6. Plainti.ff believes, and therefore avers, that the
amendment sought in this Motion does not prejudice the Defendants
in any manner,
WHEREFORE, Plaintiff, First Bank National Association,
respectfully requests that its Motion to Amend its Complaint in
Mortgage Foreclosure and Serve Pleadings upon the Defendants, Helen
E. Lutz, Known and Unknown Heirs by Special Order of Court be
granted and all pleadings in thirJ case be amended to reflect the
corrections noted, as set forth in this Motion, thereby correcting
the pleadings and proceedings from this date forward and directing
service of the Complaint in Mor tgage Foreclosure, Notice of
Sheriff's Sale and all subsequent pleadings upon the Defendants,
Helen E. Lutz, Her Known and Unknown Heirs, by regular mail and
cert.if ied mail and by pos t ing of the subj ect property at 20 Diane
Circle, within the Borough of Wormleysburg, Cumberland County,
pennsylvania, and publication of the filing of the Complaint in
Mortgage Foreclosure and the Notice of Sheriff's Sale in a
newspaper of general circulation once weekly for three (3)
consecutive weeks, and once in Cumberland Law Journal,

in relevant part that "It service of process by publication has
been authorized by rule of civil procedure or order of court, the
publication shall be by advertising a notice of the action once in
the legal PUblication, if any, designated by the court for the
publication of legal notices and in one newspaper of general
circulation within the county".
In the instant Motion, Plaintiff requests leave of Court to
amend its Complaint in Mortgage Foreclosure and serve pleadings
upon the Defendants, Helen E. Lutz, Known and Unknown Heirs by
Special Order of Court due to its inability to ident ify the
decedent's heirs and/or successors in interest to the subject
property Upon which this mortgage foreclosure action is predicated,

CIVIL ACTION "- COMPLAINT IN MORTGAGE FORECLOSURE
1. (a) The Plaintiff First Bank National Association TR
U/A dtd 12/1/96 (Home Equity Loan Trust 1996-4) is a corporation
having been organized under the laws of The United States of
America and having its principal place of business at 11.1 East
Wacker Drive, Suite 3000, Chicago, Illinois 60611,
(bl The subject loan is being serviced by Equicredit
Corporation of America, itself being a corporation organized under
the laws of the Commonwealth of Pennsylvania and having a principal
place of business at 10401 Deerwood Park Boulevard, Jacksonville,
Florida 32256.
2. (a) Defendant Saundra L. Mitchell is an individual
whose last known address is 415 Fairview Avenue, West Fairview, PA
17025.
(b) Defendant Saundra L. Mitchell holds an interest in
t.he subj ect property as a t.he Known Heir to Helen E. Lut z,
Deceased; Real Owner and Mortgagor.
(c) If any of t.he above named Defendants are deceased,
this action shall proceed against the deceased Defendant's heirs,
assigns, successors, administrators, personal representatives
and/or executors through their estate whether the estate is
probated.
3, (a) The residential mortgage being foreclosed upon is
secured by property located at 20 Diane Circle address within Camp
Hill, Cumberland County, Pennsylvania.
(b) All documents evidencing the residential mortgage
have been recorded in the Recorder of Deeds' Office in Cumberland
County, Pennsylvania,
(e) The Mortgage was executed on August 23, 1996 and was
recorded on August 28, 1996 in Mortgage Book 1338/ at Page 385,
(d) The legal description for this parcel is attached
and incorporated as Exhibit "A" (Mortgaged Premises) ,
(e) The herein named Plaintiff has standing to bring the
instant action by vIrtue of Assignment.s of Mortgage / duly and
publicly recorded as below:

(f) By virtue of pennsvlvania Rules of Civil Procedure
Rule 1147 (1) and 1019 (g) / and on the basis of environmental
responsibil ity / Plaint.iff is not obliged to append copies of the
above mentioned publicly recorded documents to this mortgage
foreclosure action. Thes€: documents are, however, appended hereto
and incorporated herein by reference as Exhibit "B".
4, The mortgage is in default because the Defendants above
named [ailed to timely tender the monthly payment of $674,10 on May
1, 1997, and thereafter failed to make the monthly payments,
5, As aut.horized under the mortgage instrument, the loan
obligation has been accelerated,
(b) If the mortgage arrears are to be reinstated or
paid-off prior to the Sheriff's Sale, Plaintiff's actual attorneys'
fees (calculated at counsel's hourly rate) will be charged based
upon work actually performed.
B. If any Defendant Mortgagor herein named is deceased, at
Plaint iff's opt ion, such deceased Mortgagor, and the executor,
administrator, heirs and devisee5 of any such deceased Mortgagor in
such capacities only, may be released from liability for the debt
secured by the Mortgage,
9. (a) The original principal balance of the Mortgage is
more than Fifty Thousand ($50,000,00) Dollars,
(b) Under Pennsylvania's ACT 6 of 1974, Plaintiff
Mortgagee is not obligated to serve Notice of its Intention to
Accelerate the mortgage obligation by certified and by regular
mailing, prior to initiating foreclosure proceedings.
10. (a) The subject mortgage is not governed by ACT 91 of
1983, in that the subject property is not the Defendant Mortgagor's
principal residence,
(b) Under ACT 91, notice is required only where the
property upon which the action is predicated is the Defendant
Mortgagor:' s m:.inciDal residence.

