hereinafter referred to as Contractor,

Partners" A.sociates, hereinafter referred to as Owners, whereby
the oontraotor. undertook and agreed to erected and construct a
dwelling oh' t,he certain lot of ground situate in South Middleton
TownehiPI,ICUmberland County, Commonwealth of Pennsylvania, and more
fully described in Exhibit "A" which is attached hereto and made a
part hereof known as Lot *1 Tyler Court, South Middleton Township,
Cumberland County, PA.

NOW THBREFbRB, 'tHIS AGREEMENT WITNESSETH, That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof i,8 hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractoro, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or or.
account of any work done or materials furnished by them or any of
them under, said oontract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant. -

ALL THAT CERTAIN +tract of real property situat.e in South Middleton
Township, Cumberland Count.y, Pennsylvania, described as IJot No, 1
on a Final Subdivision Plan for McCoy Business Center, as prep1ued
by Sta\:ler and Lahr, Engineering and Planning Consul tants, dat.ed
January 8, 1988, and recorded in t.he Cumberland County Recorder of
Deeds n Plan Book 55, Page 131, to wit:
BEGINNING at a point on the Northern right of way line of Alexander
Spring Road, T-469, at a point on t.he boundary line between Lot No,
1 of the aforementioned Plan and lands now or formerly of Ruth S.
Royer; thence along said Northern right of way line of Alexander
Spring Road the following two courses and distances: (1) along a
curve to the left having a radius of 661.58 feet, an arc length of
97.22 feet, a chord bearing of South 67 degrees 11 minutes 42
seconds West and a chord distance of 97,13 feet; (2) South 62
degrees 59 minutes 07 seconds West, 117,91 feet to a point on said
Northern right of way line of Alexander Spring Road; thence along
said Northern right of way line of Alexander Springs Road and
leaving the same along a curve to the right having a radius of
25.00 feet, an arc length of 39,27 feet, a chord bearing of North

at the boundary of Lot Nos. 1 and 2 as described on the
aforementioned Plan; thence along said Lot No.2, North 62 degrees
59 minutes 07 seconds East, 251.11 feet to a point at lands now or
formerly of Ruth S. Royer; thence along said lands now or formerly
of Ruth S. Royer, South 23 degrees 29 minutes 30 seconds East,
],84.48 feet to a point, the Place of BEGINNING.
