COMPLAINT
Plaintiffs, ORIVEKORE, INC. and CONSTRUCTION EQUIPMENT
RENTAL, INC., by and through counsel of Andrew C. Sheely, Esquire,
and Charles E. Shields, III, Esquire, hereby file this Complaint
and respectfully state as follows:
1. Plaintiff, DRlVEKORE, INC., is a corporation duly
authorized and constituted under the laws of the Commonwealth of
Pennsylvania with a principal place of business at 36 West Allen
Street, in the Borough of Mechanicsburg, Cumberland County,
Pennsylvania, and also having a post office box number of 2004 in
the aforesaid place.
2. Plaintiff, CONSTRUCTION EQUIPMENT RENTAL, is an entity
owned and controlled by Plaintiff, DRlVEKORE, INC., with a duly
recorded fictitious name and with its place of business at 5 East
Allen Street, in the Borough of Mechanicsburg, Cumberland County,
Pennsylvania, and also having a Post Office Box Number 2004 in the
aforesaid place.
3. Defendant NYE CONSTRUCTION COMPANY. INC., is a
corporation duly authorized and constituted under the

la\~S of the Commonwealth of Pennsylvania with a principal place of
business at 73 W. Burd Street, Shippensburg, Cumberland County,
Pennsylvania.
4. Defendant NYE CONSTRUCTION COMPANY, INC. has from time to
time used a business address of 49 W. Orange Street, P.O. Box D,
Shippensburg, Cumberland County, Pennsylvania.
5. Plaintiffs have had a business relationship with D~fendant
for at least nine (9) months.
6. During the aforesaid business relationship Defendant
requested and was granted a credit account with Plaintiff,
DRlVEKORE, mc.
7. When a company or a person establishes an account with
Plaintiff, DRIVEKORE, INC., they automatically also have an
account with Plaintiff CONSTRUCTION EQUIPMENT RENTAL.
8. After Defendant established an account, Defendant
routinely and periodically purchased and rented assorted items on
an open account.
9. The majority of all pr.oducts or equipment purchased or
rented were picked up by Defendant from the various Plaintiffs at
the various above-mentioned premises or were shipped to Defendant
via Plaintiffs' own trucks.
10. The products or equipment purchased or rented were
evidenced by "work orders" or "invoices" which listed the items
purchased or rented by Defendant and which were usually signed by

an agent, servant or employee of Defendant to acknowledge receipt
of such products or equipment.
11. The pick up or delivery of such products or equipment
would then be followed by a "billing invoice" stating, inter alia,
the products or equipment picked up or delivered and the price or
rental thereof on terms of "net 30 days".
12. There a currently numerous items which have not been paid
for on the accounts with Plaintiffs.
COUNT NO. i - BREACH QLACCOUNT AGREEMENT
13. Paragraphs 1 - 12 are incorporated herein by reference as
if set forth at length.
14. On or about April 17, 1997, Defendant rented a rotary
hammer and chisel from Plaintiffs for a period of one (1) day (3.3
hours), and purchased two (2) six inch cupwheels resulting in
Defendants being invoiced an amount of $86.84 as more particularly
set forth in Exhibit "A" attached her.eto.
15. On or about April 18, 1997, Defendant rented a gas floor
grinder and an 18" diamond cup wheel from Plaintiffs for a period
of 2.2 hours resulting in Defendants being invoiced an amount of
$161.39 as more particularly set forth in Exhibit "B" attached
hereto.
l6. On or about April 17, 1997, Defendant rented a 7" angle
grinder from Plaintiffs for a period of nineteen and one-half
hours (19.5) resulting in Defendants being invoiced an amount of

$18.92 as more particularly set forth in Exhibit "C" a,ttached
hereto.
17. On or about April 23, 1997, Defendant rented a rotary
hammer and 1 and 1/2 by 12" macho chisel from Plaintiffs for a
period of two (2) days (9.1) hours resulting in Defendants being
invoiced an amount of $133.56 as more particularly set forth in
Exhibit "D" attached hereto.
18. On or about April 21, 1997, Defendant rented two (2)
Propane heaters from Plaintiffs for a period of twenty-eight (28)
days resulting in Defendant being invoiced an amount of $455.20 as
more particularly set forth in Exhibit "E" attached hereto.
19. On or about May 19, 1997, Defendant rented two (2)
Propane heaters from Plaintiffs for a period of nine (9) days
(21.9 hours) resulting in Defendant being invoiced an amount of
$178.08 as more particularly set forth in Exhibit "F" attached
hereto.
20. Defendant was properly notified of all invoices and has
refused to pay Plaintiffs for such r~asonable and fair rental
charges and purchases.
21. Presently an amount of One Thousand, Twenty-Three
dollars and Ninety-Nine cents ($1,023.99) is due Plaintiffs from
Defendant as concisely set forth on Exhibit "G" as attached
hereto.
22. Over ninety (90) days have elapsed since the last billing

