9. Defendants also agreed under the terms of the Mortgage
that in the event of default thereunder they would pay, in addition
to the charges listed in paragraph 8 above, costs incurred by Bank
as a result of the institution of these legal proceedings.
10. The obligation owed by Defendants to Bank continues to
accrue interest thereon at the rate of eight and 37/100 Dollars
($8,37) per day, through the date of payment, including on and
after the entry of judgment on this Complaint, and continues to
accrue late charges, and attorneys' fees.
11. In accordance with the Homeowners' Emergency Mortgage
Assistance Act, Act of December 23, 1983, P,L. 385 No. 91, 35 P.S,
Section 1680.401c et ~, a Notice of Intent to Foreclose and of
Defendants' rights under said Act was forwarded to Defendants on
February 24, 1997 by certified mail, return receipt requested,
addressed to Defendant. A copy of said Notice is attached hereto
and marked Exhibit "D". Bank believes, and therefore avers, that
Defendants have not applied for assistance under the Act,
12. Pursuant to the Act of January 30, 1974, P.L. 13, No.6,
41 P.S. section 101 ill;,~, and in particular section 403 thereof,
Bank gave written notice to Defendants of its intent to foreclose
by a letter dated February 24, 1997, addressed to Defendants,
certified mail, return receipt requested, A copy of said Notice is
attached hereto and marked as Exhibit "E".

COMPLAINT
AND NOW, comes Plaintiff, PNC Bank, National Association, by
its attorneys, Saidis, Guido, Shuff and Masland, and files this
Complaint, alleging in support thereof the following:
1. Plaintiff, PNC Bank, National Association, is a national
banking association organized and existing under the banking laws
of the United States of America with a principal regional office
located at 2730 Liberty Avenue, Second Floor, PittSburgh,
Pennsylvania 15222,
2. The Defendants, William R. Taylor, Jr. and Deborah C.
Taylor, his wife, are adult individuals whose last known address is
5683 Creekview Road, Mechanicsburg, Pennsylvania 17055.
3. On or about May 31, 1985, Defendants obtained from Bank an
Ultimate ~oan line of credit in the sum of Thirty-two Thousand and
00/100 Dollars ($32,000.00) ("Loan"). As security for the l,oan,
Defendants executed and delivered to Bank a mortgage ("Mortgage")
on that tract of land together with the bUildings and improvements
erected thereon located in Hampden Township, Cumberland County,

9. Defendants also agreed under the terms of the Mortgage
that in the event of default t.hereunder they would pay, in addition
to the charges listed in paragraph 8 above, costs incurred by Bank
as a result of the institution of these legal proceedings.
10. The obligation owed by Defendants to Bank continues to
accrue interest thereon at the rate of eight and 37/100 Dollars
($8.37) per day, through the date of payment, including on and
after the entry of judgment on this Complaint, and continues to
accrue late charges, and attorneys' fees,
11, In accordance with the Homeowners' Emergency Mortgage
Assistance Act, Act of December 23, 1983, P.L. 385 No, 91, 35 P.S.
Section 1680,401c ~t ge~, a Notice of Intent to Foreclose and of
Defendants' rights under said Act was forwarded to Defendants on
February 24, 1997 by certified mail, ret.urn receipt requested,
addressed to Defendant. A copy of said Notice is attached hereto
and marked Exhibit "D". Bank believes, and therefore avers, that
Defendants have not applied for assistance under the Act.
12. Pursuant to the Act of January 3D, 1974, P.L, 13, No.6,
41 P.S. section 101 et ~, and in particular section 403 thereof,
Bank gave written notice to Defendants of its intent to foreclose
by a letter dated February 24, 1997, addressed to Defendants,
certified mail, return receipt requested. A copy of said Notice is
attached hereto and marked as Exhibit "E".

March 31, 1999 at 12:42 o'clock P.M. EST, he posted a copy of Real Estate Writ Notice
Poster and Description, in the above entitled action upon property of William H. Taylor,
Jr. located at 5683 Creek view Road, Meehanicsburg, Cumberland County, Pennsylvania
according to law.
Michael E. Barrick, Deputy Sheriff, who bdng duly sworn according to law, says on
February 16, 1999 at 7:30 o'clock P.M. EST, he served a true copy of Real Estate Writ
Notice and Description in the above entitled action upon one of the within named
defendants to wit: William H. Taylor, Jr. by handing to William H, Taylor, Jr. at 5683
Creekview Road, Mechanicsburg, Cumberland County, Pennsylvania, its contents and at
the same time handing to him pcrsonally the said true and attested copies of the same.
Steve Whistlcr, Deputy Sheriff who being duly sworn a.,cording to law, says on April
9, 199 at 7:40 o'clock P.M. EST, he served a copy of Real Estate Poster, in the above
entitled action upon one ofthe within named defendants to wit: William H. Taylor, Jr. by
making known unto William Taylor, Jr. at 5683 Creekview Road, Mechanicsburg,
Cumberland County, Pennsylvania, its contents and at the same time handing to him
personally the said true and attested copies of the same.
R. Thomas Kline, Sheriff, who being duly sworn according to law, says he served the
above Real Estate Writ Notice Poster and Description in the following manner: The
Sheriff mailed a notice of the pendency of the action by regular mail to one of the within
named defendants to wit: William H. Taylor, Jr. to his last known address 5683
Creekview Road, Mechanicsburg, Pennsylvania. This leiteI' was mailed under the date of
April 13, 1999 and never retu\'lled to the Sheriffs Office.
R. Thomas Kline, Sheliff, who being duly sworn according to law says he made
diligent search and inquiry for one of the within named defendants to wit: Deborah
Taylor, but was unable to locate her in his bailiwick .He therefore returns the above Real
Estate Writ Notice and Poster and Description Not Found as to the defendant Deborah C.
Taylor. Defendant is deceased.
R. Thomas Kline, Sheriff, who being duly sworn according to law, says that after due and
legal notice had been give according to law, exposed the within described premises at
public venue or out cry at Court House, Carlisle, Cumberland County, Pennsylvania on
June 9,1999 at 10:00 o'clock A.M.EDST and sold the same for the sum of$ 41,300.00 to
Richard M. Hebbard, his successors and assigns of 5685 Creekview Road,
Mechanicbsurg, Pennsylvania. Mr. Richard Hebbard being the buyer in this execution
paid the required 10% down payment on said writ on June 9, I 999,but decided he did not
want the property on June II, 1999 and so advised the Sheriff of his decision. The sale
therefore was rescheduled for the date of July 7, 1999 being the date advertised on the
Real Estate Poster.
