5. Denied. After reasonable investigation, answering Defendant
is without. knowledge or information sufficient to form a belief liS to the
truth or veracity of the allegations contained in paragraph 5 of
Plaintiffs' Complaint and t.he same are denied and strict proof thereof
is demanded at the time of trial.
6. Denied. It is specifically denied that when Plaintiffs first
viewed the property, Plaintiffs either questioned the alleged pet odor
and/or were informed that there were no problems with the property caused
by Defendant's dog or that it was implied that any alleged odor was due
to the dog's continued presence on the property and, therefore, strict
proof thereof is demanded at the time of trial. By way of additional
response, when Plaintiffs first viewed the property they never raised any
question regarding pet. odor, the existence of which is specifically
denied. On the contrary, both Plaintiffs were very interested in the
property and indicated that they wished they had known the property was
available prior to Defendant listing it with a realtor.
7. Denied. The Agreement of Sale speaks for itself.

9. Admitted. It is admitted that no indication was made on the
Disclosure Statement that there was any problem with the p~?perty as a
result of Defendant's dog as no such problem existed, or at any time
relevant hereto, did answering Defendant have any knowledge or notice of
any alleged "problem" existing at the property such that disclosure was
warrant.ed.
10. Admitted. It is admitted that despite knowing that answering
Defendant was atill occupying the property on the date of settlement,
August 29, 1997 (with the full consent and knowledge of the Plaintiffs),
Plaintiffs unilaterally elected to conduct their pre-settlement walk-
through inspection a mere two hours prior to settlement.
II. Denied, After reasonable investigation, answering Defendant
is without. knowledge or information sufficient to form a belief as to the
truth or veracity of the allegations contained in paragraph 11 of
Plaintiffs' Complaint and the same are denied and strict proof thereof
is demanded at the time of trial. To the extent a response is deemed
necessary, Plaintiffs were aware that on August 29, 1997, answering
Defendant had not removed her property from the premises, yet, Plaintiffs
nonetheless chose to schedule their walk-through on the day of
settlement.

13. Ailioitted in part; denied in part. It is admitted that at some
time prior to settlement, the Plaintiff, Colleen Haney, expressed concern
with regard to the dog odor and was advised that the dog was not
permitted to roam free throughout the entire house. It is specifically
denied, however, that Plaintiffs were advised that the dog was only
permi t ted in one room and tha t answering Defendant fa i led to noti fy
Plaintiff of any "problems" with the property caused by answering
Defendant's dog, as no such "problems. either existed or were kno"n by
answering Defendant at anytime relevant hereto and, therefore, strict
proof thereof is delllanded at the time of trial.

appointed time, she did so with the full consent and knowledge of both
Plaintiffs.
15. Admitted. It is admitted t.hat at the t.ime of vacating the
property, answering Defendant Seltzer set off four (4) flea bombs, in
particular, Raid Flea and Tick Bombs made specifically for this int.ended
use and which were purchased from Ollie's. By \~ay of additional
response, answering Defendant. Seltzer utilized the flea bombs at the
request of the Plaintiffs, but pr.ior to the time of settlement. and, at
all times relevant hereto, had not. had any problem with fleas at the
property.

Denied.
It is specJ.fically denied that the flea bombs
utilized by answering Defendant were not sufficient. to deal with any
alleged flea "problem,. the existence of which is, likewise, specifically
denied. Furthermore, as there was no furniture in the condominium at the
time of answering Defendant's used the flea bombs, the quantity utilized
was more than adequate.
17. Admitted in part; denied in part. It is admitted that
,answering Defendant scheduled Sears to clean and deodorize the carpet
after vacating the property. It is, however, specifioally denied that
Sears was scheduled to clean only one room and strict proof thereof is
demanded at the time of trial.
18. Denied. After reasonable investigation, answering Defendant
is without knowledge or information sufficient to form a belief as to the
truth or veracity of the allegations cont.ained in paragraph 18 of
Pl.aintiffs' Complaint and the same are denied and strict proof thereof
is demanded at the time of trial. By way of additional response,
answering Defendant Seltzer had scheduled, in advance, Sears to come in
and perform a full and complete cleaning of the condominium's carpeting.
It is specifically denied that Sears was advised that they were only
authodzed to do one room and, therefore, strict proof is therefore
demanded at the time of trial. On the contrary, Sears was advised that
it. was .IJJlll.!itcessarv to do one room, the living room, because the dog was
not allowed in that. area of the home. After reasonable investigation,
answering Defendant. lacks knowledge or information sufficient to form a
belief as to the truth or veracity of the remaining allegations contained
in paragraph 18 of Plaintiffs' Complaint and same are denied and strict
proof thereof is demanded at the time of trial.
