1. Plaintiff, MELLON BANK N.A. SUCCESSOR TRUSTEE FOR THE
PENNSYLVANIA HOUSING FINAllCE AGENCY, is a corporation with an
address of 2101 Nort.h Front Street, Harrisburg, Pennsylvania
17105.
2. Defendant, DARRELL D. PARKER a/k/a DARRELL DONNELL
PARKER, is an adult individual whose last known address is 1834
. ,
SPRING ROAD, APARTMENT A, CARLISLE, PENNSYLVANIA 17013.
Defendant, DAVALIN S. PARKER, is an adult individual whose last
known address is 1834 SPRING ROAD, APARTMENT A, CARLISLE,
PENNSYLVANIA 17013.
3. On or about May 31, 1996, the said Dofendant. executed
and delivered a Mortgage Note in the sum of $57,000.00 payable to
MAIN LINE BANK, which Note is attached hereto and marked Exhibit
"Aft.
4. Contemporaneously with and at the time of the E1xecution
of the aforesaid Mortgage Note, in order to secure payment of the
same, Defendant made, exeouted and delivered to original
Mortgagee, a oertain real estate Mortgage whioh is reoorded in
the Reoorder of Deeds Office of the within County and
Commonwealth in Mortgage Book 1323, Page 537 conveying to
original Mortgagee the subject premises. The mortgage was
subsequently assigned to MELLON BANK N.A. SUCCESSOR TRUSTEE FOR
THE PENNSYLVANIA HOUSING FINANCB AGENCY pursuant to the terms of
said Trust and reoorded as aforesaid in Book 539, Page 860 on
January 30, 1997. A Mortgage Modifioation Agreement was executed
on February II, 1997 as reoorded in Mortgage Book 543, Page 662.
Said Mortgage, Modification Agreement and Asslgnment are
incorporated herein by reference.
5. The land subject to the Mortgage iSI 245 PINE GROVE
ROAD, GARDNERS, PENNSYLVANIA 17324 and is more partiaularly
desoribed in Exhibit "B" attached hereto.
6. By deed dated May 31, 1996, and reoorded June 3, 1996,
in Cumberland County Deed Book 140, Page 323, the said Darrell D.
Parker oonveyed the within premises SUBJECT '1'0 THE MORTGAGE to
Darrell D. Parker and Davalin S. Parker. Davalin S. Parker is a
,
terre tenant. Defendants, Darrell D. Parker and Davalin S.
Parker, are the real owners of the land subject to the Mortgage.
7. The Mortgage is in default due to the fact that
Mortgagor has failed to pay the installment due on August 1, 1997
and all subsequent installments thereon, and the following
amounts are due on the Mortgage I
(a) Unpaid prinoipal balanoe $ 56,333.68
(b) Interest at $10.48 per day
from 7/ 1/97 to 1/31/98
(based on contraot rate of 6.700%) 2,242.72
(0) Acoumulated Late Charges
and Late oharges at $14.71
per month for 6 months

(e) 5% Attorney's Commission

~Together with interellt at the per diem rate noted 1n (bl above
after January 31, 1998 and other oharges and oosts to date of
Sheriff's Sale.
The attorney's fees set forth above are in conformi.ty with
the Mortgage documents and Pennsylvania law, and will be
oollected in the event of a third party purchaser at Sheriff's
Sale. If the Mortgage is reinstated prior to the sale,
reasonable attorney's fees will be charged that are actually
incurred by Plaintiff.
8. No judgment haa been entered upon said Mortgage in any
jurisdicti.on.
9. Notice of intention to foreclosure and accelerate the
loan balance pursuant to Pennsylvania Act No.6, of 1974 is not
required i that the original principal balance exceeds
$50,000.00.
10. Notice of Intention to Foreclose has been sent to
Defendant by Certified Mail, ae required by Act 6 of 1974 of the
Commonwealth of Pennsylvania, on the date set forth in the true
and correct copy of such notice attached hereto as Exhibit "C".
11. The within mortgage is insured by the Federal Housing
Administration under Title II of the National Housing Act and, as
sUdh, is not subject to the provisions of Pennsylvania Act No. 91
of 1983.

THE PENNSYLVANIA f10USING F'INANCE AGENCY pUrsuant to the terms of
said Trust and recorded as aforesaid in Book 539, Page 860 on
January 30, 1997. A Mortgage Modification Agreement was executed
on February 11, 1997 as recorded in Mortgage Book 543, Page 662.
Said Mortgage, Modification Agreement and Assignment are
incorporated herein by reference.
5. The land subject to the Mortgage iSI 245 PINE GROVE
ROAD, GARDNERS, PENNSYLVANIA 17324 and is more particularly
desoribed in Exhibit "B" attached hereto.
6. By deed dated May 31, 1996/ and recorded June 3, 1996,
in Cumberland County Deed Book 140, Page 323, the said Darrel1 D.
Parker Conveyed the within premises SUBJECT TO THE MORTGAGE to
Darrell D. Parker and Davalin S. Parker. Davalin S. Parker is a
terre tenant. Defendants, Darrell D. Parker and Davalin S.
Parker, are the rea 1 owners of the land subject to the Mortgage.
7. The Mortgage is in default due to the fact that
Mortgagor has failed to pay the lnstallment due on August 1, 1997
and all SUbsequent installments thereon, and the following
amounts a.re due on the Mortgage I
(a) Unpaid principal balance $ 56,333.68
(b) Interest at $10.48 per day
from 7/ 1/97 to 1/31/98
(based on c0ntract rate of 6.700%) 2,242.72
(c) Accumulated Late Charges
and Late charges at $14.71
per month for 6 months