1. (a) The Plaintiff First Bank National Association TR
ViA dtd 12/1/96 (Home Equity l,oan Trust. 1996..4) is a corporation
having been organized under the laws of 'I'he Uni ted St.at.es of
America and having its principal place of business at 1.11 East
Wacker Drive, Suite 3000, Chicago, Illinois 60611.
(b) 1~e subject loan is being serviced by Equicredit
Corporation of America, itself being a corporation organized under
the laws of the Commonwealth of Pennsylvania and having a principal
place of business at 10401. Deerwood Park Boulevard, Jacksonville,
Florida 32256.

Defendant Saundra L. Mitchell is an individual
whose last known address is 415 Fairview Avenue, West Fairview, PA
17025.
(b) Defendant Saundra L. Mitchell holds an interest in
the subjectl?roperty as a the Known Heir to Heien E:. Lutz,
Deceased; Real Owner and Mortgagor.
(c) If any of the above named Defendants are deceased,
this action shall proceed against the deceased Defendant's heirs,
assigns, successors, administrators, personal representatives
and/or executors through their estate whether the estate is
probated,
3. (a) The residential mortgage being foreclosed upon is
secured by property located at. 20 Diane Circle address within Camp
Hill, Cumberland County, Pennsylvania.
(b) All documents evidencing the residential mOl'tgagE'
have been recorded in the Recorder of Deeds' Office in Cumberland
County, Pennsylvania,
(c) The Mortgage was executed on August 23, 19% and was
recorded on Augu.st 28, 1996 in Mortgage Book 1338, at Page 385,
ld) 1~e legal description for this parcel is attached
and incorporated as Exhibit "A" (Mortgaged Premises) .
(e) The herein named Plaintiff has standing to bring the
instant action by virtue of Assignments of Mortgage, duly and
publicly recorded as below:

Assignee: First Bank National Association TR V/A dtd
12/1/96 (Home Equit.y Loan Trust 1996-4)
Recording Date: April 7, 1997
(Assignment) Book: 544
At Page: 403
(f) By virtue of Pennsvlvania Rules of Civil Procedurt;l
RuJ,e 1147 (1) and 1019 (g), and on the basis of environmental
responsibility, Plaintiff is not obliged to append copies of the
above mentioned publicly recorded documents to this mortgage
foreclosure action, These documents are, however, appended hereto
and incorporated herein by reference as Exhibit "B".
4. The mortgage is in default because the Defendants above
named failed to timely tender the monthly payment of $674.10 on May
1, 1997, and thereafter failed to make the monthly payments.
5. As aut.horized under the mortgage inst.rument, the loan
obligation has been accelerated.
(b) If the mot'tgage arrears are to be reinstated or
paid-off prior to the She.rIff's Sale, Plaintiff's j;Jctual attorneys'
fees (calculated at counsel's hourly rate) will be charged based
upon work actually performed,
8. If any Defendant Mortgagor herein named is deceased, at
Plaintiff's option, Buch deceased Mortgagor, and the executor,
administra tor, heirs and devisees of any such deceased Mortgagor in
such capacities only, may be released from liability for the debt
secured by the Mortgage,
9. (a) The original principal balance of the Mortgage is
more than Fifty Thousand ($50,000.00) Dollars.
(b) Under Pennsylvania's ACT 6 of 1974, Plaintiff
Mortgagee is not obligated to serve Notice of its Intention to
Accelerate the mortgage obligation by certified and by regular
mailing, prior to initiating foreclosure proceedings.
10. (a) The subject mortgage is not governed by ACT' 91 of
1983, in that the subject property is llQt the Defendant Mortgagor's
principal residence,
(b) Under ACT 91, notice is required only where the
propex'ty upon which the action is predicated is the DElfendant
