AND NOW comes the Plaintiff, Michael L. Martin, Inc.,
t/d/b/a M M I Components, by its attorney, L,ouis J. Adler, and
states the following:
1. Plaintiff, Michael L. Martin, Inc, t/d/b/a M M I
Component.s, a duly registered f ict.i tious name, is a corporation
organized and existing under the laws of the Commonwealth of
Pennsylvania with a principal place of business at 52 Rear Market.
Street, Lemoyne, Cumberland County, Pennsylvania.
2. The Defendant, Ronald L. Little, Sr" is an
individual residing at 4480 Paradise Road, Dover, York County,
Pennsylvania 17315.
3 . Plaintiff is in the business of rebuilding racing
cars as well as selling parts and accessories therefore,
4. Defendant was an employee of Plaintiff from January
2, 1997 to December 17, 1997.
Initially he was employed as a
welder and from October 1997 Defendant acted as sales manager of M

5, On or about December 17, 1997, it was discovered
that Defendant had surreptitiously and without the permission or

Plaintiff was building atlts premises. The inventory value of the items in Defendant's possession
which have sin~e been returned are $1,988.99. The itemized list attached to Plaintitl's Complaint
as Exhibit" A" lists numerous items which Defendant had never had in his possession frolll
Plaintitl's inventory.
6. Denied. It is denied that the Defendant owed an outstanding balance for
inventory purchar.ed 01'$1,231.11 as shown on the statement marked Exhibit "B" attached to
Plaintitl's Complaint. The said statement is incorrect in that it covers only a portion of the year
1997 during which the Defendant worked for Plaintiff, and records no purchases and payments
made after March 13, 1997, fails to reflect payment made by Defendant prior to March 13, 1997,
and fails to give Defendant credit for sponsorship payments received by Plaintiff for application
to Defendant's account.
7. Denied. It is denied that Defendant was provided with a number of items
including an engine which was to be returned refreshed. On the contrary, Defendant acquired an
engine from Rider's Automotive Machine Shop at a cost 01'$7,706.50 which was paid for by
Plaintiff through sponsorships of Defcndant's racing program, solicitcd and collected by Plaintiff
from Plaintiff's subcontractors.
8. Denied. It is denied that Defendant ordered a vehicle for which he has not paid or
that the amount due for the same is $4,721.25. On the contrary, Defendant never ordered a
vehicle from the Plaintiff and Plaintiff never built a vehicle for the Defendant.
WHEREFORE, Defendant requests that Plaintifl's Complaint be dismissed.

9, Defendant owns and operates a racing program under the name of LCW
Motorsports in which he owns and drives a race car.
10. On or about January 2, 1997, Defendant and Plaintiff entered into an Employment
Agreement, a copy of which marked Exhibit" A" is attached hereto and made a part hereof.
Pursuant to said Agreement, Plaintiff agreed to be a sponsor for Defendant's racing pl'0gram and
contribute the sum 01'$3,000.00 toward the cost of the same.
II. Notwithstanding that the Agreement between Plaintiff and Defendant
contemplated that Plaintiff would pay the sponsorship amount in cash, Plaintiff failed and
refused to do so, and instead authorized Defendant to purchase parts for his racing program from
Plaintiff, and to which Plaintiff agrecd to credit the sponsorship money.
12. In addition to ils own sponsorship money, Plaintiff agreed to find other sponsors
for Defendant's racing program and collect fi'om such sponsors enough money to reimburse
Plaintiff for an engine which Defendant purchased from Rider's Automotive Machine Shop.
13. Plaintiff has failed and refused to account to Defendant for the $3,000.00
sponsorship amount guarantced Defendant under his Employmcnt Agreement, or for the amount
collected by Plaintiff from other sponsors acquired by it.
14. At the beginning of the racing season in 1997 the Defendant inquired of Michael
L. Martin, principal of the Plaintiff, whether he had secured enough sponsorship money to
reimburse PlaintilTfor the monies advanced by it for the engine. Plaintiff advised Defendant that
not all of the anticipated sponsorship money had been collected, but that the cngine belonged to
Defendant who should use the same in his racing program.

