PA 11M) confirm that the price of $233,000 was based upon plank delivery to occur about the second week of May, 1997. 6. Poole incorporated the Nitterhouse bid into its overall bid for the construction of the project and this bid was accompanied by a bid bond. 7, On March 13, 1997, Poole was notified that they were the successful bidder on the project. 8. On March 14, 1997, Poole advised Nitterhouse that Nitterhouse was the low sllccessful concrete plank subcontractor and that Nitterhouse would be doing the project based on a schedule of plank delivery starting in May, 1997. 9. On March 20, 1997, Poole issued a written notice of its intent to award the contract to Nitterhouse with direction to proceed immediately with shop drawings, submittals and orders as necessary to prevent any delay to the proj ect. A copy of this notice is attached hereto as Exhibit "B". 10. On March 24, 1997 and March 25, 1997, Poole received facsimile messages from Nitterhouse requesting specific information on the project. A copy of these facsimile messages are attached hereto as Exhibit "e" and "D" respectively. 11. On March 27, 1997, Poole received a written confirmation of the precast order from Nitterhouse. A copy of this confirmation is attached hereto as Exhibit "E". 12. On March 27, 1997, Larry Shoemaker from Nitterhouse contacted Jeff Packard from Poole and informed him that Nitterhouse could not provide the plank for the Wingate Inn 2 project until August 1, 1997 since they had received several other large orders which made th/!J previously agreed upon delivery in May 1997 "impossible." 13. On March 28, 1997, Richard D. Poole confirmed the events described above in a letter to William Nitterhouse, Vice President of Nitterhouse. A copy of this letter is attached hereto as Exhibit "F". 14. Because of its contractual commitments relating to the schedule for the project, Poole was required to utilize the services of another contractor, Stresscon, Inc. to perform the work which Nitterhouse had agreed to perform. i I; Ii I I 15. The contract which Poole issued to Stresscon was for. $248,000. 16. In addition to the increased costs of the Stres8con contract, Poole has incurred additional costs in the amount of $29,000.00 because of Nitterhouse's refusal to honor its commitment. COUNT I - BREACH OP' CONTRACT 17. The averments of Paragraph 1 through 16 are incorporated herein by reference as though fully set forth. 18. The actions of Nitterhouoe is described above in Paragraphs 5 through 12 constitute a breach of contract. 19. On March 28, 1997, Richard D, poole confirmed the events described above In a letter to William Nitterhouse, Vice President of Nitterhouse. On March 14, 199'7, Poole advised Nitterhouse that Nitterhouse was the low successful concrete plank subcontractor and that Nitterhouse would be doing the project based on a schedule of plank delivery starting in May, 1997. 9. On March 20, 1997, Poole issued a written notice of its intent to award the contract to Nitterhouse with direction to proceed immediately with shop drawings, subm:l ttals and orders as necessary to prevent any delay to the project. A copy of this notice is attached hereto as Ex.hibit "B". 10. On March 24, 1997 and March 25,1997, Poole received facsimile messages from Nitterhouse requesting specific information on the project. A copy of these facsimile messages are attached hereto as Exhibit "e" and "D" respectively. 11. On March 27, 199'7, Poole received a written confirmation of the precast order from Nitterhouse.