19. Denied. It is specifically denied that the Sears employee
either needed or was unable to reach Defendant Seltzer for additional
authorization and same is denied and strict proof t.hereof is demanded at.
the time of trial. On the contrary, at the time answering Defendant
cont.acted Sears to perform the car~et cleaning, she provided Sears with
two means of payment: a Visa card, as well as a second source, a
Visa/Mac. In addition, Sears was provided with answering Defendant's
unlisted telephone number where they could have contacted her if there
were any problems; answering Defendant was neither contacted nor aware
of any effects to contact her on the part of Sears.
20. Denied. After reasonable investigation, answering Defendant
is without knowledge or information sufficient to form a belief as to the
truth or veracity of the allegations contained in paragraph 20 of
Plaintiffs' Complaint and the same are denied and strict proof thereof
is demanded at the tJme of trial.
21. Denied. After reasonable investigation, answering Defendant
is without knowledge or information sufficient to form a belief as to the
truth or veraoity of the allegations contained in paragraph 21 of
Plaintiffs' Complaint and the same are denied and strict proof thereof
is demanded at the time of trial. To the extent a response is necessary,
it is specifically denied that there was and/or is, a "very intense pet
urine smell" at the property and strict proof thereof is therefore
demanded at the time of trial.
22. Denied. It is specifically denied that the property was not
clean at the time Defendant Seltzer vacated the residence and strict
proof thereof is therefore demanded at the time of trial. With regard
to the specific allegations of paragraph 22, answering Defendant was
unaware of cobwebs when she cleaned the premises upon her departure I any
rings in the toilets are believed to be caused by water and are not
attributable to the lack of cleaning.
Likewise, all the baths were
cleaned at some time shortly before answering Defendant vacated the
premises and all kitchen cabinets were wiped out and washed down. It is
believed and therefore averred that the only "garbage" was the four empty
boxes to be used ~n conjunction with the flea bombs for the protection
of the carpeting. Moreover, the blinds in the upstairs den were left at
the premises with Plaintiffs' knowledge in the event they preferred them
to the verticals.
23. Denied. After reasonable investigation, answering Defendant
is without knowledge or information sufficient to form a belief as to the
t.ruth or veracity of the allegations contained in paragraph 23 of
Plaintiffs' Complaint and the same are denied and strict proof thereof
is demanded at the timo of trial.
24. Denied. It is specifically denied that the foggers placed by
Defendant Seltzer were not sufficient to eliminate the alleged flea
"problem,. the evidence of which is specifically denied. with regard to
the remaining allegat.ions of paragraph 24, answering Defendant lacks
sufficient knowledge or information so as to admit or deny the truth of
said allegations al~ strict proof thereof is therefore demanded at the
time of trial.
25. Admitted in part; denied in part. It is admitted that the
electric water heater had been replaced in 1996 and Plaintiffs were
advised accordingly. It is specifically denied, however, that the
electric water heat was not properly wired or that this condition was
known to answering Defendant and strict proof thereof is therefore
demanded at the time of trial. With regard to the remaining allegations
in paragraph 25, answering Defendant lacks knowledge or information
sufficient to form a belief as to the truth or v~racity of these
allegations and the same are denied and strict proof thereof is therefore
demanded at the time of trial.
26. Admitted in part; denied in part. It is admitted that there
are several minor discolorations on the carpeting throughout the
property. It is specifically denied, however, that the alleged
discolorations and "stains. are from pet urine and soaked through the
carpeting, padding and into the foundation and subflooring of the
propert.y and strict proof thereof is therefore demanded at the time of
trial. By way of additional response, at no time during her occupancy
of the premises did answering Defendant have any knowledge of any stains
on the carpeting caused by pet urine which soaked through the carpetIng,
padd.ing and into the foundation and/or sUbflooring of the property.
Indeed, answering Defendant was not aware of any permanent stains on the
carpeting, as she ren the vacuum in the property once it was empty and
saw nothing that would have put her on notice that there was a
substance/stain that would not come out with professional cleaning. In
addition, answering Defendant had the carpeting professionally cleaned
before with no problems.
