The name of the person by whom this lienor was employed and to whum he
furnished such labor and materials is Senior Collages of America, LLC, by and through its
agents, COllages of Shippensburg Limited Partnership.
Lienor, a general contractor, on or about May 8, 1997 entered into an wrillen
agreement with Collages of Shippensburg Limited Partnership, who were acting as agents
for said Senior Collages of Shippensburg, Ltd., in which contract lienor agreed to furnish
all the labor and materials for the improvements of the aforesaid property located in the
Borough of Shippensburg, as more fully described on the allached Exhibit A, in
accordance with the wrillen agreement between lienor and COllages of Shippensburg
Limited Partnership.
In the perfonnance of said contract, lienor furnished all labor and materials
required to be furnished by him for that portion of the project for which payment is now
due under the tenns of the agreement between the parties.
All of the labor required to be perfonned by lienor under this portion of the
agreement has been perfonncd and all the materials thereby required to be furnished by
said lienor have been furnished.
The agreed price of the labor perfonned and materials furnished under the
agreement for this portion of the project is the sum of EIGHT HUNDRED THIRTY-
ONE THOUSAND FIVE HUNDRED THIRTY-SEVEN AND 73/100 DOLLARS
($831,537.73) for this portion of the project for which payment is now due.
The amount unpaid and owning to this lienor from the owner under the contract is
EIGHT HUNDRED THIRTY-ONE THOUSAND FIVE HUNDRED THIRTY -SEVEN
AND 73/100 DOLLARS ($831,537.73).-
The first item of work under the agreement was furnished on or about July IS,
1997. The first item of materials under the agreement was furnished on or about July IS,
1997. Work is continuing under the agreement and this lien is for partial perfonnance by
the lienor because offailure to pay by the owner.
