Windy Hill, Lot 162, ShcrmansdaJe, Pennsylvania, 17090, and is the husband of Darlene
Dorman,

of ability to perform work in and around her house, all of which are or may be penllanent.

with negligence, carelessness and recklessness by:
a, failing to render proper and reasonable eare for Mso Donnan' s right hand
including failure to operate on her right hand in a proper and skillflll,
manner;
b. failing to exercise reasonable sldlllll\d care in the carpel tunnel operation
upon Ms. Dorman's right hand.
c. Failing to detect and treat the palmar cutaneou~ branc,h of the median
nerve which Dro Hamsher severed during the carpal tunnel oll~ration,

MOTION TO AMEND COMPLAINT
NOW COME Plaintins in the above-captioned maller, Darlene Dorman and Erie
Dorman, by and through undersigned counsel, and move for leuve of Court to file a Second
Amended Complaint and in support there,)f aver as follows:
I. This is a medical malpractice and negligence action,
2, Defendant Hamsher evaluated plaintiff Darlene Dorman on Oclober 9, 1996 and
recommended carpal tunnel surgery on Ms, Donnan's right hand, Ms, Dorman underwent carpal
tunnel surgery, performed by defendant Hamsher, on October 24, 1996,
3, Neither defendant HlIl1lsher, nor lInyone on his staff explained to Ms. Dorman that
there Wns any risk that the pnlmnr cutllneous bmnch of Ms, Dorman's hand could be iq;ured
during cnrpal tunnel release surgery, In uddition, no one explained to Ms, Dorman that she had
reasonable alternatives to carpal tunnel release surgery,

5, On August Ill, 1996, and sevcrnllimcs al\crward, Ms, Dorman consulted Ik Rolle
and complained of a progressively worsening (:ondition of her right huad,
6, Dr, Rolle flailed to delect und propcrly treal the severcd pnlmllr cutaneous branch of
Ms. Dorman's median nerve,
7. On information und belief; Dr, Rolle is an appropriate dcfcndant to this action,
8, Pursuant to Pn,R.Civ,P, 1033, plnintiffs respectfully move for leave to me the
Second Amended Complaint attached hereto as Exhibit I,
9. Other than the: addition of a countugainst de/cndant Hamsher for failure to obtain
informed consent and the addition of Dr. Rolle us a defendant, the Second Amended COIl1plnint
is virtually identical to the First Amended Complaint.
10. As of the time of filing this motion, the Statute of Limitations has not rtInas to
either Dr. Hamsher or Dr, Rolle,
WHEREFORE, plaintiffs respectfully request that the Court grant leave to file the
attached Second Amended Complaint.

carpal tunnel release surgery, including, but not limited to, the risk of severing Ms, Dorman's
palmar cutaneous branch of her median nerve, Dr. Hamsher wronglLilly touched Darlene Dorman
and went beyond the scope of his authority and Darlene Dorman's consent, creating injuries,
conditions and disabilities Darlene Dorman did not previously have, including all the
aforementioned damages,