REPLY TO NEW MATTER AND COUNTERCLAIM
AND NOW comes the Plaintiff, Michael L. Martin, Inc.,
t/d/b/a M M I Components, by its attorney, Louis J. Adler, Esquire,
and files this Reply to New Matter and Counterclaim as follows:
REPLY TO NEW MATTER
9, Denied, After reasonable investigation Plaintiff is
without knowledge or information sufficient to form a belief as to
the truth of the averments and proof thereof is demanded at the
trial of the cause hereon,
10. Admitted in part and denied in part. It is admitted
that the parties entered into written agreement. The terms of the
agreement being a written document speak for themselves. To the
extent a response may be appropriate it is averred that Plaintiff
did not agree to contribute $3,000.00 from his own funds but rather
to secure t.hat amount from sponsors.
11. Denied. The Agreement of the parties did not
provide that Plaintiff would pay any sponsorship amount in cash but
rather that $3,000,00 would be raised and contributed to
Defendant's racing program which in fact it was in the form of a
credit.
12. Admitted in part and denied in part. It is admitted
that Plaintiff would seek sponsorship funds but any engine purchase
was contingent upon Plaiptiff's ability to obtain sufficient funds
from outside sources and at Plaintiff's discretion, It is denied
that plaintiff had agreed to provide sponsorship money of its own.
13. Denied. As stated aforesaid, plaintiff provided
$3,000.00 of sponsorship money from outside sources which fulfilled
his obligation, Th€' accounting therefore appears in Exhibit "C" of
the Complaint,
14. Admitted in part and denied in part. It is admitted
that the Defendant inquired as to the amount of sponsorship money
collected. It is denied that the engine in any way belonged to
Defendant or that Plaintiff had so indicated.
15, Denied. After reasonable investigation plaintiff is
wit.hout knowledge or information sufficient to form a belief as to
the averment that Defendant delivered an engine to Rider's
Automotive Machine Shop for refreshing or as to his intent if in
fact he did. In any event it is denied that it was "his" engine,
By way of further answer thereto that t.he engine in question was
utilized by Defendant in 1997 but was to be returned to Plaintiff
refreshed in consideration of its use by Defendant,
16. Admitted in part and denied in part. It is admitted
that Plaintiff terminat.ed Defendant, It is denied t.hat it. was
without. just cause. On the contrary the basis for termination was
Defendant's removal of inventory from Plaintiff's premises without
permission or knowledge of employer and without documenting t.he

removal, all of which was in violation of company's policy,
Although wages of $1,120,00 had accrued for the benefit of the
Defendant, Defendant's obligation to employer for his wrongful
oonduct far exceeded that sum.
I? Denied, The engine never belonged to Defendant nor
was there ever an agreement that it was to become Defendant' s
property. On the contrary at all timeo Lhe engine belonged to
Plaintiff. The value of the engine was $5,300.00
18, Denied, It is denied that Plaintiff converted "the
engine" as it never belonged to anyone other than Plaintiff. After
reasonable investigation Plaintiff is without knowledge or
information sufficient to form a belief as to the truth of the
averment conoerning how Defendant's 1998 racing program failed, but
in any event any problem which may have occurred oannot. be
attributed t.o any wrongful act on the part of the Plaintiff, as
there was none.
WHEREFORE, Plaintiff demands judgment against the
Defendant in the amount of $13,435,18 as claimed in the Complaint
together with costs of suit,
REPLY TO COUN!'ERCLAIM
19, Denied. It is denied that Plaintiff is indebted to
Defendant in the amount to $1,120,00 for two weeks services for the
reason that Defendant is indebted to PlainLiff due to Defendant's
wrongful action for an amount far in excess of $1,120.00 as more
particularly stated above.

And now this day of January, 1997, by and between RONALD L. LITTLE, SR"
he~ln after referred to as "Employee" and MMI COMPONENTS, herein after referred to as
"Employer" who he~by agree as follows:
1. Employee's hourly wage will be at the rate 01'$14,00 per hour for a 40 hour work
week, All houn worked over and above 40 will be considered overtime hours and paid at lhe
I1Ile of time and one-halt' per hour,
2. Eleven sets of company unifonns will be furnished to Employee at Employer's
expense.
3, Employee will be entitled to 2 weeks paid vacation effective January I, 1997,
4, Paid holidays will be agreed upon by Employer and Employee,
S, Employee will have the use of Employer's tools and equipment, provided it is for
Employee's Viper Program during ~gular hours,

FINDINGS OF FACT:
1, The claimant was last employed as a sales and office manager for
Michael L. Martin, Inc. His last day of work was December 17, 1997,
He worked for the employer for one year,
2. Originally, the claimant worked as a welder until October 1997 when
he was promoted to the position of sales and office manager.
3. The claimant was an amateur driver for the dirt track late model
vehicle races and he had his own car,
4. At the time the claimant began working for the employer, the
employer agreed to help the claimant obtain sponsors for his racing.
5. The claimant replaced a professional car driver as the sales and
office manager.
6, The professional race car driver accepted the office job under
duresD and preferred to work as a welder for the employer.
7. The employer asked the claimant three times during the last three
weeks to submit an invoice for a race car the claimant insisted was
being built for him.
8. The race car was originally prepared because of a work order
indicating that it was for a professional race car driver before the
claimant insisted it was his,