invoice was sent to Defendant by the various Plaintiffs.
23. Plaintiffs and Plaintiffs' agents have made repeated
demands and request for payment.
24. Despite such repeated demands and requests, Defendant has
not tendered any money on the items set forth above for which
money is sti.::'l due and owing and Defendant has refused to pay for
such reasonable amounts.
WHEREFORE, Plaintiffs demand judgment agai.nst Defendant,
NYE CONSTRUCTION COMP!\NY, INC., in the amount of ONE THOUSAND,
TWENTY THREE DOL.k\RS and NINETY-NINE cents ($1,023.99), plus
interest at the rate of one and one-half percent (1 1/2%) per
month from the date each invoice was submitted, together with the
costs of this action, in an amount which requires compulsory
arbitration, and any other relief deemed just and appropriate.
COUNT NO 1-2-:-~\lAtIT.~t.IED CONTRACI
25. The averments of Paragraphs 1 through and inClUding 24
hereinabove are incorporated hereby by reference thereto.
26. Pursuant to the request made by Defendant, Plaintiffs
provided services and goods to Defendant.
27. The reasonable and necessary charges for said services
and goods provided as requested by Defendant are in the total
amount of ONE THOUSAND TWENTY THREE DOLLARS and NINETY-NINE cents
($1,023.99).
2B. To date, Defendant, despite proper request and demand by

plaintiffs, has not brought its account current.
29. By reason of Defendant's request for performance of
services and p.roviding of goods, Defendant impliedly promised to
pay the reasonable and necessary charges for same.
WHEREP'ORE, Plaintiffs demand judgment. against Defendant,
NYE CONSTRUCTION COMPANY, INC., in the amount of ONE THOUSAND,
TWENTY THREE DOLLARS and NINETY-NINE cents ($1,023.99), plus
interest at the rate of one and one-half percent (1 1/2%) per.
month from the date each invoice was submitted, together with the
costs of this action, in an amount which requires compulsory
arbitration, and any other relief deemed just and appropriate.

31. Defendant obtained the services, supplies and equipment
of Plaintiffs as set forth herein and included within Exhibits "A"
through "G".
32. Plaintiffs fully and adequately performed services and
provided supplies and equipment as requested by Defendant.
33. As a direct and proximate result of Defendants refusal
to pay the reasonable value of Plaintiffs' services, supplies and
equipment from which Defendant benefitted, Defendant has been
unjustly enriched in the amount of ONE THOUSAND TWENTY THREE
DOLLARS and NINETY-NINE cents ($1,023.99).

14. On or about April 17, 1997, Defendant rented a rotary
hammer and chisel from Plaintiffs for a period of one (1) day (3.3
hours), and purchased two (2) six inch cupwheels resulting in
Defendants being invoiced an amount of $86.84 as more particularly
set forth in Exhibit "A" attached hereto.
15. On or about April 18, 1997, Defendant rented a gas floor

20. Defendant was properly notified of all invoices and has
refused to pay Plaintiffs for such reasonable and fair rental
charges and purchases.

25. The averments of paragraphs 1 through and including 24
hereinabove are incorporated hereby by reference thereto.
26. Pursuant to the request made by Defendant, Plaintiffs
provided services and goods to Defendant.
27. The reasonable and necessary charges for said services
and goods provided as requested by Defendant are in the total
amount of ONE THOUSAND TWENTY THREE DOLLARS and NINETY-NINE cents
($1,023.99).
28. To date, Defendant, despite proper request and demand by

32. Plaintiffs fully and adequately performed services and
provided supplies and equipment as requested by Defendant.
33. As a direct and proximate result of Defendants refusal
to pay the reasonable value of Plaintiffs' services, supplies and
equipment from which Defendant benefitted, Defendant has been

