1. NATIONSCREDI1' HOME EQutTY SERVICF~S is a corporation with offioes in Irving,
TX 75062 and is hereinafter referred to as "Plaintiff".
2. Defendants are adult individuals who reside at 227 South Pitt Street Carlisle,
CUmberland County, PA 1 70l.3 .
3. On or about the 17th day of July, 1996, Defendants executed and delivered to
Plaintiff a Mortgage on certain real property omled by Defendants. Said Mortgage was
reoorded in the Office of the CUMBERLAND County Recorder of Deeds in Mortgage Book
Volume 1332, Page 237. A copy of said Mortgage is attached hereto, marked Exhibit "1"
and made a part hereof.
4, Of even date with said Mortgage, Defendants executed and delivered to
Plaintiff a Note, a copy of which is attached hereto, marked Exhibit "2" and made a part
hereof.
5. The aforementioned Mortgage and Note were assigned to the Plaintiff herein by
Assignment of Mortgage which was recorded in the Office of the Cumberland Coullty
ReoDrder of Deeds Oll JUlie 24, 1997 in Mortgage Book Volume 550, page 841. A copy of the
Assignment is attached hereto, marked Exhibit "3", and made a part hereof.

6. By t.he t.erms ann oonditions of the aforement.ioned Mortgage and Not",
Defendants agreed to repay (!ert.ain sums to Plaintiff and, in so doing, to maks certain
monthly payments to Plaintiff as is more specifioally shown by said Mortaage and Note.
7. Plaintiff avers that Defendants are in default of the terms and conditions of
the aforementioned Mortgage and Note by having not made payments as agreed, thereby
rendering the entire balance immediately due and payable.
8. On or about May 23. 1997 and June 23, 1997, NotIces were sent to Defendants
in aoaordance with Aot No.6 of 1974, Section 403, and Act 91 that an action on said
Mortgage may be commenced after 31 days from the date of said Notioe. Said Notices
further advised Defendant of Defendants' rights and obligiltions in ilccordanae with add
Acts. A oopy of said Notices is attached hereto, marked Exhibit "4", cOlleotively, and
made a part hereof.
9. Plaintiff avers that the outstanding principal balanoe due as of May 1, 1997
is $72, SSG. 52 .
10. Plaintiff is entitled to interest at an adjustable rate. ~he rate ourrently
in effect is 10.95 percent per annum. Interest due throllgh and inoluding February 28,
1998 amounts to $0,748.80,

11. Plaintiff is entitled to late charges af $35.10 per month for a total of
$i51.00 as of February 28, 1998.
12. By tile terms of the aforementioned mortgage, Defenda.nts have agreed to pay
Plaintiff's reasonable attorneys' fees, which PlaJ.ntiff avers will amount to $3,700.00.
13. Although repeatedly requested to do so by Plaintiff. Defendants willfully
failed and refused to pay the aforesaid balance, interest, late charges, attorney fees
or any part ~hereof to Plaintiff.
WHEREFORE, Plaintiff demands jUdgment in mortgage foreclosure against Defendants,
Jointly and severally, in the amount of $83,356.32 wi ~h ContinUing interest and late
charges at the COntract rate plus costs.
