3. The Defendant, Peter B. Givler, was an individual
who resided in Cumberland County, Pennsylvania, but who is now
deceased, and his heirs or possible assignees or transferees
are unknown to Plaintiffs if any there be. Moreover the
whereabouts of any possible heirs, assignees or transferees of
Peter B. Givler is unknown to the Plaintiffs.
4. The Defendant, Mary M. Givler, was an individual who
resided in Cumber.1and County, Pennsylvania, but who is now
deoeased, and her heirs or possible assignees or transferees
are unknown to Plaintiffs if any there be. Moreover the
whereabouts of any possible heirs, assignees or transferees of
Mary M. Givler is unknown to the Plaintiffs.
5. Samuel W. Nevin and Harriet M. Nevin, his wife, were
seized in fee of the land hereinafter described in this para-
graph hereof, and by their deed dated February 19th, 1880, and
reoorded in the Offioe of the Recorder of Deeds for Cumberland
County in Deed Book "8", Vol. 3, page 293, conveyed the same
to Nancy Givler.
Nancy Givler, being seized of the land, died April
10th, 1897, leaving to survive her as her sole legal heirs,
Joseph Givler, Peter B. Givler and Mary M. Givler.
Joseph Givler, Peter B. Givler and Mary M. Givler,
by their deed dated December 12th, 191~, and intended to be
recorded, conveyed the land to Benjamin M. Heberlig.
Lenora Heberlig and Hazel Heber1ig Brechbie1, Execu-
trices of the last will and testament of Benjamin M. Heber1ig,
deoeased, by their deed dated March 27th, 1965, recorded in
Cumberland County Deed Book Vol. N21, page 999, conveyed the
same to Anna M. Gipe.
On November 19th, 1974, Anna M. Gipe, a widow and
single woman, of Shippensburg TownShip, Cumberland county,
Pennsylvania, oonveyed a fee simple title as tenants by the
entireties, to five (5) acres and sixty.-three (63) perches of
unimproved land in Southampton TownShip, Cumberland County,
Pennsylvania, to Thomas G. Fuller and Vernal E. Fuller, his
wife, said deed having been recorded in Cumberland County Deed
Book Vol. X25, page 965, on January 29th, 1975, attaohed here-

To the Honorable, the Judges of the court of common Pleas of
cumberland county, pennsylvania:
NOW COMES, Thomas B. steiger, Attorney for the Plaintiffs
in the above captioned Action to Quiet Title, and after
investigation, as set forth in the accompanying affidavit,
believing that service by the Sheriff can not be made,
respectfullY moves 'lour Honorable court, pursuant to Pa.
R.C.P. Rule 430, to make an order directing service of the
complaint by publication against the Defendants and their
heirs and assigns generally, they being unknown.

Thomas B. steiger, being duly sworn according to law,
deposes and says that he is the Attorney for AIda Maye Fuller,
Grac},e L. Golden and Sandra Jean Corlett, Executrices of the
last will and testament of Vernal Ellen Fuller, Deceased,
Plaintiffs, in the within Action to Quiet Title, and that he
as such attorney attempted to discover and determine the
whereabouts of the Defendants, Joseph Givler, Peter B. Givler
and Mary M. Givler, their heirs and assigns, by inquiries of
postal authorities in the Shippensburg, Franklin and Cumber-
land County areas, by checking voter registration lIsts in the
Shippensburg area, by inquiring whether files in the law
offices of the late William R. Mark, or Anna M. Gipe, the
person who conveyed the real est.at.e in question to the
Plaintiffs' decedent, had any information as to Defendants,
their heirs and assigns, or if they had in their possession
the missing deed.
As a result of such inquiries Affiant determined that t.he
names of the Defendants, Joseph Givler, Peter B. Givler and
Mary M. Givler did not appear on any vot.ers list for the
Shippensburg area or in the voter registration office for
Cumberland County. Nor did any of their names appear in the
Shippensburg Area or Cumberland County countywide telephone
books for fall of 1997. Neither Anna M. Gipe nor the law
office of the late William R. Mark, Esquire, have the missing
deed or know of any heirs of t.he three Defendants. Further
Affiant had the records in the Office of the Register of Wills
for Cumberland County examined for any records of Defendants'
estate proceedings.

As a result of the Affiants search of the records in the
office of the Register of Wills of Cumberland County, it was
determined that Peter B. GiVler died testate December 17th,
1921, and his will, a copy of which is attached hereto,
reoorded in Will Book Vol. 31, page 478, devised his entire
estate to Joseph Givler for life, then to mary M. GiVler, for
life, then to his heirs. The estate was administered pursuant
to said will, however, the inventory and appraisal and other
pertinent papers could not be found in the file indicated.
The logical assumption from said records is that Joseph
Givler and Mary M. GiVler were brother and sisters of Peter B.
GiVler, and were unmarried.
