STIPULATION AGAINST LIENS
THIS AGREEMENT made this 12thday of March
and between Fred Tiday Builder, a sole proprietorship,
referred to as Contractor,
, 1998, by
hereinafter
AND
Henry W. Strong, II and Jan S, Nilsen-Strong, husband and wife,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in Hampden Township, Cumberland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof and known as
Lot #53 Pinehurst, Mechanicsburg, Pennsylvania 17055.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1,00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above nescribed, and the said Contractor, for itself, himself or
therr" ,ves, its, his or their subcontractors and others under them,
her~;,y expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

EXHIBIT "A"
ALL THAT CERTAIN tract of land situate in Hampden Township,
Cumberland County, Pennsylvania, being Lot No, 53 as shown on a
plan entitled Phase I Final Subdivision Plan of Pinehurst, dated
September 1988, recorded at Plan Book 57, Page 70, Cumberland
County Records, revised by a plan entitled Final ResbUdivision Plan
of Pinehurst - Phase I, dated April 1989, and recorded at Plan Book
58, Page 59, Cumberland County Records, more particularly bounded
and described as follows, to wit:
BEGINNING at a point on the Southerly sideline of Silver Pine
Circle, a fifty foot (50') public right of way at the dividing line
between Lot No, 52 and Lot NO, 53 as shown on said Plan; thence by
Lot No, 52 South twenty eight degrees thirty-four minutes twenty-
nine seconds East (S 280 34'29" E), a distance of two hundred
seventy-seven and sixty-three one hundredths feet (277,63') to a
point on the Westerly dedicated right of way line of Good Hope Road
(PA Route 1013); thence by said right of way line North twenty-two
degrees twenty-nine minutes nineteen seconds East (N 220 29' 19"
E), a distance of ninety-two and sixteen one hundredths feet
(92,16') to a point; thence by the same North thirty degrees
nineteen minutes nineteen seconds East (N 300 19' 19" E), a
distance of one hundred seventy-seven and eighty-seven one
hundredths feet (177,87') to a point; thence by Lot No, 54 as shown
on said plan North fifty-nine degrees forty minutes forty-one
seconds West (N 590 40' 41" W), a distance of two hundred feet
(200') to a point on the Easterly sideline of Silver Pine Circle;
thence by Silver Pine Circle South thirty degrees nineteen minutes
nineteen seconds West (S 300 19' 19" W), a distance of thirty-five
and thirty-four one hundredths feet (35,34') to a point; thence by
the same by the arc of a curve to the right having a radius of one
hundred seventy-five feet (175.00'), an arc length of ninety-five
feet (95,00') to a point, the place of BEGINNING,
Known and numbered as 1804 Silver Pine Circle,
BEING the same premises which pamay Development Co" Inc, granted
and conveyed to Henry W, Strong, II and Jan S, Nilsen-Strong,
husband and wife,
