4. On or abotlt Septcmber IS, 1983, as security for payment of the aforcsaid Note,
Defendant made, cxccutcd and delivered to Plaintiff a Mortgage in the original principal amount
of $36,000.00 on the premiscs hereinaftcr described, said Mongage bcing recOl'dcd in the Ofticc
of the Rccordcr of Decds of Cumbcrland County un Scptembcr 15, 1983 in Mortgagc Book
Volume 736 PlIge 625. A true und corrcct copy of said Mortgage containing a dcscription ofthc
premises su~iect to said Mortgagc is markcd Exhibit "A", attached hercto und madc II part hcreof.
5. Dcfcndant is thc rccord und rcal owner of the aforcsaid mortgaged premises.
6. Defendant is in default under the terms of the aforesaid Mortgage und Notc for,
intcr alia, failurc to pay the monthly installments of princiPlllund interest when due. Dcfendant
is due for thc September I, 1997 paymcnt.
7. On or about November 10, 1997. Defendant was mailed Notice of
Homeowner's Emergency Mortgage Assistancc Act of 1983, in compliance with the
Homeowner's Emergency Mortgage Assistancc Act, Act 9101' 1983. A true and correct copy of
said Notice arc markcd Exhibit "B", attuched hereto and made a pm1 hereof.
8. On or about November II, 1997, Defendant was mailed Notice of Intention to
Foreclose Mortgage in compliance with Act 6 of 1974, 41 P.S. slOI, ct seq. A true and correct
copy of said Notke is marked Exhibit "C", attached hereto and made a part hereof.
