GRANTED and Defendant is hereby directed to produce the identified videotape within
days of the date of this Order. Pailure to comply with this Order will result in sanctions pursuant
to Pa, R. C. p, 4019,

3, On or about August 27, 1998, Mr, Welt mer received Defendant's Answers to
Plaintiff's Interrogatories Lnd responses to Plaintiff's Request for Produotion of Documents,
(Defendant's Answers to Plaintiff's Interrogatories are attached hereto as Exhibit "A" and
Defendant's Response to Plaintiff's Request for Production of Documents is attached hereto as
Exhibit "8"),
4, DefendanCs answer to Interrogatory number 9 indkales that he has possession of
a videotape that he made after the incident, which shows tramc at the scene of the incident, (See
Exhibit A, number 9),
5, Defendant's response to Mr. Weltmer's Request for Production of Documents,
number 6, also indicates that he has possession of a videotape, (See Exhibit "8"),
6, The instructions to Mr, Weltmer's Request for Production of Documents
specifically define "document" as including "written, printed, typed, recorded, or graphic matter,
however produced or reproduced. including correspondence, telegrams, other written
communications, data processing storage units, tapes, contracts, agreements, notes, memoranda,
analysis, projections, indices, work papers, studies, repol1s, surveys, diaries, calendars, films,
photographs, diagrams. drawings "," (A copy ofMr, Weltmer's Request for Production of
Documents is attached hereto as Exhibit "C"),

7, Request for Production of Documents number 7 specifically requests all
documents identified in your answers to any set of interrogatories propounded In this matter,
8, Defendant did not produce a copy of the videotape, nor did the Defendant make
the videotape available for review by Mr, Weltmer's counsel,
9, After failing to receive the videotape, Mr, Weltmcr's counsel requested from
Defendant's counsel an opportunity to view the Yideotape, A copy of this correspondence is
attached hereto as Exhibit "D,"
10, Again, after receiYing no response, Mr, Welt mer's counsel requested an
opportunity to view the videotape, A copy of counsel's March 4, 1999 letter is attached hereto as
Exhibit "E,"
11, To date. Defendant has still failed to produce the identified Yideotape,
12, Pa, R C, p, 4019(a)(I)(vii) states, "The court may. on motion. make an
appropriate order if a party, in response to a request for production or inspection made pursuant
to Rule 4009, fails to respOlld that inspection will be permitted as requested or fails to permit
inspection as requested,"

13, Pa, R, C. p, 4019(a)(I)(vlll) states, "The court may, on motion, make an
appropriate order If a party or person otherwise falls to make dlscoveryor to obey an order of
court respecting discovery," Defcndanl Is falling to makc discovery by refusing to produce the
requested videotape,
14, Mr, Weltmer's case Is severely prejudiced without having an opportunity to review
this videotape,
WHEREFORE, Mr, Weltmer respectfully requests that this Honorable Court grant his
Motion to Compel and that Defendant be directed to produce the identified videotape,

that at the subject time Sherry Stephenson was travelling
southbound on Bridge Street and had stopped or slowed her vehicle
in anticipation of making a left turn onto eastbound Fourth Street.
It is further admitted that Ms. Weltmer proceeded into the
intersection of Bridge Street and Fourth Street. The remaining
facts averred in Paragraph B of the Complaint are denied.

WHBRBFORE, Defendant demands judgment in his favor dismissing
the Complaint and awarding Defendant his costs and attorneys' fees

NBW I!:fATTBR
16. Eastbound traffic on Fourth Street is controlled by a
stop sign at the Bridge Street intersection.
17. There is no stop sign or traffic signal controlling
southbound traffic on Bridge Street at the Fourth Street
intersection.
18. Southbound traffic on Bridge Street has the right-of-way
vis-a-vis eastbound traffic on Fourth Street.
19. The accident described in the Complaint was directly and
proximately caused by the negligence of Ms. Weltmer in that she:
a. failed to exercise reasonable care in the
operation of Plaintiff's vehicle;
b. operated Plaintiff's vehicle in such a manner
as to cause a COllision with Defendant's vehicle;
c. failed to be alert and keep a proper lookout
for other vehicles on the rOiidway;

