PETITION fOR SPECIAL RELIEF

AND NOW, this 11th day of June 1998, comes the petitioner, Victoria L. BUI'kett, hy her
attorneys, IRWIN, M(~KNIGHT & l-fl1GHES, and makes the following Petition for Special
Relief against the respondent, Gary L. Burkett, as 1()llows:
I.
The petitioner is Victoria L. Burkett, an adult individual residing at f 2 West Factory
Street, Meehaniesburg, Pennsylvania 170 II.
2.
The respondent is Gary L. Burkett, an adult individual residing in Camp Hill,
Pennsylvania, Pennsylvania, 17011, having a mailing address c/o Planks Suburban Press, 2321
Market Street, Camp Hill, Pennsylvania 170 II.

The parties were married on June 15, 1985 in Mechanicsburg, Cumberland County,
Pennsylvania.

The parties lire the nntural pllrents of Adalll .I. Burkett, age thil'leen (13), born Oil July 12,
1984, and of Megan L. Burkett, age 12, bol'll October 26, 1985,

Petitioner is unaware of nny prior cllstody proceedings which mny be pending inrelution
to the parties nnd the minor children,

During the course of the parties marTing,,, the Respondent, Gary L. Burkett, used illegal
substances, including cocainc, During such time, Respondent would become violent and
argumentative toward Petitioner and the minor children.

On 01' IIbout JanulllY 14, 1995, the parties separated, with the Respondent, Gary L.
Burkett, vacating the marital residence.

At the time of separation, the Petitioner, Victoria L. Burkett, wtained physical custody of
the parties' minor children, and continued to the be the primary custody of the children
thereafter.

The during the first three (3) years following s~pal'lltlon, the Rcspondcnt took no al1tion
toward obtaining partial 01' primnry custody of' the minor children, nnd I'lIrely requested visitation
with the children,

Beginning in March, 1998, ufter Petitioncr hnd bcgun divorce proceedings ngainst
Respondent, Mr. Burkett began to arrive at the children's school and pick np the minor children
at thc end of the school duy without agrecment 01' notice to the Petitioner, Victoriu L.. Burkett.

Oil those duys in whkh Respondentunilatcrally chose to exercise custody of the minor
children, Petitioner had no knowledge us to the whereabouts ofthc children until they would be
returned to the Petitioner's home later in the afternoon,

On 01' about Tuesday, June 9, 1998, MI'. Burkett did contact Petitioner and request
visitation with the children so that he could tuke them swimming ut Lisburn Creek, Petitioner
consented and Mr, Burkett did exercise custody accordingly,

When Pctitioner returned from her employment that Tuesday, she encountered Mr.
Burkett with her son and all ofthc son's belongings packed in Respondcnt's lIutomobile,
Respondent told the Petitioner that he W(\S taking thcir minor son, Adam, to live with him, An
argument ensued, with the resulting outcome bcing that the Respondent removed the parties'
