This action is subject to compulsory arbitration in that
the amount in controversy is less than $35,000,00,
WHEREFORE, Plaintiffs, Mark and Nanette Homes, respectfully
request that this Honorable Court find for Plaintiffs and against
Defendants in the amount of $3,033,10 plus costs and such other
relief this Court deems just,
