While it may no longer makc scnse for Perry County to pay for Attorney Morrow to micromanage the details of custody, that docs notmcan that the case should be transferred. 5. Rulc 1915.2 permits hut docs not rcquire transfcr. 6. Thc Notes to Rule 1915.2 show that guidancc regarding factors to consider in deciding whether to transfcr may be found in the Uniform Child Custody Jurisdiction Act, 23 Pa.C.S. ~5341 et seq. ~5348 governsfomlll non conveniens transfers. One faetor is "(4) If the parties have agreed on anothcr forum which is no less appropriate." Here, the parties agreed on Perry County at the outset. 7. Other factors enumerated in ~5348 also point towards Pcrry County retaining jurisdiction. For example, whilc it is true that Kirk and Blake, the two youngest children (the older two children have turncd 18 since this all started), now livc in Cumberland County, they lived most of their lives in Perry County, they regularly spcnd time here with their dad during the school year, and their dad has primary custody during the summers. The extended family on their father's side lives here. Substantial evidence concerning them is in Perry County. 8. Another directive in ~5348 is to further the policies set out in ~5342, of which number 6 is to "avoid reUtigation of custody decisions". See ~5348(e)(5). The Perry County court, with the able Involvement of court-appointed counsel to the children, Attorney Morrow, has crafted a carefully delineated "balance of powcr" bctween these two perpetua\1y warring parents that ought not to be upset except for substantial reasons. The subj ects of this Custody matter, Kirk /,~nd Blake "i DeatriCk, reside at PO Box 225 Sommerdale, PA,17093;' in qumberland , County. ",,' 2 . The children and petitioner, their mother, are physically present in Cumberland County and the mother has primary physical custody of the children. 3. Kirk and Blake Deatrick have lived in Cumberland County for the past four (4) years. 4. The respondent, Dwayne L. Deatrick, the father, resides at RR #2 Box 986 New Bloomfield, FA 17068, in Perry County. 5. At the time of the filing of the this petition to transfer, Cumberland County, is an appropriate court of venue pursuant to PA.R.C.P. Rule 1915.2. 6. It would be mare convenient for the parties and witnesses involved in this case to have the case transferred to Cumberland County. 7. It is in the best interflst of the children that Cumberland County decide this matter because the children and the petitioner, their mother, have signif icant conneotions to Cumberland County. 8. There is available within cumberland County, substantial evidence ooncerning the children's present or future oare, protection, training and personal relationships. 9. The Children's former attorney, Kathy Morrow, withdrew from representation of the children because she felt Perry county was "no longer the appropriate County as the children live in Cumberland County and have done so for a number of years". Petitioner requests to proceed without cost, in that she does not have available the means to pay the costs and fees of transfer and removal of the record. Wherefore, the petitioner respectfully requests that this Court grant the Petition to transfer this matter to Cumberland county, at no cost to the petitioner, as outlined above. This job is very important. to her. 'II 8. The order of December 19 further provides that t.he IChildren shall vis! t the ot.her parent one weekend each month. !far as this concerns Dawn, this means that under the order, her I\s mother has a right to her visiting once a month. II 9. The younger sister, Heather, is not obliged to visit her Ilfather unless she wants to. I, II 10. Dawn's work schedule on weekends, although not totally Ipredictable, interferes with her mother's visitation rights. I 11. Dawn has offered to visit at ot.her times to make up for Ithe weekends that she cannot visit her mother, due to her I Irequirement to be at work. I 12. In reliance on the literal wording of the Ot'dec, on the Iweekend of February 9, when Dawn declined to go visit her mother because she had to work at Long John Silvers, the mother, Leta Deatrick, asked the Pennsylvania State Police to enforce the terms of the order. The Officer declined to enforce it literally on that weekend, but indicated to the father, I I IDWayne Deatrick, that the next time around they would have no lehoice but to enforce the order. I II n. Ijoounsel, Kate Morrow, ilnd Dwayne Doatrlck, through his counsel, Jerry Philpott, attempted to work out an amicable resolution and a FOllowing that weekend, Dawn Deatrick, through her mutually agreeable revision to the order. 14. The latest exchange of correspondence among counsel indicates that it is likely that Leta Deatrick will continue to seek literal enforcement of the order, despite these efforts at an amicable resolution. 15. Dwayne Deatrick is prepared to assist in making alternative arrangements so that Dawn Deatrick can visit her mother, but does not feel that he should be jailed for Dawn's I wishes to work. ! I WHEREFORE, 'order declaring petitioner, Dwayne Deatrick asks the court for an that he will not be in contempt of court when Dawn does not visit her mother on weekends that she is otherwise required to visit her mother because she has to work at her job. Respondent's nephew frequently lives in the home, or visits for extended periods. 6. Dawn is afraid of Respondent's nephew since he has humiliated and ridiculed her in the past and has made suggestions with sexual overtones to her. 7. When Dawn attempted to get help through the school counselor, said counselor told Respondent, and instead of helping the situation, made it worse. 8. Dawn has made one unsuccessful attempt to commit suicide by slashing her wrists. 