WHEREAS, KOLLAS AND COSTOPOUWS, of 1104 FCOlwood Avenue, Camp
Hill, Cumberland COUllty, Pennsylvania, hereinafter referred to as Owner, Is about to execute
contemporaneously herewith, a contract, with RUSSELL A. TIDAV, for the erection ofa house
ancllllllY to development in a complex known as Wertz Run Heights, Cumberland County,
Pennsylvania, construction described as follows:
ALL THOSE CERTAIN tracts or parcels of ground on Lot No.7 of North Middleton
TOIWship, Cumb,rland County. I)ennsylvanis, more particularly bounded and described liS set forth
in Exhibit "A" attached hereto and made a part hereof
NOW, this 2nd day of April. 1998, at tlte time of and ilmnediately before the execution
of the principal contract dated April 2, 1998, and before any authority has been given by the said
Owner, to the said Contractor to commence work on the said building, or purchase materials for the
same hI consideration of tho marking of the said contract with Owner, and the further consideration
of One Dollar snd 00/100 ($1 ,00), to Contractor paid by O\wer, it is agreed that no Hen shall be filed
against the building by the contractor, or any sub-oontractor, nor by any of the material men 01'
workmen or any otber person for any labor, or materials purohased, or extra labor or IlIIlterials
purohased for the erection of said building, the right to file such Hens heing expressly walved,
