The parties to this action, .JEFFREY 1.. DONNELLY, (hereinafter
referred to as "FATHER"), and GINA L. DONNELLY (hereinafter
referred t.o as "MOTHER"), desiring to amicably settle and resolve
all outstanding issues concerning custody and partial custody with
respect to the minor child involved in this action: BRANDY LEIGH
DONNELLY, born May 8, 1988, hereby stipulate and agree to the entry
of an Order of Court awarding custody and partial custody of BRANDY
as follows:
1. The parents agree that they shall share legal custody of
the minor child, BRANDY LEIGH.
2. The parents agree that FATHER shall have primary physical
custody of the minor child.
3. 'l'he parents agree that MOTHER shall have partial physical
custody of the minor child on the following schedule:
a) On alternate weekends from Friday at 5:00 p.m. until
Sunday at 5:00 p.m.; and
b) Every TU13sday and Thursday from 4:30 p.m. until 7:30
p.m.
4. MOTHER and FATHER agree that the following holidays shall
be alternated between them from year to year, regardless of the
usual schedule I Easter, Memorial Day, Fourth of July, Labor Day and
Thanksgiving.
MOTHER shall have Easter, the Fourth of July and Thanksgiving
in 1998 and in all even years thereafter. FA'l'HER shall have
Memorial Day and Labor Day in 1998 and in all even years
thereafter.
FATHER shall have Easter, the Fourth of July and Thanksgiving
in 1999 and in all odd years thereafter. MOTHER shall have Memorial
Day and Labor Day in 1999 and in all odd years thereafter.
The holiday hours shall be from 9:00 a.m. until 5:00 p.m.
5. The parent.s agree that the ChriF.ltmas holiday shall be
shared between them each year.
In 1998 and in all even years thereafter, MOTHER shall have
from 5:00 p.m. on the last day of school before Christmas vacation
until noon on December 25th and FATHER shall have the remainder of
the holiday.
In 1999 and in all odd years thereafter, MOTHER shall have
from 5:00 p.m. on the last day of school before Christmas vacation
until 10:30 p.m. on December 24th and FATHER shall have the
remainder of the hOliday.
6. MOTHER and F'ATHER agree that each shall have the
opportunity to see the minor child on her birthday, and on each of
their birthdays.
7. The parents agree that. they shall share the child I s
summer vacation from school on an alternating two (2) week
uninterrupted basis, with MOTHER beginning her first two (2) weeks
of summer custody on the Friday following the last day of school at
5:00 p.m., and ending her summer custody the Friday before the
beginning of the next school year at 5:00 p.m.
8. The parents agree tnat FATHER shall have the child on
Father's Day, MOTHER shall have the child on Mother's Day,
regardless of the usual schedule. The hours shall be from 9:00 a.m.
until 5:00 p.m.
9. MOTHER and FATHER agree that they shall permit reasonable
telephone access between the child and each of her parents.
10. Both parents agree that, by their mutual consent, an
expanded or altered schedule may be agreed upon between them for
and in the best interests of the minor child.
11. The parents agree that this Agreement shall be submitted
to the Court of Common Pleas of Cumberland County, Pennsylvania for
approval and for entry of an Order awarding custody and partial
custody as set forth herein, and the parents hereby request the
Court to enter such an Order.
1M WITNESS WHEREOF, the parties have executed this Custody
Stipulation on the date(s) indicated below.