27. Denied. It.is specifically denied that any of the minimal
discolorations or stains on the carpeting were "hidden" by Defendant
Seltzer's personal property and were not discovered by Pla.intiffs until
after Defendant Seltzer removed her personalty from the property and
strict proof thereof is therefore demanded at the time of trial. At the
time of their scheduled walk-through, the Plaintiffs were aware that
Defendant still had her furniture and possessions in the premises, but
nonetheless elected to conduct their walk-through at that time. No
action on the part of answering Defendant prevented or prohibited the
Plaintiffs from Observing/discovering illl.'l alleged condit.lon of the
premises. Plaintiffs had every opportunity to conduct a complete and
adequate inspection of the property and any failure to do so is through
no fault or effort on the part of answering Defendant.
28. DenJed. It is specifically denied that t.here was any smell in
the property attributable to pet urine or that the alleged odor "is very
strong" and strict proof thereof is therefore demanded at the time of
tr ial.
29. Denied. Aft.er reasonable investigat.ion, answering Defendant
is without knowledge or information sufficient to form a belief as to the
trut.h or veracity of the allegations contained in paragraph 29 of
Plaintiffs' Complaint and the same are denied and strict proof thereof
is demanded at the time of trial. To the extent a response is deemed
necessary, it is specifically denied that the heating and air
condi tioning system needed to be cleaned and strict proof thereof is
therefore demanded at the time of trial. On the contrary, at no time
during her occupancy of the premises did answering Defendant experience
any difficulty with the operation or efficiency of the system which would
have put her on notice that it needed to be cleaned.
30. Denied. After reasonable investigation, answering Defendant
is without knowledge or information sufficient to form a belief as to the
trut.h or veracity of the allegations contained in paragraph 30 of
Plaintlffa' Complaint and the same are denied and strict proof thereof
is demanded at the time of trial.
31. Denied. After reasonable investigation, answering Defendant
is without knowledge or information sufficient to form a belief as to the
truth or veracity of the allegations contained in paragraph 31 of
Plaintiffs' Complaint and the same are denied and strict proof thereof
is demanded at the time of trial.

36. Denied. After reasonable investigation, answering Defendant
is without knowledge or information sufficient to form a belief as to the
truth or veracity of the allegations contained in paragraph 23 of
Plaintiffs' Complaint and the same are denied and strict proof thereof
is demanded at the time of trJal. By way of additional response,
Defendant Seltzer was never asked to pay for the carpet cleaning.
37. Denied. It is specifi.cally denied that Defendant Seltzer
failed to properly treat the property for any alleged flea infestation
and strict proof thereof is therefore demanded at the time of trial. On
the contrary, four flea bombs were set off prior to Defendant's vacancy
and, in light of the fact that t.here was no "flea infestation" said
efforts were more than adequate.
38. Denied. It is specifically denied that Defendant Seltzer
and/or the company hi.red by her failed to deodorize the carpet as
required by the Pre-Settlement Walk-Through and strict proOf thereof is
therefore demanded at the time of t.rial.
WflERE~'ORE, answering Defendant, Sandra A. Seltzer, respectfully
requests that this Honorable Court. enter judgment in her favor and
against the Plaintiffs in an amount not in excess of the compulsory
arbitration limits of Cumberland County.

specifically denied that there was any material defect to the carpeting,
padding or sUbflooring caused by dog urine of which answering Defendant
had knowledge or notice at the time she executed the Seller Disclosure
Act or at anytime thereafter.
42. Admitted. It is admitted that seller, answering Defendant,
did not amend the Seller's Property Disclosure Statement because she was
not aware of any alleged damage/defect to the carpet, padding and
subfloor; therefore, it is uncontroverted that answering Defendant cannot
and is not required to disclose that which she is unaware of and which
is not tantamount to a material defect.
43. Denied. The allegations raised in paragraph 43 state a
conclusion of law to which no response is required. To the extent a
response is deemed necessary, the Real Estate Disclosure Act does not
require a seller to disclose that which she has no knOWledge of; i. e.
answering Defendant neither had knOWledge or reason to know that there
was any damage to the carpeting, padding and subfloodng allegedly caused
by dog urine the existence of which is specifically denied.
44. Denied. The allegations raised in paragraph 44 state a
conClusion of law to which no response is required. Answering Defendant
incorporates herein by reference as though set forth in full her response
to paragraph 43 above.
45. Denied. The allegations raised in paragraph 45 state a
conclusion of law to which no response is required. To the extent a
response is deemed necessary, it is specifically denied that with regard
to the property in question there was, at anytime, a "pet odor problem"
of the alleged problem, the existence of which is specifically denied,
and strict proof thereof is therefore demAnded at the time of trial.
