,COMPLAINT IN REPLEVIN
1st Federal Savings & Loan (hereinafter the "Bank"), by its attorneys,
Mette, Evans & Woodside, files the following Complaint,
1. Plaintiff, the Bank, maintains a business address at 135 East Liberty
Street, Wooster, Ohio, 44691, and does business within the Commonwealth of
Pennsylvania,
2, Defendant June A, Hyser, a/k/a June A Bigler, is an adult individual
now or formerly residing at Lot 108. Big Spring Terl'nce, Newville, Pennsylvania
17241.
3, On 01' about June 7, 1996, Defendant executed a Retail Installment
Contract and Security Agreement (hereinafter the "Contract") in favor of Bonnie
Heights Homes/Shrmnsdal, 5900 Spring Road, Shermunsdule, Pennsylvania 17090
in the original principal amount of $22,811 ,DO, plus interest and other charges as
provided therein, A true und correct copy of said Contract is attached hereto at
Exhibit "A" and its terms and conditions are incorporated herein by reference,
4. By its terms, the Contract provided for the simultaneous assignment
of the Contract to the Bank,
5. Under the terms of the Contract, the Bank maintains a security
interest in the subject 1995 Fleetwood Mobile Home, VIN PAFLR22A073360L (the
"Mobile Home"). Said security interest is duly noted on the Certificate of'l'itle
(hereinafter the "'I'itle") as required by law, A true and correct copy of said 'l'itle
is attached hereto at Exhibit "B" and incorporated herein by reference,
6, 'fhe Contract is now in default be,~ause Defendant has failed to make
timely monthly payments that are due and owing for the months of November,
1997 through March, 1998,
7. Such defaults are continuing,
8, The Bank believes and therefore avers that the Defendant has
possession of the Mobile Home,
9, 'l'he Bank sent Defendant a Notice of Default by letter dated
January 2, 1998, in accordance with 69 P.s. ~623(G), A true and correct copy of
the Notice of Default is attached hereto at Exhibit "C" and incorporated herein by
reference,
11, As of this date, Defendant has failed to cure the default or deliver
possession of the Mobile Home to the Bank,
12, The Bank is entitled to possession of the Mobile Home.
