STIPULATION AGAINST LIENS
THIS AGREEMENT made this Ir/"-. day of f1l11/Uh ,
between H. Edwin Berkheimer, a sole proprietor,
referred to as Contractor,
1998, by and
hereinafter
AND
Gilbert L. Bishop and Linda M. Bishop, husband and wife,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in South Middleton Township, Cumberland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lot
#11 The Oaks, South Middleton Township, Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
he:t'eby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
o~'any of them, and agree that this instrument, waiving the right
of li.en, shall be an independent covenant.

EXHIBIT "A"
ALL THAT CERTAIN piece of land situated in the Township of South
Middleton, County of Cumberland and Commonwealth of Pennsylvania,
more particularly bounded and described as follows:
BEGINNING at a point on the southern legal right of way line of
South Pin Oak Drive at the dividing line between Lots Nos. 11 and
10 as shown on the hereinafter mentioned plan of lots; thence along
said dividing line between Lots Nos. 11 and 10, South 3 degrees 15
minutes 37 seconds West, a distance of 150 feet to a point on the
dividing line between Lots Nos. 11 and 5 as shown on said plan of
lots; thence along the line dividing Lot No. 11 from Lots Nos. 5
and 6 as shown on said plan of lots, North 86 degrees 44 minutes 23
seconds West, a distance of 168.99 feet to a point on the eastern
legal right of way line of Orion Road; thence along said eastern
legal right of line of Orion Road, the following two (2) courses
and distances: (a) in a northerly direction on a curve to the right
having a radius of 320.77 feet, an arc distance of 83.03 feet to a
point, and (b) North 18 degrees 5 minutes 26 seconds East, a
distance of 56.01 feet to a point at the beginning of a Curved
corner at the intersection of Orion Road and South Pin Oak Drive;
thence along said curved corner on a curve to the right having a
radius of 20 feet, an arc distance of 28.07 feet to a point on the
southern legal right of way line of South Pin Oak Drive; thence in
an eastwardly direction along said southern legal right of way line
of South Pill Oak Drive, the fOllowing two (2) courses and
distances: (a) on a curve to the left having a radius of 250
feet, an arc distance of 22.85 feet to a point, and (b) South 86
degrees 44 minutes 23 seconds East, a distance of 100 feet to a
point on the same at the dividing line between Lots Nos. 11 and 10
as shown on the hereinafter mentioned Plan of Lots, the Place of
BEGINNING.
BEING Lot No. 11 as shown on a certain subdivision plan of lots
entitled "Final Plan of Phase Two for The Oaks" as recorded in the
Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Plan Book 60, Page 84.
BEING the same premises which James J. Collins and Pamela K.
Collins, husband and wife, granted and cOnveyed to Gilbert L.
Bishop and Linda M. BiShop, husband and wife, Borrowers herein.