50. Denied. The allegations raised in paragraph 50 state a
conclusion of law to which no response is required. To the extent a
response is deemed necessary, it is specifically denied that answering
Defendant willfully and/or fraudulently failed t.o reveal the severity of
the alleged damage to the property allegedly caused by Defendant
Seltzer's dog urinating throughout the property, as answering Defendant
had no notice and/or knowledge of any condition created by her dog's
alleged urine at the property at anytime relevant hereto and strict proof
thereof is therefore demanded at the timo of trial.
,'i1. Denied. It is specifically denied that Defendant Seltzer made
it impossible for Plaintiffs to do a full and complete inspection of the,
property prior to settlement by her failure to promptly remove herself
and her personalty from the property and strict proof is therefore
demanded at the time of trial. On the contrary, Plaintiffs themselves
elected August 29, 1997 at approximately 12:30 p.m. as the time for their
pre-settlement inspection and did so with full knowledge and notice that
Defendant Seltzer still had her personalty in the property and was
occupying the premises. By way of additional response, there was no
action on the part of Defendant Seltzer that prevented Plaintiffs from
completing and performing a full inspection of the property at anytime
prior to settlement.
52. Denied. 'rhe allegations raised in paragraph 52 state a
conclusion of law to which no response is required. To the extent a
response is deemed necessary, Defendant Seltzer made no eff' rts to "hide"

62. Paragraphs 1 through 54 of answedng Defendant:' s Answer above
are incorporated herein by reference as though set forth in full.
63. Plaintiffs' Complaint fails to state a claim and/or cause of
action sufficient to accord relief.
64. Plaintiffs have faUed to state a cause of action for punitive
damages.
65. Pursuant to paragraph 17 of the Agreement for the Sale and
Purchase of Real Estat~ entered into by Plaintiff, Colleen A. Haney and
answering Defendant on or about July 13, 1997, .it is "understood that
buyer has inspected the property, or hereby waives the right to do so and
he/she has agreed to purchase it as a result of such inspection and not
because of or in reliance of any represent.ation made by the seller. .. and
that he/she has agreed to purchase it in its present condition....
66. Plaintiff, Rudolph F. Kocevar, Jr., was not a party to the
Agreement of Sale between Plaintiff Haney and answering Defendant.
67. The Agreement of Sale is a wholly integrated
agreement/document and there are no other terms, obligations, covenants,
representative statements or conditions, oral or otherwise, of any kind
whatsoever concerning the sale.
68. Plaintiffs, between the date of the Agreement of Sale and the
date of settlement, inspected the property and were fully aware of the
condition of said property.
69. At the time answering Defendant completed the Seller's
Property Disclosure Statement (or thereafter) she was aware of no
mater.al defects that existed at the property.
70. At no time relevant hereto did answaring Defendant have any
knowledge or notice of any problem with regard to the carpeting, padding,
subflooring or flooring by virtue of pet urine or any other cause.
71. At no time relevant hereto did answoring Defendant have any
notice or knowledge of any problem with either the heating, ventilating
and/or air cDnditioning system.
72. Answerlng Defendant was not aware of any problem with the
electrical water heater at anytime relevant hereto.
73. In tho event there is any damage to the carpeting and padding
which requires the replacement of the carpeting, padding and/or necessity
to clean and seal the subflooring, same is attributable solely to the
Plaintiffs' actions and/or the actions of a third party unrelated to and
unbeknownst to answering Defendant.
74. Answering Defendant properly and adequately deodorized the
carpet in question.
75. No condition of the property existed either prior or
subsequent to the transaction in question which would have a significant
adverse impact on the value of the residential real property and which
constitutes a material defect and which was known to answering Defendant
at anytime.
76. Any alleged discoloration and/or stains and/or odor was open,
visible and apparent to Plaintiffs.
77. Pursuant to the Pre-Settlement Walk-Through Inspection,
PlaintJ.ffs expressly warranted that "they are not relying upon any
representations made by Seller.. .and hereby releases, quit-claims, and
forever discharges, Sellers.. .for any and all claims, losses or demands,
Including personal injuries, and all of the consequences thereof, whet.her
now known or not, Which may arise due to the condition of the subject
propert.y. "
78. Pursuant to the Seller's Property Disclosure Statement, a copy
of which is attached to PlaintIffs' Complaint as Exhibit "0", PlaintIff,
Colleen Haney as buyer, acknowledged receipt of the Disclosure St.atement
and acknowledged that the statement Was "not a warranty and lInless stated
otherw1se in the Agreement of Sale, buyer is purchaaing this property in
its present condition. It is buyer's responsibility to satisfy himself
or herself as to the condition of the property. Buyer may request that
the property be inspected at buyer's expenses and by qualified
professionals." Buyers, the Plaintiffs, failed to request that the
property be inspected by an independent entity.
