5. Under the contract, Defendant in this matter was
responsible for purchasing lumber. Due to Defendant's failure to
supply necessary lumber, the Plaintiff purchased the necessary
lumber from Moore's on August 7, 1997 for the total sum of $587.13.
To date, this amount has not been repaid. Moore's invoice is
attached hereto and incorporated as Exhibit A.
6. During the construction, a check for prior billing was
returned for insufficient funds. Notice from Harris Savings Bank
is attached hereto and incorporated as Exhibit B.
7. The Plaintiff submitted an invoice for payment of work
performed in a workmanlike manner on August 22, 1997. This was
done in accordance with prior practice between the parties for over
three years and in accordance with the same type of specifications
for work done for the Defendant for which the Plaintiff had been
paid. Three similar jobs by the same invoicing were done and paid
in 1997. This invoice is attached hereto and incorporated as
Exhibit c.
8. After submission of the invoice, Plaintiff received a
billing adjustment dated September 4. 1997 without explanation of
reduction of $250.00 for which he is rightfully entitled to
payment. This is more fully set forth and attached hereto and
incorporated as Exhibit D.

9. Plaintiff has incurred interest from Moore's in the
amount of $14.73 per month, after the 30 days from the invoice of
August 7, 1997.
10. Plaintiff is entitled to one and one-half percent
interest from 30 days of the date of the invoice until the date of
judgment which amount is $6,836.03.
11. Defendant requested the Plaintiff to do additional work
at a construction site at Divens, which work necessitated leaving
the job site at Lot 3, Irish Glen subdivision for approximately
eight days.
12. Plaintiff completed his work in a prompt and workmanlike
manner.
WHEREFORE, Plaintiff demands judgment for the invoiced work
of $7,174.41, together with interest from date of judgment from
the District Justice in the amount $35.87 per month.