d. drove inattentively wi thollt regard to the
rights and safety of Defendant;
e. failed to yield the right-of-way to Defendant
as his vehicle entered the intersection; and
f. violated 75 Pa.C.S. 3323(b).
20. Ms. Weltmer' s negligence, as aforesaid, was a substantial
factor in causing the accident.
21. Any damages incurred by Plaintiff were directly and
proximately caused by Ms. Weltmer's negligence, as aforesaid.
22. Ms. Weltmer's negligence / as aforesaid, is imputed to
Plaintiff for purposes of this action.
23. Ms. Weltmer's negligence, as aforesaid, was greater than
Defendant's causal negligence, if any, and Plaintiff's claim is,
therefore, barred by 42 Pa.C.S. S7102(a}.
WHEREFORE, Defendant demands judgment in his favor dismissing
the Complaint and awarding Defendant his costs and attorneys' fees
together with such other relief as the Court deems appropriate.

8, Pa, R,C,P, 4019(a)(I)(viii) states, "The court may, on motion, make an
appropriate order if a party or person otherwise falls to make discovery or to obey an order of
court respecting discovery,
9, Rule 40 1 9(c)(2) states, "The court, when acting under subdivision (a) of this rule,
may make an order refusing to allow the disobedient party to support or oppose designated claims
or defenses or prohibiting him from introducing in evidence designated documents, things
or testimony or from introducing evidence of physical or mental condition," (emphasis supplied),
10, Rule 4019(c)(5) states, "The court, when acting under subdivision (a) of this rule,
may make such order with regard to the failure to make discovery as is just."
II. Rule 4019(g)(I) authorizes the imposition ofmonetalY sanctions against a
disobedient party who fails to obey an order of court, This rule authorizes that a party may be
required to pay the moving party's reasonable expenses, including attorney's fees, incurred in
obtaining the order of compliance and the order for sanctions, See Pa, R.C,p, 4019(g)(I),
12, Defendant has failed to comply with an order of court respecting discovery;
therefore, Plaintiff rcspectfully submits that this Honorable Court is well within its discretion to
preclude Defendant from utilizing videotape at trial and this Court is well within its discretion to
impose a monetary sanction upon Defendant for his failure to comply with discovery Orders,

MOTION FOR LEAVE TO WITHDRAW APPEARANCE
AND NOW, comes Mark E. Halbruner, Esquire (hereinafter
"Petitioner"), of the law firm of Gates & Associates, P.C., and
pursuant to Pa.R.C.p. 1012(b), makes the fallowing motion for leave
to wi thdraw his appearance as counsel for E:ric Steven CrOWley
(hereinafter "Defendant") in the above-captioned action:
1. Petitioner is an attorney-at-law practicing with the law
firm of Gates & Associates, P.C., 1013 Mumma Road, Suite 100,
Lemoyns, Cumberland County, Pennsylvania 17043.
2. By way of a praecipe filed on May 8, 1998, Petitioner
entered his appearance as counsel for Defendant.
3, The pleadings are closed, and the parties have engaged in
discovery.
4. In his answer to PlaIntiff I s interrogatories, Defendant
revealed that. he had videotaped the scene of the automobile
accident which is the subject of this action.
5. On several occasions, Plaintiff's counsel informally
requested that the videotape be produced for his inspection.
6. After each such request, Petitioner gave Plaintiff
written notice of the request and advised Plaintiff to deliver the
videotape to petitioner so that. he could review the tape.
7. Plaintiff never responded to petitionor's correspondence
nor did he produce the videotape.
8. On April 13, 1999, PlaintIff obtained a rule directing
Defendant to show cause why he should not produce the videotape for
inspection.
9. Petitioner received the rule and promptly provided
Defendant with a copy of the same along with a letter explaining
the need to respond to the rule.
10. The return period on the rule elapsed wi th no response
from Def endant.
11. On June 10, 1999, Plaintiff obtained an order directing
Defendant to produce the videotape within twenty days or suffer
sanctions pursuant to Pa.R.C.P 4019.

Defendant with a copy of the same along wi th a letter explaining
the need to respond to the order and further explaining that
Petitioner would withdraw as his counsel if he did not contact
Petitioner by June 28, 1999.
13. Defendant has not produced the videotape nor contacted
peti tioner regarding the production order.
14. Throughout the discovery proceedings, Peti tioner has left
telephone messages at Defendant I s residence, but Defendant has not
returned the calls.
