a. In or about November 1991, while the defendant was
standing against the front door of their residence holding a rifle, he
thrClatened to kill the plaintiff and their children screaming at dIem to
sit on the couch. Their oldest child was crying and saying "No,
daddy, no," The defendant then asked which one of thcm wantcd
to go first as he pointed the gun at the plaintiff. Their oldcst child,
agc 6, screamed, "D,ddy, shoot mc ftrst." When the plaintiff said
something to the defendant, he forcefully slapped her across the
face, When the defendant then poi.nted the rifle at his duoat, the
plaintiff wresded the gun away from him and pwnped the shellB out
ofit.
b. From approximately November 11}()7 through March 1998,
the defendant, on a regular basis, threatened the plaintiff In ways
including, but not limited, to saying, "011, what are my kids going to
do without a mother," threatening that somebody could come In and
"slash" her throat or shoot her; threatening that IlC' could be sleeping
while she was killed; tenlng her which one of his guns was loaded
and threatening that he never knew when he might have to 118C

Immediate and present danger of abuse from the defendant and that they are in need of protection
from such abuse,
7, The plaintiff desiles that the defendant be prohibited from having any direct or
Indirect contact with the plaintiff including, but II\Jt limite!! to, telephone and written
communications.
8, The plaintiff desires that the defendant be enjoined from harassing and stalking the
plaintiff; and from harassing the plaintiffs relatives, 01' the minor children,
9, The plaintiff desires that the defendant be restrained from entering her place of
employment or the schools and day care facility of the minor chlldren,

a. In or about Nowmber 1997, while lite defendant was
standing against the fronl door of their rctidence holding a rifle, he
threatened to kill the plaintiff and their children RCrt'.arning II them to
sit on the couch. nleil' oldest child was crying and saying "No,
daddy, no," The defendant then asked which one of thorn wante<l
to go first all he pointed Ihe gun at the plaintiff. Their oldest child,
age 6, llCrcamcd, "Daddy, shoot me first." When the plaintiff said
sornothing to the defendant, he forcefully lIlappcd her acrORB the
face. When the defendant then pointed tb-: rifle at his throat, the
plaintiff wrestled the gun away from him and pumped the shells out
of it.
b. From approximately November 1997 through March 1998,
the defendant, on a regular basis, threatened the plaintiff in ways
including, but not limited, to saying, "Oh, what arc my kids going to
do without a mother, " threatening that IlOmcbody could come in and
"slash" her throat or shoot her; threatening that he could be sleeping
while she was killodj telling her which one of his guns was loaded
and threatening that ho ncvcr mew when he might have to u&c

c. In or about October 1997, when the plainliffwent to care
for their youngest child, Cody, thc defendant foDowed her, cornered
her, and tcpeAtedly punched her in the head as mo tried to cover her
face for pl'Otcction. The defendant picked up a rail and hit the
plaintiff on thc head CAusing a laceration on her scalp which
required stitehos and then hit hor on the hand with the flll1 CAUSing
swelling. When the plaintiff wcot to another room to get ice for her
head, tho defendant followed her, Rcreamed at her, and while
holding an extension cord in his hand threatened to choke her.
d. Since approximately 1991, the defendant has on several
different occasions, abused the plaintift'in ways including: pushed
the plaintiff; grabbed her, threw different objects at her, threatened

to IdIl her, threatened to put a bullet in her head, screamed at thc
pIaintiffwith gun beside him causing her to fear for her safety, and
pushed the plaintiff; who was three months pregnan~ onto a bed
placing his foot 011 her stomach and threatening to kiD the baby.

residence at 2467 CannCly Road, Lot 4, Elliston, Virginla, in order to avoid further abuse.
