a. On or ahout Fchruary 1 I, 1998, the defcndant confesscd 10
the plainlilf that in or about .July, 1997, he had dissolved the
contents of a 50 milligram capsule of Loxipane into a glass of milk
which he gave to the plaintiff's four year old daughter, At that time,
the defendant had been caring for the children while the plaintiff
was away for a few hours. When she relurned, she found thai the
defendant had taken the children and gone 10 his mother's. When
the plaintiff wcnt there, she found Bryan, age 2, and Daniellc, age
4, sleeping on the eouch. Hours later they were still sleeping and
were unable to be arouscd to bc taken home. Lah:r, after being
taken home, Bryan woke up and bccamc alert but, Danielle got
worse, stared into space and passed out. The plaintiff called for an
ambulancc and Danielle was taken to Holy Spirit Hospital and
eventually transferred to Hershey Medical Ccnter wherc she was
placed in ICU for the next three days for testing. It was discovered
that she had Loxipane in her system. The plaintiff feared for herself
and her children since this incident since she suspected that the
defendant had been responsible for the children's condition, She has
been unable to sleep, and has had recurring nightmares about the

incidcnt. When the defendant confessed 10 her thaI hc had druggcd
the children, the plainlilf callcd the police and Cumberland County
Children and Y oulh Sen-ices, Whcn Ihc plaintirr told thc defendant
to leave the residcnce, he did, TIIC policc and Cumhcrland County
Children and Youth Services are currently investigating this incident,
b, On or about Fchruary 10, 1998, the defendant raiscd his fist
to the plaintiff and threatened to kill hcr.
c. In or about January 1998, when the plain tilT was eight
months pregnant, the defendant kicked her in her upper stomach
callSing her to fear for hcr safely and thc safely of hcr unborn child,
d. In or about 1996, aftcr thc plainlilT askcd thc defendant to
leave thc residcnce and he rcfllScd, ehased her, grabbed her, and
repeatedly punched her on the hcad causing swelling. 1be children
wcre present during this incident. The Mechanicshurg Police were
called, and they arrcstcd the defcndant for simple assault,
5, The plaintiff believes and therefore avers that she and the minor childrcn are in
immediate and present danger of ahuse from the defendant should they rcmain in the home
without the defendant's exclusion and that they are in need of protection from such abusc.
6. 1be plaintiff desires that the defendant be prohibited from having any direct or
indirect eonlael whh the plaintifi'including, but nol linlited to, telephone and wliUen
conununicalions, except for Ihe limited purposc of facilitating supervised visitation arrangements,

Hummel Avenuc, Second Floor, Lemoyne, Pennsylvania,
12. The plaintilf dcsires possession of the home so as to give the greatest degree of
eonlinuity to the lives of thc children and to allow her son, Johnny L(lwrcnce Dariely, Jr., to
continue his education at his school and to continue his school and social activilics.
C. REIMBURSEMENT FOR COST OF CASE
13, 'The plaintiff asks that thc defcndant be ordered to pay $250,00 to reimburse one of
Legal Services, lnc.'s funding sources for the cost of litigating this case.

8. This Order shall remain in effect for a pcriod of one year or until modilicd or
terminated by the Court, The Order can be extended hcyond ils original expiration date if the
Court finds that the defendant has eommitled another act of abuse or has eng.1ged in a patient or
practice that indicates continued risk of hann to the plaintiff.
9. A \iolalion oflhis Order may subject the defcndant to: i) arrcst under 23 i'a,C,S,
~6Il3; il) a private criminal complaint under 23 i':l,C.S. ~6Il3,1; iii) a charge of indirect eriminal
contcmpt undcr 23 Pa,C,S, ~61 14, punishable by imprisonment up to sLx months and a fme of
$100.00-$1,000.00; and iv) civil contempt under 23 Pa,C.S, ~6II4. I. Resumption of co-
residence on the part of thc plaintiff and defendant shall not nullify the provisions of the court
order.
10. The Wcst Shore Regional Police Departmenl shall be pro\ided with a certified
copy of this Order by the plaintiff's atlorney and may enforce this Order by arrcst for indirect
criminal contempt without warrant upon prohable cause that this Ordcr has been violatcd, whether
or not the violation is committed in the presence of a police officer. In the cvent that an arrest is
made under this seetiun, the defenwnt shall be taken without unm:cessalY delay befure the euurt