9. Dawn is fear.ful that Respondent will abuse her since he has hit his girl friend when he is in a violent rage, and has backhanded Heather on two occasions so hard that she had a swollen lip for several days. 10. Petitioner has requested intervention by Snyder County Children and Youth Services. 11. Dawn, now 15 years old, has repeatedly asked to live with Petitioner and her sister and brother. 12. Petitioner believes and therefore avers that she should be awarded custody of Dawn since she is able to provide a safe and stable home for her. 13. I don't think that 13 is particularly appropriate for Kirk because his sense 14 of time. . . that concept is not that well developed. 15 He's about six and a half now and he misses his mom. 16 He still lives primarily with dad. I don I t: know how 6 their behavior is in the community, including school. 7 I only know that Lata reports that what.evor sibling 6 rivalry and competition that exists -- that are normal 9 between Dawn and Heather seem to quickly resolve them- 10 selves at lcast by Saturday morning when she has her 11 weekend visi ta tion. I don I t have any evidence that the 12 older kids as yet are experiencing any major depression. 13 I know there is confusion. Hcather is very sensitive 14 and may be somewhat inhibited and may withdraw -- but I'm 16 speculating on that. I have not had the opportunity to 16 comprehensively review their adjustment. If you do 17 nothing what will happen? Dawn is very concerned about 18 her looks and acceptability with her peer group. Heath- 19 er helps her, from reports that Heather shared with us, 20 feel comfortable, her older sister feel comfortable with 21 her peer group. Pastor Deck will detail how he advised Dwayne that Dwayne should not physically harm Lata, and that he should give Leta ~n opportunity to reevaluate her feelings towards Dwayne, however, on three (3) separate occasions in the last month prior to separation, Dr. Beck will testify that Dwayne came to the Pastor indicating that he once again physically abused his wife. Pastor Beck will likewise note the active church involvement of the mother and the active involvement of the four (4) children when they are with the mother on the every other weekend schedule that has been established in the interim from separation to the date of the custody hearing. Testimony from Mrs. Deatrick's father will reveal that on several occasions, he accompanied his daughter to the home of the father in an effort for Leta to be able to see her four (4) children, and that on several occasions, D\~ayne physically accosted teta's father for no apparent reason. On several occasions, likeWise, Dwayne's language became very vulgar and obsoene, he beoame loud and boisterous, all in front of the children. -3- Testimony from the father of i~ta Deatrick will likewise reveal that he believes the children are extremely intimidated by the physical violence and temperament of Dwayne Deatrick. 1'estimony from a Eri.end of Leta, KIm, will reveal that Kim's boyfriend is a close personal friend of Dwayne Deatrick. On at least two (2) or three (3) times during the week since the separation of the parties, Dwayne has come to Kim's home and has literally left the four (4) children with her to watch while Dwayne and Kim's boyfriend go to the garage to work on cars and engage in drinking. On many occasions, Kim will indicate that the children are left alone because of Kim's work schedule and literally are left to watch themselves. Testimony from a close neighbor of Leta Deatrick, Ms. Baker, will testify that she does babysitting services and will provide babysitting services for Leta, if custody is awarded to her. Ms. Baker knows the Deatrick children and will further indicate that during several times that when she has had contact with the children, that tht! older ch.ildren, Heather and Dawn expressed to her that all the children are left alone on a regular basis, with the two (2) older children having to literally serve as babysitters for the younger two (2). -4- In addition, Heather, age thirteen (13) has indicated to Ms. Baker that ehe does most of the coOking in the Deatrick home at the present time. There is some indication from several persons that Heather has expressed a strong preference to be with her mother and that this preference is known to Mr. Deatrick who has "taken it out on Heather.' Kim recalls how Heather is mistreated and ridiouled by Mr. Deatrick because of her stated preference to be with her mother. Additional examples of Mr. Deatrick's violent behavior OOourred shortly after separation when Leta was with her sister traveling on what is known as the Ridge Road, between Newport and New Bloomfield. Mr. Deatrick pursued I~ta and her sister, attempting to hit their car and finally forcing them off the road at or near a store on Ridge Road. Lata's sister ran into the store and called for the State Police, and Upon her leaving the store, found that Mr. Deatrick had literally attempted to pull the door off its hinges and did, in fact, pull the door handle out of place. He was very viOlent, beating on the car and SCreaming obscenities how he was going to physically harm his wife, Lata. -5- At the present time, the four (4) ohildr.en, as indioated, reside with their natural father in E1J.iottsburg. Eaoh morning at approximately 4:30 or 5:00 in the morning, the children are taken to the sister-in-law of the father in Blain, where they are dispatched from various buses to various schools with Blake remaining their for purposes of babysitting. The father spends little or no time with the children for the balance of the day, while he is at work. Every other weekend since separation, the children have been with the natural mother, but during some of those weekends, because of her weekend work schedule, she has been using