11. The claimant refused to provide documentation about the race car.
12. The employer rented a space at the Philadelphia Car Show so that the
claimant could show his newly made car to obtain sponsors,
13. 'l'he employer was also planning to show constructed race car
components for the public to view.
14. The owner informed the cla~nant that the company was not going to
enter a car in the shoW anel that the company 'lias not preparing a car
on its own behalf.
15. The claimant began removing inventory from the employer's stock
without permission of the owner or the general manager as soon as he
became the office manager, He also did not prepare any
documentation,
16. The claimant was responsible for maintaining an inventory control by
documenting anything that left the employer's premises unless the
owner was aware of the merchandise that was leaving,
17, On December 16, 1997, after being asked by the president about the
cash flow, the claimant indicated that there were problems because
of the welder who the claimant believed may have been sabotaging the
company's profitability.
18. The welder punched out and walked off of the job indicating to the
employer that he would quit if it was wanted.
19. That night, the welder reported to the president the fact that the
claimant was removing merchandise from the premises without
documentation or informing the owner,
20. The welder did not previously inform the president about the
claimant's removal of merchandise from the premises because the
welder wanted to provide the claimant with an opportunity to prepare
an invoice or other documentation about the merchandise and because
he wanted the claimant to succeed as the sales and office manager so
that he would not again have to assume the position.
21. On December 17, 1997, the president asked the claimant about
removing property and said, "What do you have?"
22. The claimant responded, "You tell me what I have,"
23, The employer discharged the claimant for failing to provide
documentation before removing items from the premises.
24. The claimant knew at the time he was discharged that his dismissal
was the result of removing property from the company's premises
without permission and that it was not due to his position being
eliminated,
25. The claimant received $301.00 of benefits for claim week ending
December 27, 1997,

HISTOR;'!: 'l'he Job Center issued a determination denying benefit.s to t:'he
claimant under Section 402(e) of t.he Pennsylvania Unemployment
compensation Law. The determinat.ion also indicated that he claimant had
a fault overpayment under Section 804(a) of the Law, The claimant filed
a timely appeal to the Job Center determination, A hearing was held
before the Referee which was at.tended by the claimant, a witness and his
counsel as well as employer witnesses and employer counsel.
ISSUE: The issue to resolve in determining the claimant's benefit
eligibility is whether his job separation was the result of wilful
misconduct in connection with the work as defined under Section 402(e) of
the Law and according to court precedents,
The second issue to resolve is whether the claimant has an overpayment,
and if so, under what Section of the Law it will be recouped.
REASONING: Section 402(e) of the Law provides that a claimant shall be
ineligible for compensation for any week in which his unemployment is due
to his discharge or temporary suspension from work for wilful misconduct
connected with his work. Wilful misconduct has been defined as an act of
wanton or wilful disregard of the employer'S interests, a deliberate
violation of the employer's rules, a disregard of the standards of
behavior ~'hich t.he employer has aright to expect of an employe, or
negligence indicating an intentional disregard of the employer's
interests or of the employe's duties and obligations to the employer.
An employer bears the burden of proving that a former employe was
discharged for wilful misconduct in connection with the work in order for
unemployment benefits to be denied, 'ro meet this burden, the employer
must prove the existence of a reasonable policy and that the claimant
violated it. The employer testimony is credible that an employe was
required to provide written documentation about removing company stock
from the premises unless the removal was known and approved by the
president. The Referee also finds credible the testimony that the
claimant violated this policy. Therefore, the employer has met its
burden.
The burden then shifts to the claimant to prove either he had good cause
for the violation of the employer policy or that the employer's policy
wa~ unreasonable. The claimant's testimony that the general manager knew
and approved of the claimant's removal of the merchandise is not found to
be credible. Furthermore, the claimant's contention that he was
willing to spend his own time, effort and money making components for a
race car which belonged to the employer is not found to be credible.
Thus, the claimant has not met his burden. Consequently, the claimant's
discharge was the result of wilful misconduct in connection with the work
and he is not eligible for benefits under Section 402(e) of the Law.
Section 804(a) of the Law provides, in substance, that the State is
empowered to recover any benefits improperly paid to the claimant because
of the claimant's fault.