'l'he attorney's fees set forth above are in conformity with
the Mortgage documents and Pennsylvania law, and will be
collected in ths event of a third party purchaser at Sheriff's
Sale. If the Mortgage is reinstated prior to the flale,
reasonable attorney's fees will be charged that are actually
incurred by Plaintiff.
B. No judgment has been entered upon said Mortgage in any
jurisdiction.
9. Notice of intent10n to foreclosure and accelerate the
loan balance pursuant to Pennsylvan1a Act No. 6 of 1974 is not
required i that the original principal balance exceeds
$50,000.00.
10. Notice of Intention to Foreclose has been sent to
D~fendant by Certified Mail, as required by Act 6 of 1974 of the
Commonwealth of Pennsylvania, on the date set forth in the true
and correct copy of such notice attached hereto as Exhibit "C".
11. The within mortgage is insured by the Federal Houeing
Administration under Title II of the Natlonal Hous1ng Act and, as
such, is not subject to the provisions of Pennsylvania Act No. 91
of 19B3.

1. Plaintiff, MELLON BANK N.A. SUCCESSOR TRUSTEE FOR THE
PENNSYLVANIA HOUSING FINANCE AGENCY, is a corporation with an
address of 2101 North Front Streett Harrisburg, Penosylvania
17105.
2. Defendant, DARRELL D. PARKER, is an adult individual
whose last known address 1s 245 PINE GROVE ROAD/ GARDNERS,
PENNSYLVANIA 17324.
3. On or about May 31, 1996, the said Defendant executed
and del1vered a Mortgage Note in the sum of $57/000.00 payable to
MAIN LINE BANK, which Note is attaohed hereto and marked Exhibit
ItA".
4. Contemporaneously with and at the t1me of the execution
of the aforesaid Mortgage Note, in order to secure payment of the
same, Defendant made, executed and delivered to original
Mortgagee, a certai.n real estate Mortgage which is recorded in
the Rocorder of Deeds Office of the within County and
Commonwealth in Mortgage Buok 1323, Page 537 conveying to
original Mortgagee the subject premises. The mortgage was
subsequently assigned to MELLON BANK N.A. SUCCESSOR TRUSTEE FOR
THE PENNSYLVANIA HOUSING FINANCE AGENCY pursuant to the terms of
said Trust and recorded as aforesaid in Book 539/ Page 860 on
January 30, 1997. A Mortgage Modification Agreement was executed
on February 11, 1997 aD recorded in Mortgage Book 543, Page 662.
Said Mortgage, Modification Agreement and Assignment are
inoorporated herein by referenoe.
5. The land subject to the Mortgage iSI 245 PINE GROVE
ROAD, GARDNERS, PENNSYLVANIA 17324 and is more particularly
described 1n Exhibit "B" attached hereto.
6. The said Defendant is the real owner of t.he land subject
to ths M()rtgage.
7. The Mort.gage is in default due to the fact that
Mortgagor has failed to pay the installment due on August 1, 1997
and all subsequent installments thereon, and the following
amounts are due on the Mortgagel

10. Defendant is not a member of the Armed Forces of the
United States of America, nor engaged in any way which would
bring them within the Soldiers and Sailors Relief Act of 1940, as
amended. 11. The within mortgage is insured by the Federal
Housing Adm1nistrat1on under Title II of the National Housing Act
and, as such, is not subject to the provisions of Pennsylvania
Act No. 91 of 1983.
WHEREFORE, Plaintiff demands jUdgment in mortgage
foreclosure "IN REM" for the aforementioned total amount due
together with interest at the rate of 6.700% ($10.48 per diem),
together with other charges and costs including escrow advAnoes
incidsntal thereto to the date of Sheriff's Sale and for
foreclosure and sale of the property within described.

address of 2101 North Front Streett Harriaburg, Pennsylvania
17105.
2. Defendant, DARRELL n. PARKER, is an adult individual
whose last known address is 245 PINE GROVE ROAD, GARDNERS,
PENNSYLVANIA 17324.
3. On or about May 31, 1996, the said Defendant executed
and delivered a Mortgage Note in the sum of $57,000.00 payable to
MAIN I,INE BANK, which Note is att.ached hereto and marked Exhibit
flAlf.
4. Contemporaneously with and at the t1me of the execution
of the aforesaid Mortgage Note/ in order to secure payment of the
samet Defendant made, executed and delivered to original
Mortgagee, a certain real estate Mortgage which is recorded in
the Recorder of Deeds Office of the within County and
Commonwealth in f.lortgage Book 1323, Page s.n conveying to
orig.,.n.al Mortgageo the subject premises. The mortgage was
subsequently assigned to MELLON BANK N.A. SUCCESSOR TRUSTEE FOR
THE PENNSYLVANIA HOUSING FINANCE AGENCY pursuant to the terms of
said Trust and recorded as aforesaid in Book 539, Page 860 on
January 30/ 1997. A Mortgage Modification Agreement was executed
on February 11/ 1997 as recorded in Mortgage Book 543/ Page 662.
Said Mortgage, Modification Agreement. and Assignment are
incorporated herein by reference.
5. The land subject to the Mortgage iSI 245 PINE GROVE
ROAD, GARDNERS, PENNSYLVANIA 17324 and 1s more part1cularly
described in Exhibit "B" attached hereto.
6. The said Defendant is the real owner of the land subject
to the Mortgage.
7. The Mortgage is in default due to the fact that
Mortgagor has failed to pay the installment due on August 1, 1997
and all subsequent installments thereon, and the following
amounts are due on the Mortgage:
(a) Unpaid principal balance $ 56,333.68
(b) Interest at $10.48 per day
from 7/ 1/97 to 1/31/98
(based on contract rate of 6.700%) 2,242.72
(c) Accumulated Late Charges
and Late charges at $14.71
