Plaintiff was orally cngagcd to rcmove stumps from the property.

The stump removal was to be paid on thc basis of $1 05 per hour for a CAT 330
Excavator plus a moving fee of $310.

In accordance with said agreement, Plaintiffperfonned the following stump
removal work:
7/1196 Moving fee $ 310.00
7/2/96 8 hours 840.00
7/3/96 8 hours 840.00
7/5/96 8.5 hours 892.50
7/9/96 7.5 hours 787,50
TOTAL $3,670.00

After completion of the stump removal work, Defendants engaged Plaintiff to
excavate a hole and bury the stumps.
8.
The stump burial work was based upon a written agreement for $3,400 which was
accepted by Defendant Jon P. Wiesman on behalf of Defendants on July 11, 1996. A

copy of said agreement is attached hereto and incorporated herein by reference as though
fully set forth.
9.
After completion of the stump burial work, Defendants requested PlaintifTto
perform additional excavation work in a pasture.
10.
This additional work was based upon an oral agreement to be paid on the basis of
$84 per hour for a Komatsu 0-668 track loader plus a moving fee of$80.
II.
In accordance with said agreement, PlaintifTperformed the following additional
work:
8/2/96 Moving fee $ 80.00
8/2/96 8.5 hours 714.00
8/5/96 II hours 924.00
8/6/96 7.5 hours 630.00
8/7/96 6.5 hours 546,00
TOTAL $2,894.00
12.
Defendants understood the payment terms to be net sixty days with a finance
charge of 18% per year on the balance over sixty days.