the services of Ms. Baker as a babysitter, and also, her friend Kim. The position of the mother is that given the present circumstances that the husband works the balance of the week with the wife working usually on weekends, that primary physical custody would better be served by vesting the same in the mother, since she is ava:l.lable throughout the course of the week, and the father having temporary custody in the form of weekend custodial arrangements. -6- Deatr.iok, has from either prior to the date of separation, been extremely physicJal, has manifested a bad temper and has, on many oooasions, used vulgar and obscene language even in the presence of the ohildren. On several oooasions, Mr. Deatrick used profanity and physical threats towards Mrs. Deatrick's father when he merely endeavored to visit with his grandchildren. Additionally, the mental and emotional health of eaoh parent is certainly relevant. See, Hall v. Mason, 316 Pa. Super. 160, 462 A.2d 847 (1983). Testimony will likewise reveal that the emotional state of Mr. Deatriok i.s, at best, questionable. He flies into fits of rage, has admittedly physioally accosted Mrs. Deatrick, Mrs. Deatriok's father, and has even go so far as to write a suioide note threatening to kill himself over this domestic matter. In Hall v. Mason, 316 Pa. Super. 160, 462 A.2d 847 (1983), the Superior Court opined that custody should be awarded to the father where the mother I s emotional instability was evidenced by a suioi.de attempt. As it relates to the religious training of the ohi1dren, there is no question but such is relevant. See, R.L.H. v. G.D.H., 318 Pa. Super. 330, 464 A.2d 1368 (1983). Evidenoe will reveal -8- child during the day, as opposed to awarding custody to the father, who would have had his sister care for the children. In the case at bar., the determination of the Court, as it relates to the work schedule of the father, would be a contest between the sister-in-law of the father or the mother, who does not work. Clearly, therefore, the custodial issue, as it relates to the care during the time of employment schedule of the father, is certainly a factor for the Court to consider. Evidence will reveal that the father's work schedule is a work schedule that effectively has him work all day through the week, having the weekends free, whereas the mother works primarily on the weekends, and has weekdays free. At the present time, in addition, the children are subjected to a 4:30 a.m. time frame when they have to get up in order to be able to go to the sister-in-law's because of the father's work schedule. -lO- By / ,~~_! _"<:::::O_.___".,n,,- P. For the summer of 1991 and all summers hereinafter unless otherwise ordered, Kirk and Dlake shall have one (1) month with their Mom and one (1) month with their Dad. The third month they shall be in their resp~ctive llomes unl~ss the parties agree otherwise. Dawn may well be seeking summer employment. Her joh may result in her remaining with her Fathor or with her Mother depending on job location, convenience, etc. Depending on / , / whether sha works and whore sho Htay~~ she shall have the option of visiting the other parent. Occasionally Monday hOlidnys will coma along and in the even a Monday holiday covers a visitation poriod, the parent in custody shall have his or hor vlsitntlon period oxtended until 5130 p.m. on the Monday hOliday. WIth respect to Christmas of 1990, Father shall have the children commencing Friday, the 21st of December until 11,00 o'clock on December 25 at which time Hother shall piCk the children up and keep them until 6,00 p.m. December 26 and 27 shall not be. tho subject of visits. Commencing December 28 the children ~hall be ~Ilth their Mother until January 1 at 11,00 a.m. at which ti~e Fabher shall pick th children up and have them until 6:00 p.m. Mom shall have the kids Mother's Day and Father shall have the Idds Father's Day and those visits shall. extend to the entir weekend as though it ware a weekend as above. Both parents shall have equal access to the children at Gchool with respect to grades, records, health matters, and both parents shall be notified concerning important events such as parent/teacher conreronces, activities in which the kids are involved, and such othor similar matters. Philpott, Esquire, and the Children, Kirk DeatrIck and Blake Deatrick 3. As the Children had previously resided in Perry County, two prior Orders have been entered by Judge Rehkamp, Court of COIlIllOn Pleas of the 41st Judicial District of Pennsylvania, Perry County Branch, on September 3, 1992 and June 4, 1997. These Orders, copies of which are attached to this report, set forth the basic custody arrangements between the parties. The Mother. filed this Petition for Modification to allow flexibility in the custody schedule so that the parties' oldest son, Kirk, could obtain a job over the slllllller and also to insure that the parties' youngest son, Blake, is able to participate in sports and other activities without interruption when he is in the Father's custody. 4. 1he parties agreed at the Conference to continue under the existing custody schedule wi th the addi tion of a provision addressing flexibility to accomoclate the Children's activities and employment. The Mother filed this Petition for Modification to allow flexibility in the custody schedule so that the parties I oldest son, Kirk, could obtain a job over the sumner and also to insure that the parties' youngest son, Blake, is able to participate in sports and other activities without interruption when he is in the Father's custody. 4. The parties agreed at the Conference to continue under the existing custody schedule with the addition of a provision addressing flexibility to accolOCldate the Children's activities and employment.
