9, In accordanct' with the contract, Wlntermyer. fnc, perlilrmed all work and
supplied all material and equipment necessary for the construction of the contracted
Improvements expect for the construction of the wearing course to the streets.
10. McCown has not disputed Wintermyer Inc. '8 performance of the conditions to
the contract and the completion of the Improvements.
II. All work done to date has been inspected by Hampden Township.
12. Wintennyer's work under the contract was substantially completed on or about
May IS. 1997. The only remaining work that needs to be completed is the paving of the
wearing course which has not yet been requested by McCown, In lIccordance with standard
practice, the wearing course is not laid until most lots are sold from the subdivision.
13. On the total contrllct price of $76,542.00, McCown has paid, or has caused to
be paid. the sum of $3,601.77.
14. The principal balance due and owing on the contract is $72,940.23.
15, Under the contract, interest on the principal balance aeerues at the rate of one
and one-half (1 1/2 %) percent per month, There is presently accrued interest on the
principal amount, caleulated from May 30. 1997 through February 28. 1998, of $9.846.92,
14, Wintermyer, Inc, has repeatedly demanded payment of the amount due, but
McCown has wholly neglected and refused to pay same.
WHEREFORE, Plaintiff. Leon E, Wintermyer. Ine, demands judgment against the
Defendants. Charles McCown and Patricia A. McCown, jointly, severally and individually.
for the sum of $82.787.18 in principal and Interest through February 28. 1998, plus Interest

thereon calculated from March 1. 1998 at the ratc of onc and onc-half (I 1/2%) percent pcr

All engineering, project stakeout, permits, tests, inspections and tapping fees

on the date of the proposal and will romiOin firm up to and including June 1,
1996. After June 1, 1996, we reserve the right to increase our price(s) at such
time as the actual costs of material(s) increase(s),
If bonds are required there will be an additional charge of three percent to t.he
contract amount,
Upon accept.ance, pleaee forward applicable finanCing information to our office,
which can include verification of the funding source or the established line of

If unstable conditions are encountered at any subgrade elevation, there will be
an additional charge to undercut these areas and replace them with suitable

If water for compaction purposes is not available on site or permitted to be
used from that source, importing of water from an off-site source will be an
additional charge to the contract,
This is a unit price contract, all billings and payments will be based on actual
quantities as measured and installed in the field.
If wearing course placement is delayed by more than two weeke after the base or
binder course placement then cleaning, tack coat, repair or leveling of the base