4. Defendant NYE CONS'rRUC'l'ION COMPANY, INC. has from time to
time used a business address of 49 W. Orange Street, P.O. Box D,
Shippensburg, Cumberland County, Pennsylvania.
5. Plaintiffs have had a business relationship with Defendant
for at least nine (9) months.
6. During the aforesaid business relationship Defendant
requested and was granted a credit account with Plaintiff,
DRIVEKORE, INC.
7. When a company or a person establishes an account with
Plaintiff, DRIVEKORE, INC., they automatically also have an
account with Plaintiff CONSTRUCTION EQUIPMENT RENTAL.
8. After Defendant established an account, Defendant
routinely and periodically purchased and rented assorted items on
an open account.
9. The majority of all products or equipment purchased or
rented were picked up by Defendant from the various Plaintiffs at
the various above-mentioned premises or were shipped to Defendant
via Plaintiffs' own trucks.
10. The products or equipment purchased or rented were
evidenced by "work orders" or "invoices" which listed the items
purchased or rented by Defendant and which were usually signed by

an agent, servant or employee of Defendant to acknowledge receipt
of such products or equipment.
11. 'I'he pick up or delivery of such products or equipment
would then be followed by a "billing invoice" stating, inter alia,
the products or equipment picked up or delivered and the price or
rental thereof on terms of "net 30 days".
12. 'rhere a currently numerous items which have not been paid
for on the accounts with Plaintiffs.

14. On or about April 17, 1997, Defendant rented a rotary
hammer and chisel from Plaintiffs for a period of one (1) day (3.3
hours), and purchased two (2) six inch cupwheels resulting in
Defendants being invoiced an amount of $86.84 as more particularly
set forth in Exhibit "A" attached hereto.
15. On or about April 18, 1997, Defendant rented a gas floor
grinder and an 18" diamond cup wheel from Plaintiffs for a period
of 2.2 hours resulting in Defendants being invoiced an amount of
$161.3Q as more particularly set forth in Exhibit "B" attached
hereto.
16. On or about April 17, 1997, Defendant rented a 7" angle
grinder from Plaintiffs for a period of nineteen and one-half
hour's (1.9.5) resulting in Defendants being invoiced an amount of

$18.92 as more particularly set forth in Exhibit "e" attached
hereto.
17. On or about April 23, 1997, Defendant rented a rotary
hammer and 1 and 1/2 by 12" macho chisel from Plaintiffs for a
period of two (2) days (9.1) hours resulting in Defendants being
invoiced an amount of $133.56 as more particularly set forth in
Exhibit "D" attached hereto.
lB. On or about April 21, 1997, Defendant rented two (2)
Propane heaters from Plaintiffs for a period of twenty-eight (28)
days resulting in Defendant being invoiced an amount of $455.20 as
more particularly set forth in Exhibit "E" attached hereto.
19. On or about May 19, 1997, Defendant rented two (2)
Propane heaters from Plaintiffs for a period of nine (9) days
(21.9 hours) resulting in Defendant being invoiced an amount of
$178.0B as more particularly set forth in Exhibit "F" attached
hereto.
20. Defendant was properly notified of all invoices and has
refused to pay Plaintiffs for such reasonable and fair rental
charges and purchases.
21. Presently an amount of One Thousand, Twenty-Three
dollars and Ni.nety-Nine cen.ts ($1,023.99) is due Plaintiffs from
Defendant as concisely set forth on Exhibit "G" as attached
hereto.
22, Over ninety (90) days have elapsed since the last billing

invoice was sent to Defendant by the various Plaintiffs.

demands and request for payment.
24. Despite such repeated demands and requests, Defendant has
not t.endered any money on the items set forth above for which
money is still due and owing and Defendant has refused to pay for
such reasonable amounts.
WHEREFORE, Plaintiffs demand judgment against Defendant,
NYE CONSTRUCTION COMPANY, INC., in the amount of ONF. THOUSAND,
TWENTY THREE DOLLARS and NINE'rY-NINE cents ($1,023..99), plus
interest at the rate of one and one-half percent (1 1/2%) per
month from the date each invoice was submitted, together with the
costs of this acticn, in an amount which requires compulsory
arbitration, and any other relief deemed just and appropriate.

hereinabove are incorporated hereby by reference thereto.
26. Pursuant to the request made by Defendant, Plaintiffs
provided services and goods to Defendant.
27. The reasonabl_ and necessary charges for said services
and goods provided as requested by Defendant are in the total
amount of ONE THOUSAND TWENTY THREE DOLLARS and NINETY-NINE cents
($1,023.99).
28. To date, Defendant, despite proper request and demand by

services and providing of goods, Defendant impliedly promised to
