WAIVER OF MECHANICS LIEN
WHEREAS, orange street Limited Partnership, a Pennsylvania
limited partnership, of 152 South Second Street, Chambersburg,
PennsYlvania, entered into a contract with Waynesboro Construotion
Company of 215 West Fifth Street, Waynesboro, Pennsylvania, for
renovation and new construction to a two story dwelling situate
upon real estate owned by Orange Street Limited Partnership lying
and being situate at 7 East Orange Street, Shippensburg, Cumberland
County, Pennsylvania, as more fully described in deed from Dauphin
Deposit Bank and Trust Company dated 9/30/97, and recorded in
Cumberland County Deed Book Volume 165, Page 559.
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the said parties as part of the said contract and for the
consideration herein set forth that neither the undersigned
contractor, nor any sUb-contractor or materialmen, nor any other
person furnishing labor or materials to said contractor under this
contract shall file a lien, commonly called a mechanics' lien, for
work done or materials furnished to said bUilding or any part
thereof.
THIS STIPULATION IS MADE and intended to be filed with the
Prothonotary of the Court of Common Pleas of the 9th JUdicial
District, PennsYlvania, prior to the commencement of any work upon
the ground in accordance with the requirements of Act of Assembly
of Pennsylvania, in such case provided.
WITNESS the due execution of this stipulation the 3/~ day of
