6, Dcfendant filed a timcly appcal to the Order of October IS. 1996, and the
declaratory Judgment matter was reviewed by the Pennsylvllnia Superior Court.
7. By Order dllted Janulll'Y 29, 1998, the Pennsylvllnia Superior Court, Ford Elliott,
Eakin and Olszewski, JJ., aflirmed the Judgment of the Court o!'Commonl'leas. A true IInd
correct copy of said Order of thc Superior Court is attached herl'lo and incorporated liS Exhibit
"B",
8, On 01' about December 27, 1990, the Plaintifl'and Defendant had conveyed to
them a cet1ain timeshare unit known as the "Fairfield Williamsburg" ("timeshare unit"), a tl1le and
correct copy of the deed of conveyance is attached hereto as Exhibit "e" and is incorporated,
9, Neither Plaintifl nOt' Defendant indicated to any individual repl'esenling the Seller
of the timeshare unit that Plaintiff and Defendant were husband and wife,
10, The deed created to convey the timeshare unit to the Plaintiff and the Defendant
incorrectly identil1ed them as being "husband and wife,"
9, In connection with the purchase of the timeshare unit, the parties executed a Time-
Share Estate Contract Purchase Agreement and Installment Note ("Purchase Agreement"), alme
and correct copy of the Purchase Agreement is attached hereto and is incorporated by reference
as Exhibit "D",
10, The purchase pricefor the timeshare unit was $11,700.00. The Defendant
provided a check in the amount 01'$3,500,00 at the time of conveyance and the balance of the
purchase price was financed as set forth in the Purchase Agreement.
11. Subsequent to lhe purchase of the timeshare unit, PlaintitTl'eimbursed the
Defendant for the down payment she had previously made and l'laintill~ in his name alone,
obtained a loan from a local bank to rayoll'the remaining balance due under the Purchase
Agreement. Moreover, Plainti!l' has repaid in full this refinancing loan.

13. Defendant has failed to make any payment against the obligation created for the
purchase of the timeshare unit.
14, The Purchase Agreement created a joint and several obligation of the parties to
pay for the timeshare unit.
15, Defendant has sought to use and e'1ioy the timeshare unit and has canceled
attempts by Plaintiff to use the timeshare unit when Plaintitl'has scheduled use thereof.
16, Since the purchase of the timeshare unit, Plaintifl'alone has paid and continues to
pay yearly maintenance fees lor the limeshare unit.
WHEREFORE, Plaintitl' requests that Defendant be ordered and directed to contribute
one-half of the purchase price and maintenance fees paid by Plaintiff for the timeshare unit, pILls
interest and costs and such fWiher relief as this Court may deem just and proper.
COUNT II-GLEN C. WITMER v. JOY E. MYERS
REFORMATION

18. Alternatively, Plainlitl'was under the understanding at the time of the purchase of
the timeshare that he would be the sole owner of the timeshare ullit.
19, Plalntlf1' has always maintained that he lInd the Defendant were not and are not
married, This position has been adjudicated and found to be the case.
20, The deed of conveyance 101' the timeshare unit incorrectly and mistakenly identll1es
the l'laintitl' and Defendant as being husband and wife.
21. The Defendant has failed and refused to join in to reconvey the property solely to
Plaintifhs an individual.
WHEREFORE, PlaintitTrequests that the Court order and direct that the deed by
reformed to identify Plaintiff as the owner of the timeshare unit as an individual and such other
relief as this Court may deem just and proper. Alternatively, PlaintitT requests that the Court
declare the rights of the parties to the timeshare property by issuance of a declaratory judgment.
COUNT-III GLEN C, WITMER v, JOY E, MYERS
BREACH OF CONTRACT

23, On or about June 30, 1987, PlaintitTopened a checking account number
760044776 at CCNB Bank N.A ("account"),
24, Defendant was named on the account permitting her to write checks from the
account.
25, This account was intended by PlaintitTto be used primarily for obligations relating
to two rental properties owned by PlaintilT and for receipts generated by the rental properties.
26, On or about October 28, 1991, PlaintilTmade a deposit 01'$6,044,26 Into the
account.

After a thorough review ofthe record, the briefs of the parties, the relevant
law, and the well-reasoned opinion of the trial court, we hold that the arguments
proffered by appellant lire without merit as the trial court applied the proper
principles oflaw as it proceeded to its ruling. Appellant is essentially asking this
court to re-weigh the testimony and evidence ofrecord, Under our scope ofrr.view
as set forth previously, we may not substitute our judgment for that ofthe trial
court, Accordingly, we affirm on the basis of the trial court's opinion.

I. A Complaint was flied in equity in the above-captioned action on Aprill, 1998.
2. Service was made upon the Defendant on April 9, 1998.
3. Count I of the above-referenced Complaint demands relief based upon
"Contribution. "
4. The action in Count I is based upon a real estate transaction which occurred in
the Commonwealth of Virginia and in which the real estate at issue, being a time-share
unit, exists in the Commonwealth of Virginia.
5. The Count 11 of the Complaint demands relief based upon "Reformation." The
relief requested by the Plaintiff in Count 11 relates to a request that the ownership of real
estate in the Commonweaith of Virginia be transferred from joint names of the parties into
Plaintifrs name a/one.
6. Count III of' Plaintiff's Complaint is a request for relief based upon an oral
contract.
7. The relief requested in Count III of Plaintiffs Complaint relates to an oral
contract allegedly entered into on or about October 28, 1991, between the named parties.

9. The cause of action claimed in Count III of Plaintiff's Complaint on an oral

which relief can be granted because the Complaint was not brought until six and one-half
years after the cause arose, and therefore, beyond the statute of limitations for bringing
suit upon an oral contract.
WHEREFORE, Plaintiff requests your Honorable Court to strike and dismiss
Count III ofPlaintitl's Complaint, with prejudice, for failure to comply with the statute of
limitations.
