TEMPORARY PROTECTIVE ORDER
AND NOW, this 2", 1ay of March, 1998, upon presentation and consideration of the
within Petition, and upon finding that V. JOANN MALA VENDA, now residing in Cumberland
County, Pennsylvania, is in immediate and present danger of abuse from the defendant. CARL R.
MALA VENDA, the following Temporary Order is entered,
The defendant, CARL R. MALA VENDA. whose current address is 512 North West
Street, Carlisle, Cumberland County, Pennsylvania, is hereby enjoined from physically abusing the
plaintiff, V. JOANN MALA VENDA, and their minor daughter, or placing them in fear of abuse
and is ordered to stay away from any location where they may reside, The plaintiff is hereby
awarded primary physical custody of the parties' minor daughter. Angalena M, Malavenda, born
April 25, 1994, The defendant is hereby notified that ifhe fails to follow this Order, he may be in
indirect criminal contempt which is punishable by a fine not to exceed $1,000.00 and/or by a
sentence of up to six months in jail and any other appropriate punishment.
This Order shall remain in effect until a final order is entered in this case, A hearing shall
be held on this matter on the 17- #. day of March, 1998, at ~: 30 a. .m, in Courtroom No.

AND NOW comes the Petitioner, V, JOANN MALA VENDA, by her attorneys, Irwin,
McKnight & Hughes, Esquires and presents this petition for a protective order under the
Protection from Abuse Act, 23 Pa,C,S.A. Section 6101 et seq" representing as follows:
I.
The Petitioner is V, JOANN MALA VENDA, an adult individual presently residing at 239
West Locust Avenue, Carlisle, Cumberland County, Pennsylvania,

The Respondent is CARL R. MALAVENDA, an adult individual residing at 512 North
West Street, Carlisle, Cumberland County, Pennsylvania,

The parties were married on October 26, 1991, and separated on January 24, 1997,

There was one child born to this marriage, Angalena M, Malavenda, born April 25. 1994,

Immediately following the parties' separation, the respondent visited the minor child on a
very sporadic schedule. often failing to follow through with promises of visitation,

Prior to the parties' separation, the respondent often displayed violent behavior in the
presence of both the petitioner and their minor daughter, including throwing items of personal
property, and making threats of hurting the petitioner and himself.

Recently, the parties have disputed regarding the custody of their minor daughter, and the
respondent has threatened to kill the petitioner in various ways,

Most recently, the respondent was speaking to the petitioner's mother, and told the
petitioner's mother that he was going to kill the petitioner and cut her up in little pieces and that
no one will ever be able to find the evidence,

The petitioner is in fear of serious bodily injury and/or death for both herself and her minor
daughter,

The petitioner had previously been diagnosed with depression and severe mood disorder.
and had previously been on medication to control the symptoms,

The petitioner is unaware of whether the respondent is currently on medication or whether
he is choosing not to take the prescribed medication,
WHEREFORE, Petitioner respectfully requests this Honorable Court to enter an order
providing that :
a, Respondent shall refrain from abusing threatening with violence, harassing or
visiting the Petitioner in any manner;
b. Respondent shall be excluded from any residence where the Petitioner and her
minor daughter may reside;
c, Petitioner shall be granted primary physical custody of the parties' minor daughter;
d, Such other relief as this Court deems necessary,