79. As a result of the Plaintiffs' failure to inspect the property
prior to settlement or having inspected and failed to note an exception
to and having proceeded to settlement, Plaintiffs are bound by the terms
of same and such risk of damage resulting thereafter is the
responsibility of the purchasers/Plaintiffs.
WHEREF'ORE, answering De fendant, Sandra A. Selt ze r, respectfully
requests this Honorable Court to dismiss Plaintiffs' Complaint and to
enter jUdgment in her favor, plus costs of suit, counsel's fees and all
other expenditures which this Court should deem reasonable under the
circumstances.

5. Defendant Coldwell Banker was th(~ listing agent for the property.
6. When Plaintiffs first viewed the property, Plaintiffs questioned the
pet odor but were Informed there were no problems with the property caused by
Seltzer's dog and It was implied that the odor was because the dog was stili in the
property.
7. As a part of the Agreement of Sale, Plaintiffs requested that Seltzer
have the carpet professionally cleaned and the property treated for fleas.
8, As a part of the Agreement of Sale, Seltzer had provided a Seller's
Property Disclosure Statement indicating the condition of the property. A copy
of said Disclosure Statement is attached hereto, marked Exhibit "B" and
Incorporated herein by reference.
9. No Indication was made on the Disclosure Statement that there was
any problem with the property as a result of Seltzer's dog.
10. On the date of settlement, August 29, 1997, Plaintiffs did a pre-
settlement walk-through Inspection.
11. It was impossible for Plaintiffs to do a complete inspection because
Seltzer had not removed her property from the residence.
12. Because of the odor that was still present in the home, the pre-
settlement walk-through Inspection indicated that the carpeting was to be cleaned
and deodorized for pet odor. A copy of said Pre-Settlement Walk-Through
Inspection is attached hereto, marked Exhibit "C" and incorporated herein by
reference.
13. After the walk-through, when Plaintiffs expressed concerns about the
dog odor, Seltzer Indicated that the dog was only permitted In one room and was
not permitted in the whole house and again failed to notify Plaintiffs of any
problems with the property caused by Seltzer's dog.
14. There was a post-settlement possession addendum allowing Seltzer
to remain In the property until August 30, 1997. However, Seltzer did not vacate
the property until after the appointed time.
15. At the time of vacating the property, Defendant Seltzer set off flea
bombs that had been purchased from Ollie's.
16. Said flea bombs were not sufficient to deal with the flea problem.
17. After vacating the property, Seltzer scheduled Sears to clean the
carpet and deodorize the carpet, but only scheduled this for one room.
18. When the Sears employee came to clean the carpets, he Informed
Plaintiff Colleen Haney that he was only authorized to do one room, and also that
Defendant Seltzer's credit card had been declined.
19. The Sears employee was unable to reach Defendant Seltzer for
additional authorization,
20. Plaintiff Colleen Haney paid the bills to Sears for $208.04 and $95.04.
21. The carpet cleanel' from Sears indicated that there was a very intense
pet urine smell at the property.
22. The propeM.y was not cleaned at the time Defendant Seltzer vacated
the residence. Specifleally there were cobwebs throughout the property, rings in
the toilet, dirt on the floor in the bathrooms, grease around the fan in the kitchen,
dirt inside the cabinets, and a lot of garbage throughout the property.
23. It was necessary for Plaintiff Colleen Haney to pay Maid To Perfection
to have the property cleaned prior to moving into the property. The eost of said
cleaning was $95.40.
24. Because the foggers plaeed b~' Defendant Seltzer were not sufficient
to eliminate the nea problem, Plaintiff Haney purchased and set off nea foggers
at the property. The cost of the foggers was $37.72.
25. The electrl(: water heater which Defendant Seltzer Indicated had been
replaced In 1996 was not properly wired. It was necessary for Plaintiffs to pay an
electrician to Install ajunction box and re-wire the heater. The cost was $50.00.
26. There are discolorations and stains throughout the property on the
carpeting. The stains go through the carpeting and the padding, and onto the
foundation and subfloorlng of the property. The smell Indicates that the stains are
from pet urine.
27. Most o.fthe discolorations and stains on the carpeting were hidden by
Defendant Seltzer's personal property and were not discovered until after Seltzer
removed her personalty from the property.
28. The smell in the property from the pet urine Is very strong.
29. It was necessary for Plaintiffs to have the heating and air-conditioning
system cleaned. 'rhe person doing the cleaning indicated that it appeared that it
