oncoming lane and into the driver's side ofa 1992 Toyota Camry owned and operated by
Plaintiff causing damage to Plaintiff's vehicle.
5. Plaintiff had observed Defendant coasting toward her, had negotiated her
vehicle as far to the right of the parking lot lane as possible, had sounded her horn, but
Defendant still negligently struck Plaint ill's vehicle.
6. Defendant's negligence consisled of:
a. Failure to operate his vehicle at a safe speed so as to give himself a safe
stopping distance.
b. Failure to be diligent in his observation of other vehicles in and around
him while operating his vehicle and proceeding through a parking lot so as to give himself
a safe stopping distance,
c. Failure to maintain his vehicle in his lane of traffic so as not to endanger
persons and property traveling in an oncoming lane.
6. As a result of Defendant's negligence, Plaintiff suffered the following damages:
a, Damage to her vehicle in the amount of$2,097.17.
b. Past rental expenses for a replacement vehicle in the amount of
$2,451. 70.
$420.00.
c. Future rental expenses for a replacement vehicle in the amount of
d. Interest on the rental expenses incurred in subparagraph b. at the
statutory rate.
7. Plaintill's damages do not exceed Twenty-Five Thousand ($25,000.00) Dollars.
8. The damages suffered by Plaintiff were directly and/or substantially caused by
Defendant's negligence.
