AND NOW, oome Plaintiffs by thej,r undersigned oounsel and
respectfully bring this Complaint setting forth in support thereof
as follows:
1. Plaintiffs herein are Leland I. Gillette and Judith C.
Gillette, adult individuals residing at 253 W. Pomfret st.,
Carlisle, Cumberland County, Pennsylvania, 17013.
2. Defendant herein is Rosemary Fl iOkinger, is an adult
individual residing at 146 Main street, Arendtsv.i1le, PennSYlvania,
17303.
3. As pertinent herein, Plaintiffs operated a Val-'I?ak,
Ino., sublioense in the Cumberland, Franklin, and Adams County
areas.
4. Defendant is in the bus.iness of carpet, cleaning and
operates under the name of Flickinger's Cleaning Service.
5. On or about December 2, 1994, and subsequent times
th~reto, Pla.intiffs and Defendant entered into contraots for
Plaintiff to provide Defendant with certain .in--home mailer
advertising services through Val-Pak, Inc., pursuant to written
agreement. A copy of this agreement is attaohed as Exhibit "A" and
inoorporated by reference herein.
6. On or about F'ebruary 13 and May 7, 1997, Defendant
placed an order with Plaintiffs for an advertisement in the
Upcoming Val-Pak mailers. A copy of the advertising mailer card is
attached hereto as Exhibit "B" and incoroporated by reference
herein. This advertising card was approved by Defendant.
7. Pursuant to the terms of the agreement, Plaintiffs were
to place this with Val-Pak, Inc., of Florida for distribution to
various zip oode zones in the south-central Pennsylvania area.
8. Plaintiffs complied with the terms of the agreement, and
tbe advertising copy was mailed in due course.
9. Pursuant to the t.errlls of the agreement, Defendant was to
pay $3200.00 for the services.
10. Upon demand made, Defendant has failed to pay for the
services.
11. Pursuant to the terms of the agreement, Defendant is
li.able for interest and costs of collection as follows:
a. interest on any balance remaining past thirty (30)
days at the rate of one and one-half percent (1 1/2%) per
month, or an annual rate of eighteen peroent (18%)/
b. an additional sum equal to 3:1% of the remaining
balance for costs of collection.

attached hereto as Defendant's Exhibit "C" and Incorporated herein by reference,

further affirmative defenses as may become available and apply during discovery

3. Plaintiff is liable to defendant for reasonable attorney's fees pursuant to 42 Pa C.S,A,
sec. 2503, since said action was brought by Plaintiffs in bad faith since they were well
aware of the fact that Defendant had paid Val-Pac, Inc. in full prior to the commencement of
this action.
WHEREFORE, the defendant demands that Judgement be entered In her favor and
against the plaintiff on defendant's complaint for reasonable attorney's fees, with court
costs and fees.

satisfies all monies owed Mr, Gillette for the February and May 1997 mailers.
You had a balance of $1 ,624,00 for the February mailer and an $800,00 balance for the
May mailer which equals $2,424.00. Your payments of $500,00, checl< #2297, and
$25.00, check #2434, left a balance of $1,899,00, The payment we received today of
$1,89900, check #2532, leaves a $0 balance for these two mailers.
You received a letter from me as well as our home office indicating that Mr. Gillette no
longer represents Val-Pak Any monies owed Mr. Gillette in his Val-pak sub-franchise
is due to Val-pak of Maryland, the owner of the franchise of South Central
Pennsylvania,
