OOUNT I - REPLEVIN
1. Tho Plaintiff is PNC Bank, National ASRociation,
organized under the laws of the United states of Amedca with its
registered office at Western Loan Center, 2730 Liberty Avenue
Pittsburgh, PA 15222.
2. Defendants RAYMOND E. & VIRGINIA F. MATEER are
individuals residing at RRl, BOX 657B, LANDISaURG, PA 17040.
3. The transactions and occurrences out of which this oause
of action arose took place in Cumberland County, Pennsylvania.
4. On or about February 21, 1989, Defendants entered into a
Pennsylvania Mobile Helme Installment Sale Contract with CI\I'lisle
Mobile Homes, Inc. for a 1989 DeRose 76 x 14 mobile home with
hitch, Serial No. 01229918. A true and correct oopy of the
Installment Sale Contract is attached as Exhibit "Ah.
5. The oontract was assigned to First Eastern Bank, N.A. by
the terms and conditions of the assignment contained in the
contract. PNC Bank, N. A. is the sucoessor in interest to F.t rst
Eastern Bank, N.A.
6. By the terms of the contract, Plaintiff maintained a
security interest j,n the subject mobile home.
7. Plaintiff's security interest is evidenced by the
Commonwealth of Pennsylvania Certificate of Title for a Vehicle for
the mobile home, a copy of which is attached as Exhiblt. "B".
8. Defendants have defaul tad under the terms of the contract
by failing to make monthly payments when due as follows: Defendants
have failed to pay the October 25, 1997 payment of $267.60, and all
subsequent payments for a total delinquency of $1,605.60 and II

payoff of $14,838.47 as of Maroh 5, 1998.
9. The mobile home is currently looated at Defendants'
residenoe RR1, BOX 657B, LANDISBURG, PA 17040 and has an
approximate fair market value of $7.0,820.00.
10. Plaintiff believes and therefore avers, that Defendants
have possession of the subject mobile home.
11. Plaintiff believes that, unless prevented from doing so,
Defendants may damage and/or will remove the mobile home from the
county, and that Plaintiff's interest in the mobile home will be
adversely affected.
12. Plaintiff believes that an action for money damages may
be inadequate beoause Defendants may flee the jurisdiotion or may
not otherwise be able to pay money damages.
13. Defendants have failed and refused, despite repeated
demands by Plaintiff, to pay the balanoe due under the contraot or
deliver possession of the vehicle to Plaintiff.
WHEREFORE, Plaintiff demands judgment of possession together
with reasonable attorney's fees, interest and costs.

Plaintiff, PNC Bank, National ASSociation, by its attorneys,
Philips, Curtin & DiGiacomo EsqUires, hereby moves the Court for an
Order for Issuance of a Writ of Seizure in the above action, and
avers as follow!I in support thereof:
1. The allegations of the Complaint ill Replevin, a copy
of which is attached hereto and marked Exhibit "A", are
incorporated herein by reference as though fully set forth.
WHEREFORE, Plaintiff requests that the Court issue a Writ
of Seizure, and ent.er the attached RUle setting a hearing date on

1. The Plaintiff is PNC Bank, National Assooiation,
organized under the laws of the United States of America with its
registered office at Western Loan Center, 2730 Liberty Avenue
Pittsburgh, PA 15222.
2. Defendants RAYMOND E. & VIRGINIA F. MATEER are
individuals residing at RR1, BOX 657B, LANDISBURG, PA 17040.
3. The transactions and occurrences out of which this cause
of action arose took place in Cumberland County, Pennsylvania.
4. On or about February 21, 1989, Defendants entered into a
Pennsylvania Mobile Horne Installment Sale Contract with Carlisle
Mobile Homes, Inc. for a 1989 DeRose 76 x 14 mobile home with
hitch, Serial No. 01229918. A true and correct copy of the
Installment Sale Contract is attached as Exhibit "A".
5. The contract was assigned to First Eastern Bank, N.A. by
the terms and conditions of the assignment contained in the
contract. PNC Bank, N.A. is the successor in interest to First
Eastern Bank, N.A.
6. By the terms of the contract, Plaintiff maintained a
security interest in the subject mobile home.
7. Plaintiff's security interest is evidenced by the
Commonwealth of Pennsylvania Certificate of Title for a Vehicle for
the mobile horne, a copy of which is attached as Exhibit "B".
B. Defendants have defaulted under the terms of the contract
by failing to make monthly payments when due as follows: Defendants
have failed to pay the October 25, 1997 payment of $267.60, and all
subsequent payments for a total delinquency of $1,605.60 and a
payoff of $14,838.47 as of March 5, 199B.
9. The mobile home is currently located at Defendants'
residence RR1, BOX 657B, LANDISBURG, PA 17040 and has an
approximate fair market value of $20,820.00.
10. Plaintiff believes and therefore avers, that Defendants
have possession of the SUbject mobile home.
11. Plaintiff believes that, unless prevented from doing so,
Defendants may damage and/or will remove the mobile home from the
county, and that Plaintiff's interfi\st in the mobile home will be
adversely affected.
12. Plaintiff believes that an action for money damages may
be inadequate because Defendants may flee the jurisdiction or may
not otherwise be able to pay money damages.
13. Defendants have failed and refused, despite repeated
demands by Plaintiff, to pay the balance due under the contract or
deliver possession of the vehicle to Plaintiff.
WHEREFORE, Plaintiff demands judgment of possession together
with reasonable attorney's fees, interest and costs.

