Whereas, the parties hereto hllve each had the benefit of competent IInd independent

Now Thet'efore, the parties hereto, intending to be legally bound, do covenant and
agree as follows:
Separation
It shall be lawful for each party at all times hereafter to live separate and apart from the other
party at such place as he or she may from time to time choose or deem fit. The foregoing provisions
shall not be taken as an admission on the part of either party of the lllwfulness or unlawfulness of
the causes leading to their living apart.
Interference
Each party shall be free from interference, authority and contact by the other as fully as ifhe
or she were single and unmarried, except as may be necessary to carry out the provisions of this
agreement. Neither party shall molest the other or attempt to endeavor to molest the other. nor
compel the other to cohabit with the other or in any way harass or malign the other, nor in any way
interfere with the peaceful existence, separate and ap1ll1 from the other, and each of the parties hereto
completely understand and agree that neither shall do or say anything to the children of the parties
at any time which might in any way influence the children adversely against the other party.

against the olher, except any or all cause or causes of net ion for divorce and except any or all causes
of action for breach of any provisions of this agreement.
Real Property
The parties do not own any real property.
Personal Property
The 1986 Ford Bronco shall be the property of Wife. All personal property which is in now
of possession of Wife shall be property of Wife, except those items specifically referred to in this
agreement as property of Husband.
The following items shall be property of Husband: 12 gauge Winchester pump shotgun with
36" vented rib barrel; 20 gauge Winchester pump shotgun with 36" vented rib barrel; 30.06 bolt
action Winchester rifle with 2/x5 scope and sling; 3D/3D lever action Model 94 rille; 10/22 Ruger
semi automatic rille; 22 LR hex barrel pump rille; all rilles in 4 case; and all personal papers,
including prior tax papers, and similar documents. All otheritems of personal property which is now
in the possession of Husband shall bc the property of Husband.

month for the second year following divorce, and OIW 11\lI1dred ($100.00) Dollars per month for lhe
third year jllllowing divorce. After which time, Ilusband shall have no further obligation to pay
alimony to Wife. Alimony shall terminate upon the death or remarriage of Wife.
Husband shall pay counsel fees and expenses for Wife in lhe anK.llnt of Five Hundred
($500.00) Dollars.
Husband hereby waives any claim he may have against Wife l'or spousal support, tempornry
alimony, alimony pendente lite, counsel fees and expenses.
Dependent for Income Tax Purposes
Husband shall have the right to take the child, Jordyn Taylor Cucinotta, as a depe.ndent for
income taxes for 1998. Thereafter, the right of the party to take the child as a dependent will be in
accordance with regulations under the Internal Revenue Code.
Pension
Wife hereby waives any claim she may have against Husband's pension plan, 401 K plan or
any other similar benefit.
Husband hereby waives any claim he may have against Wife's pension plan, 401 K plan or
any other similar benefit.
Legal Representation
The parties acknowledge that they have been advised that there may be certain tax
consequences pertaining to this agreement, that neither attorney has furnished advice with respect

into any Decree of Final Divorce and shall survive any Decree of Final Divorce and be enfon:eahle
through all powers of a court of r-ompetent jurisdiction,
It is specifically acknowledged and agreed by both parties that this Agreement is entered into
in contemplt\tion of the divorce action instituted by Husband in the Cumbe,r1and County Court of
Common Pleas.
The parties acknowledge that they have been advised that each may claim in the said divorce
action rights available to them under the divorce code, including support, alimony, equitable
d.istribution of property, counsel fees, division of life insurance policies and the right to live in the
family residence.
The parties acknowledge and agree that the terms and provisions of this Agreement shall be
in lieu of any and all claims which might properly be made in said divorce action, or in any divorce
action subsequently instituted by either party, and the rights under said Code not provided for herein
are hereby waived.
As soon as practicable after the execution of this Agreement, both parties shall execute and
cause to be filed in the Cumberland County Court of Common Pleas, Affidavits of Consent in the
divorce action liIed by Husband. Husband shall take those actions necessary to obtain a divorce in
said action upon the ground of an irretrievable breakdown of the marriage with the consent of both
parties under Section 3301 (c) of the Divorce Code. The Husband shall proceed with the conclusion
of said divorce proceedings as soon as practicable after the execution of this Agreement, and shall
provide Wife with a certified copy of such Decree of Divorce upon his receipt thereof.