1. The Plaintiff is PNC Bank, National Association,
organ~zed under the laws of the United states of America with its
registered office at Western Loan Center, 2730 I,iberty Avenue
Pittsburgh, PA 15222.
2. Defendants RAYMOND E. " VIRGINIA F. MATEER are
individuals residing at RR1, BOX 657B, LANDISBURG, PA 17040.
:;. The transactions and occurrences out of which this oause
of action arose took place in Cumberland County, Pennsylvania.
4. On or about February 21, 1989, Defendants entered into a
Pennsylvania Mobile Horne Installment Sale Contract with carlisle
Mobile Homes, Inc. for a 1989 DeRose 76 x 14 mobile home with
hitch, Serial No. D122991R. A true and correct copy of the
Installment Sale Contract is attached as Exhibit "A".
5. The contract was assigned to First Eastern Bank, N.A. by
the terms and conditions of the assignment contained in the
contraot. PNC Bank, N.A. is the successor in interest to First
Eastern Bank, N.A.
6. By the terms of the contract, Plaintiff maintained a
security interest in the subject mobile home.
7. Plaintiff's security interest is evidenoed by the
Commonwealth of Pennsylvania Certificate of Title for a Vehicle for
the mobile home, a copy of which is attached as Exhibit "B".
8. Defendants have defaulted under the terms of the contraot
by failing to make monthly payments when due as follows: Defendants
have failed to pay the October 25, 1997 payment of $267.60, and all
subsequent payments for a total delinquency of $1,605.60 and a
payoff of $14,838.41 a9 of Maroh 5, 1998.
9. '1'he mobile homo js cUI:rently located at Defendants'
l'esidence fln1, BOX 65'IB, I.IINDIS/lURG, I'll 17040 and has an
approximate fair market value of $20,820.00.
10. Plaintiff believes and therefore avers, that Defendants
have possession of the subject mobile home.
Defendants may damage and/or will remove the mobile home from the

12. Plaintiff believes that an action for money damages may
be inadequate because Defendants may flee the jurisdicti.on or may

deliver possession of the vehiole to Plainti.ff.

1. The Plaintiff is PNC Bank, National Association,
organized under the laws of the United States of America with its
registered office at Western Loan Center, 27)0 Liberty Avenue
PittSburgh, PA 15222.
2. Defendants RAYMOND E. & VIRGINIA F. MATEER are
individuals residing at R1U, BOX 657D, LANDISBURG, PA 17040.
3. The transactions and occurrences out of which this cause
of action arose took place in Cumberland County, Pennsylvania.
4. On or about February 21, 1989, Defendants entered into a
Pennsylvania Mobile Home Installment Sale Contract with CarliSle
Mobile Homes, Inc. for a 1989 DeRose 76 X 14 mobile home with
hitoh, Serial No. D1229918. A true and correct copy of the
Installment Sale Contract is attached as Exhibit "A".
5. The contract was assigned to First Eastern Bank, N.A. by
the terns and conditions of the assignment contained in the
oontract. PNC Bank, N.A. is the successor in interest to First
Eastern Bank, N.A.
6. By the t.erms of the contract, Plaintiff maintained a
security int.erest in t.he subject mobile home.
7. Plaintiff's security interest is evidenced by the
Commonwealth of Pennsylvania Cert.ificate of Title for a Vehicle for
the mobile home, a copy of which is attached as Exhibit "B".
8. Defendants have defaul ted under the terns of the contraot
by failing to make monthly payments when due as follows: Defendants
have failed to pay the October 25, 1997 payment of $267.60, and all
subsequent payments for a total del inqueflcy of $1,605.60 and a
payoff of $14,838.47 as of March 5, 1998.
9. 1'ho mobile homo is currontly locatod at Defendants'
residence RR1, BOX 6~;"Il, LANDISIlIJRG, PA 17040 and has an
approximate fair market valuo of $20,820.00.
10. Plaintiff believes and therefore avers, that Defendants
have possession of the subject mobile home.
11. Plaintiff believes that, unlesB prevented from doing so,
Defendants may damage and/or will remove the mobile home from the

of action arose took place in Cumberland County, Pennsylvania.
